APPROVAL OF MINUTES Minutes of December 22, 1976 were approved with the chanse that Commissioner Jose was the maker of both motions under Item #6. ,. ORAL COM_F.UNICATIONS 1) Announcement of 1977 Planning Commissioners' Institute in Los Anqeles, Februarv 2-4, 1977. 2) The Comrxehensive Planning Orqanization's slide presentation on the 208 Program (area-wide water quality management plan - funded throuqh federal legislation). Rick Alexander of CPO made the presentation. .. 3) Acting Planninq Director Bud Plender announced that 2 new items have been added under New Business. PUBLIC HEARINGS Continued 1) Case No. ZC-183, David Koyl - Request for appro val of a change of zone from R-1-7500 to RD-M.. David Koyl, 2104 Linda Lane, Carlsbad stated that he wishes to construct 20 units in conjunction with another 44 units he has already constructed adjacent to suhj-t property. Acting Planning Director Bud Plender stated that staff is recommendinq approval. A motion was made to approve Resolution No.'131n for a change of zone from R-1-7500 to RD-M for the reasons contained in the staff report. 2) Case No. CUP-128, City of Carlsbad - Request for approval of a conditional use permit to allow the utilization of the old St. Patrick's Church site for recreational activities and meetings. Bud Plender asked for a continuance until 1/28/77 in order for the Barks & Recreation Department to obtain more information. A minute motion was made to continue Case No. CUP-128 until the January 26th, 1977 meeting. New 3) Case No. CUP-130, Leucadia County Water Distric Request for approval for construction of a public buildinq, as required by Section 21.42.010(21) of the Municipal Code. Richard Hanson, Manaqer., Le'ucadia County Water District, 1959' 'El' c'amin'o' Real, Leuc'adia, CA stated. that the proposed new access road to the proposed building will be shared with the La Costa#Shoppinq Center. They feel that adherance to Condition 6 (a) of the January 12th staff report would be extremely difficult since they are advertisinq for a bid openinq in February. Bud Plender stated that since the City has been assured by La Costa that they will share .the access road with LCWD, the Planning Department would then. - recommend that the wordinq of Condition 6(a) be '. changed from "prior to building permit" to "prior to Occupancy". A motion was made to approve Resolution No. 1311 Motion X with the change in Condition 6(a) suggested by staff. Ayes X X xxx . .- - " " - . .. .- ~: : 4) Case - No. ZC-186, Ross Winton - Request for approval of a change of zone from R-1-15,000 to Mike Zander qave the staff presentation. He stated that staff is recommending that this item be tabled until staff knows whether applicant is going to sub- mit a variance request rather than recruest the zone change. A minute motion was made to table 1tem.K-186. 5) Cf - Request for amroval of a General Plan Amendment (Land Use Eiement) from PI (Planned Industrial) to RRE (Extensive Regional Retail). Mike Zander made the staff presentationandatated tha the Planning Department recommended densid of the designation change from PI to RRE, but recommended the alternative of chanqinq the land use designation from ?I to Travel Services (7's). Nicholas C. Banche, Attorney at Law, 702 Fourth Street, Ocenaside, CA 92054 spoke on behalf of the aDPlicant. He stated that the applicant aqrees that the Travel Services (TS) alternative -suggested by staff is a good desicrnation. They therefore would abandon their request to -amend the Land Use Element by changing certain property from a PI designation to an RRE designation, and would instead request the chanqe t'o the Travel Services designa- tion. Les Evans, General Manaqer, Encina Joint Sewerage Facility, 6200 Avenida Encinas, Carlsbad, CA said that the Encina Facility at times causes odor problems in the surroundinq area. Since they are such close neighbors to the subject property, they are concerned that a Travel Services designation would allow a hotel to be constructed. Perhaps the guests would be offended by the odor pollution, and consequently have a bad image of the City of Carlsba if they happened to be visiting on certain days. A designation which allowed a more permanent occup- ancy perhaps would be best, since, if the odor . problem would arise, it would not be so evident. Flo t ion ~ Aves X X X I! Banche stated that there are no permanent Plans for th,e subject property A motion was made to approve Resolution No. 1312 with the change in designation recommended by staff 6) Case No. GPA-43, City of Car'lsbad - General Pla I8 Summary. ,. - It was noted that perhaps this General Plan Summary is the most comprehensive in the County. A motion was made to approve Resolution.No. 1313, recommending certification of: GPA-43 bv' the City. : Council. .. NEW BUSINESS 7) Case No. CUP-101 (A) ; Bank of Aperica. Report on a Temporary Structure. - -Status This item was accepted with no further action necessary. 8) Case No. CUP-86 (A) .- Gaiser Status Report on a Temporary Structure. This item was accepted with no further action necessary. 9) Case No. ZC-184, David Minnich - Report on City Council Action on City-Owned Property. ' A minute motion was made that this item be sent back to City Council with original recommendation for approval. 10) Case Nos. CT 76-12 and PUD-4, Calaver'a Hills, Bob Ladwig - Field Trip to Site. The Planning Commission, staff and the applicant will make a field trip to the site gn Thursday, January 20, 1977 at 11:30 A.M. 11) Bill Baldwin, Qeputy City Manager, explained state law concerning compensation for board and co.mmission members. 12) . Richadson Brother's House Move Staff stated that the City will have strong control over this move, and it probably will have to go he- fore the Coastal Commission.
