PUBLIC HEARINGS Continued 1) Case Nos. CT 76-1-5 and PUD-6, Douglass Southwest - Request for deletion of Specific Plan 115 Cit.y Council Resolution No.' 3177. Auaust 7. 1973 l and a'pproval of CT 76-15 and- PUD-6 to 'allow 136 single-family detached dwellings on 43.99 acres. It is noted. for the record that Commissioner Romb0ti.s would abstain from participating in t3is hearinq as -- -I .I I -fie. has. an intmest in the.ad.jacent property. Chairman L'Heureux advised the applicant that it w.ould be necessar.y to have 4 votes either for approval or denial and there were onlv 5 Commissioners (Commissioner Nelson had not yet arrived). The applicant stated they would like to proceed with the hearinq. Acting Planninq Director Bud Plender qave the.staff presentation stating that -the property is located on the west side of El Camino Real on both sides of Tamarack Avenue. Originally, the site was approved for. 331 units, most being attached condominiums with some single-family .resi.dences in the western portion near Skyline Drive. This was approved through SP-115 Camino Real has been completed. CT 73-8 has expires, but SP-115 is.stil1 in effect. The applicant has-lots frontinq onto Tamarack and has created a service road so that property owners wwld back out o-nto this service road and then drive onto Tamarack. It was also pointed out that the . applicant had been working with the Parks and Recrea- tion Directqr to work out problems that exist with location of the parks and dedication of same. The Commissioners then discussed the service road and how traffic would be control1e.d on this road, how-would one way traffic be ensured, who would police parking on only one side of the service road, whether or not there was p.roper lighting, etc. Dan Salerno-and Roger Snipes, Snipes and Salerno, 4007 Camino Del-!?io South, Suite 207, San Diego, California 92108, tngineers for the project, gave a brief background history of the project and stated that the current project would provide all the amenities of single-family homes.with low maintenance because of the size of the .lots (zero lot lines.). They said there would be several mini-parks which would be passive parks, and ttiat the grading would be bench type grading. They felt. the. service road should more appropriately be. entitled private. driveways ,(there . would be 23 patio homes using 4 driveway lo4p.s). Robert Stevenson, 4930 Avila Avenue, Carlsbad, Ca. was concerned about a 15 foot mound of dirt on the property adjacent to his and this pro.ject and wanted to know what w'as to.become of this knoll. He was also very concerned about the-t-raffic-that would be generat on Neblina and Avila Avenue to get to the proposed homes located on Terrace Court. He wanted to know when Neblina Drive would be connected to the other portion of Meblina Drive. .Mr. .Stevenson was advised that the' 15 foot mound did not belonq to the applicant and also that Neb Drive would be connected at such time as the would cross'would be developed (thee- applicant own that land). .-- ~ -. 1 1 i na and it did' not Ron Schwab, 408r) Skyline Road, Carlsbad and hi.s attorney, Reed V. Langlois, 1196 Third Avenue, Chu'la Vista, CA. stated that there is current litigation to settle land ownership of a portion of the subject subdivision and would like this matter continued unt this dispute is settled ... (They were advi'sed that ownership of land did not concern the Planning Com- mission' and the matter would be he-ard). Mr. Schwab was concerned as to how he would get to his property once this land was develoPed as the aradina and buildi.ng of' Tamarack would do away with hi; driveway. PLACE: COUNCIL CHAMBERS Page 3 New ' 2) Case No. CUP-129, Robert Knauf - Request for approval of additional freestanding signs as required by Section 21.41.075(b), Carlsbad Yunicipal Code, for three auto dealerships: Hoehn Motors, Toyota of Carlsbad, and 2oric.k Buick-Opel. .Bud Plender qave the staff presentation and pointed out that Hoehn Motors had requested two fr~estandinq signs, but that staff was only recpmmending one as the required amount of footage i.s not available. Mr. Plender also mentioned that there are additional signs on the property and that the applicant says they are directionaT (there are no arrows or other directional information, thus staff believes they are advertising signs and should be subject to the requirt ments of the Code.)'If the Commission interprets them as directional signs, then a Condition 5 should be added exempting them; and if the Commission interpret: them as staff does, staTf will require their removal in conformance with Conditi,on 4. He- was in agreement with the-condition: outlined for Rorick Buick-Ope1 and for Toyota of .. Carlsbad. One of them being that the drive into Rorick Buick-Ope did not square up with the median cut and for this to be corrected, the building would have to be mo.ved so that the drive would line up with the entrance to the site. Robert Knauf, Attorney at Law, 810 Mission Avenue, Suite 300, Oceanside, CA. spoke on behalf of the applicant. He said that the enaineer. Mr. Richardson. was present and had advised himdthat the site could be moved and drives would then-line up properly. The Commissioners then discussed whether there was proper lighting, enough employee as well as customer parking and landscaping. A minute motion was made approving the architectural concept for the Rorick Buick-Ope1 dealership as required by SP-19 with the following changes to the staff report: 1) proper ingress and egress to be provided to ,subject 'property that is acceptable to the City Engineer. 2) any change in the location of buildings to be approved by the Planning Director. 3) proper parking for customers and employees to be provided. 4) lighting to be of proper wattage to preclude reflection on surrounding areas. 5) land- scaping to be provided on the bank at the rear of the property. 6) any minor architectural changes to be approved by Planning Director with any major.changes to be brought back before the Commission. 4) Case No. MS-295, Mr. and Mrs. E. W. L.anger - Re- quest for approval of a Panhandle lot pursuant to Title 21, Section 21.10.080. .. Mr. Bud Plender gave the staff presentation . Frank Wells, 2311 Waring'Way, Carlsbad, represented the applicants, and stated that the findings as pre- pared by the staff and conditions were fully acceptable A motion was made approving MS-29-5 for the reasons outlined in the staff report. .5) Sale. of City Owned Property Bill-Baldwin, -Assistant City Manager, asked the Commission to approve the sale of City Owned Property in that it was not to be used by the City of Carlsbad. The property is adjacent to the Fire Station on Elm Avenue. A. minute motion was made. approving the sale of this property. 6) Selection of Planning Commission Chairman for 197; A motion was made recommending that Commissionek LarSOn be Chairman for 1977.
