PLACE: COUNCIL CHAMBERS CALL TO ORDER The meeting was called to order at 7:OO P.M. ROLL CALL xx x 1 X X X Present Commissioner Nelson was absent. # Absent PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Minutes of October 27, 1976 - Approved with following X Motion changes: (1) Indicate on approval of Minutes and Reso- Ayes xxx xx David M. (4) Add amendment to the By-Laws of the APPROVAL OF RESOLUTIONS Resolution No. 1292, (CUP-60), City of Carlsbad - The Motion X staff was directed to redraft-the resolution to include Ayes xxx xx x the following and to be brought back before the Com- Absent X mission at their November 22, 1976 meeting: (1) Under findings, indicate that the Commission found there was no reason why the trailer could not be removed. (2) List Code Sections and the reason why the trailer is in violation of this section. WRITTEN COMMUNICATIONS None ORAL COMMUNICATIONS Assistant Planning Director Bud Plender passed out to .the Commissioners a mock-up of what the Planning Com- mission Agendas will look like for the next three meet- ings. There was then a discussion as to whether or not to have a second Commission meeting in December. It had normal- ly been the practice of the Commission not to hold the second meeting. A Minute Motion was made to eliminate the December 22, Motion X 1976 meeting, and to decide at the November 22, 1976 Ayes xx xx meeting whether to have a meeting on December 15, 1976 Noes X X as well as on December 8, 1976. Absent X PUBLIC HEARINGS Continued Case No. GPA.-40, Peggy R. Hadley - Request for approval of a General Plan Amendment from P-I (Planned Industrial I to RRE (Extensive Regional Retail). Com- missioner Watson suggested that perhaps the applicant did not receive suffici6nt notice of the hearing as the reports were not mailed out till Friday and this was a Monday hearing instead of the normal Wednesday hearing. Bud Plender gave the staff presentation and advised the Commission that the applicant had .called and would not be present because of a' prior commitment. The appli- cant"s representative, Mr's. Ramirez, 1211 Chestnut, Carlsbad (729-8360), was not able to be present either, but could be reached by phone after 9:30 P.M. if the Commission had any questions. Mrs. Victor Soto (representative of the Peter D. Aguilar property), 985 Oak Avenue, Carlsbad said they had no objection to the greenhouse being constructed. A Motion was made approving CUP-127 for the reasons Motion X and conditions outlined in the staff report. Ayes x xx x xx Absent X .. Case No. 76-13, Samuel W. Pearlman - Request for approval of a 3 lot, 16 dwelling unit co.ndominium project. . .. Bud Plender advised the C.ommission that a letter had - been received from Bob Ladwig. of R,ick Engineering, repr-esentative of Mr, Pearlman, requesting that this "item. be continued as the applicant had not finalized. his agreements with the school districts. Bob Ladwig, Rick Engineering, 3088 Pi0 Pico, Carlsbad ' asked that this item be continued to the November 22, 1976 meetin,g for the above reason. A motion was made to continue CT 76-13 to the November Moti-on X 22, 1976 Planning Commission Meeting. Ayes x xx Case No. 76-16, John McKeand - Request for approval of x: x x i a 7 unit,. 1 lot condominium project, on a 1 ac're I parcel. Bud Plender.gave the staff presentation and used f various maps to indicate the location of the project. t Commissioner Fikes said that the parcel indicated on 0 the area map was the wrong parcel and it should be moved up one. PLACE: COUNCIL CHAMBERS Page The Commission then asked what recreational facili-ties would be provided and were advised there would be no facilities with this .project. The Commission also inquired as to whether this project would a part of the development ai ready com'pleted next to it and wanted to know if the other development would be .using some of the par.king provided by CT 76-16. The Commis.- sion was also concerned about siltation and the pro- posed drainage system. Har-ry L. Truax, Brian Smith Engineers, Inc. , 2656 State Street, Carlsbad spoke on behalf of the applican and stated that they had no objection to any of the conditions as outlined in the staff report. He said - he felt the proposed drainage sysvem would be adequate Mr. Truax said this development would be combined with the prior development, all un-its would belong to the same Home Owner's Assotiation, would share the parking spaces and would be completely interrelated. A Motion was made recommending approval of CT 76-16 as per findi,ngs and conditions of staff report with Conditi'on #7.'to require a silt trap. .. Case Nos. CT 76-12 and PUD-4, Calavera Hills, Robert Ladwig (Agent) - Request for approval of a tentative tract map and pl.anned unit .development to provide 167 dwelling unit, '172 1o.t sudivision on approximately 63 acres. Bud Plender gave the staff report. indicating that staff's recommendation is to deny CT 76-12 and PUD-4 without prejudice for' the reasons outlined in the staff report. He also pointed out to the Commission that Master Plan 150 should be revised in order to rectify some'of the existing conflicts with park and.schoo1 sit-es. Mr. P1-ender advised the Commission that the applicant did not wish to update the Master Plan at this time and .had chosen the PUD process as an alterna- tive. Bob Ladwig, Ri-ck EngineeriBg, 3088 Pi0 Pico, Carlsbad said that.an acceptable school let-ter had been re- ceived from the Carlsbad Unified 'School District dated November 8, 1976 (each Commissioner given one) and he requested that this item be heard .at the November 22, 4-976 meetin-g. Mr. Ladwi.g fel't all changes were minor ---h. nature,.thw the Maste.r Plan did not need revising. The Commission then discussed the Supplemental Environ mental Impact Report and'that the current-Master Plan does not requ.ire .an Economic Impact Report. Amotion was made to conti'nue this item to the Novem- ber 22, 19.76 meeting 'Commissioner Larson then brought up the subject of school facilities because of the Pecent tone of the letters received from the school districts regarding future crowding, transportation problems, etc. A Minute Motion was made directing s-taff to express the Commission's concern re school facilities and their availability to the City Manager and to the City Council.
