PLACE: COUNCIL CHAMBERS CALL TO ORDER The meeting was called to order at 7:03. ROLL CALL - Commissioner Fi kes was absent. APPROVAL OF MINUTES - The minutes of February 9, 1977, were approved without change. WRITTEN COMMUNICATIONS Assistant Planning Director Ralph Plender announced that the applicant, Marvin Humphreys, wishes a continuance until March 9, 1977, of GPA-45. Also, the Chamber of Commerce wishes a 2-week continuance on the Elm Avenue Street Name Change Resolution of Intention. He further announced that a school availability letter has been received for CT-77-1 (John McKeand, appl icant) . ' CT-74-14(A) (Russell Grosse, applicant) will be continued . also to March 9, 1977, in accordance with the applicant's request, if the Planning Commission concurs. ORAL COMMUNICATIONS George Flanders, 2168 Chestnut Street, Carlsbad, spoke on the seweage capacity si tua ti on. Following his presentat-ion, a.minute motion was made that the Public Works Administrator's latest report on Carlsbad's capacity at the Encina klater Pollution Control Eacilit3 be forwarded to the Planning Commission for review prior to any action on this situation. PUBLIC HEARINGS (Continued) (1) Case No. CUP-132, Don Snowbarger' (Agent) - Request for approval ot a conditional use permit to allow installa- tion of a freestanding sign pursuant to Title 21, Section 21.41.075(b). Commissioner Rombotis announced that he would abstain from voting on this project. Commissioner Nelson announced that ,he would be qualified to vote on this project. Ral h Plender gave the staff presentation. He said that *at the proposed location for the sign is'good. Don Snowbarger, Home Federal Savings & Loan, 701 Broadway, San Diego, CA 92112, said they have provided, the information requested at the February 9th +meeting. He explained that they had chosen the site location because it is in line with the shape of the other buildings. Geor e Flanders said that the proposed sign hoes -not blend *e Hispanic motif which is supposed to be used along El Camino R,eal . He feels sign usage should be made part of the original approval of the building, and not come in later with a CUP request which does not have to go before the City Council. He believes that this sign is obtrusive, and doesn't follow the motif of El Camino Real. A motion was .made to approve CUP-132 with the added condition that the sign structure not be in. excess Of 8 feet &me the surface of the sidewalk, and to be located in the area designated in Exhibit A. PLACE: COUNCIL CHAMBERS Page 2 , , (2) Case No. GPA-45, Marvin Humphreys - Request for an amendment to the Land Use Element of the General Plan - to provide for a change in designation from-RM (residen- tial-medium density) to 0 (professional and related commercial). Ralph Plender stated that the applicant wishes a continuance. Jack Sprague, 5350 Baltimore Drive,La Mesa, who may not be available if the item is continued, read a letter stating that he is the owner of property across the street from subject location. He is in favor of the project but would like motif to be Spanish, the trees left on the site and .no blinking lights. (Subdued lighting would be acceptable.) He does not want his property to be adversely affected if subject project is not done well. It was’ pointed out that the City has ordinances to cover these concerns. A motion was made to continue GPA-45 until March 9, 1977. (3) Case No. CT 77-1 , John McKeand - Request for approval of a 15-unit, 1-lot condominium project with recreation a1 facilities on a 1-acre site. “-b- Ral h Plender gave the staff report, stating that this prop- erty had een before the Commission on earlier occasions. and- 7 units had been approved. The. appl icant, however, now wishes approval of 15 units. Though this property is not directly fronting on the Buena Vista Lagoon, public dedica- tion in the flood plain would be required, for public walk- ways or access to the Lagoon. Mr. Plender further stated that the natural drainage flow is into the Lagoon. Condition No. 7 of the Staff Report allows f0r.a closed drainage system so as not to erode away the bluff. In answer to questions, City Engineer Tim Flanagan, state’d that a drainage collection basin to prevent oil, etc. from entering the Lagoon from the project would be impractical , since the project is small. On large projects, such as shopping centers , it is much more practical to have such sys tems . Mr. Plender further stated that 2 of the existing mature tree! would have to be removed. Some other trees on the site are unhealthy and might have to be removed also. Parks and Recreation is aware of this condition. Harry Truax, Brian Smith Engineering, 2656 State Street, Carlsbad, spoke for the developer, stating that the develope has financing and Coastal Commission approval and permit. All the conditions are satisfactory. George Flanders asked that when a project such as this, adjac ent a Lagoon, comes up for approval, why is an EIR not re- quired from the developer? The runoff into the Lagoon could be critical and have far-reaching effects. Harry Truax pointed that that the earlier project had been reviewed in December of 1976 and the original status is still in effect as far as environmental impact and Coastal Comm- ission requirements. A motion was made to approve CT 77-1. (Res’olution No. 133 AT THIS POINT, COMMISSIONER WATSON LEFT THE. MEETING. PLACE: - COUNCIL CHAMBERS (4) Case No. CT 74-14(A), Russell W. Grosse -'Request for approval of a revised tentative tract map to provide a 244-dwelling unit, 246-lot subdivision on approxi- mately 83.3 acres and a modification of the original conditions of approval. Applicant Russell W. Grosse requested a continuance of this item since there are only 5 Commissioners present and he would need 4 ayes for approval. Corrnni ssioner L I Heureux requested from the developer a 1 arger- scale map indicating how these proposed streets in this development would interrelate with existing roadways and ---.other proposed subdivision. He also wants to know the time- table for this road development. He also asked that he be given a copy of the EIR on the earlier project. Mike Zander, Associate Planner, promised that a staff Tl 1974, would be made available. After more discussion on various conditions of the staff report and conditions of the original subdivision proposal,. a motion was made to continue CT 74-14(A) to March 9, 1977. (5) Case No. CUP-133, Robert. Knauf (Agent) - Request for approval of a conditional use permit to retain an additional freestanding sign for Dixon Ford (Car . Country) on Paseo del Norte. bp and must either come down or remain standing Ral h Plender gave the staff presentation, explaining that under a conditional use permit. The sign meets all require- ments of the City ordinance and fits in well with the. sur-. rounding area. Norman Vetter, Feist, Vetter, Knauf .& Loy, 810 Mission, Suite 300, Oceanside, said they agree with staff report. There'was some discussion as to whether signs of this type are economically.beneficia1 .to the business It was felt that signs of this nature provide information necessary to identify a building.. They are not used for attention gathering, as is prevalent in.some types of signs used in inferior sign programs. A .motion was made to approve CUP-133, wi'th Finding 1 (a) under Section 21.42.020 changed to: "The sign is necessary . to identify a type of subuse on the property not adequately identified by the existing permitted freestanding sign." (Resol uti on No. 1331 ) (6) 'Case No. SNC-I, City of Carlsbad - Request to consider recommending to the City Council that certain conflict- ing street names in the- ci tY of Carl shad be. changed. Thelma Hayes , Laguna Drive , Carl sbad, is concerned that the Freeway is cutting streets in two and suggested that perhaps a distinction could be made as to which side of the Freeway a particular location is situated in, such as east or west after the street name. Priority Group 1-2 will be continued to the March 9, 1977, meeting to ascertain if there are any property owners on Lagoon Lane who 1 ive in the County who should be notified. Don Brown, Carlsbad Chamber of Commerce, said that they are not ready for action on this item until they assimilate several facts which they are gathering, such as the sign changes that would have to be made on the Freeway. .Ralph Plender suggested that perhaps the Chamber should be addressing such concerns to the City Council as all the Planning Commission was asked to consider was a name change for Elm Avenue. He pointed out that there are petitions on file in the City with over 200 signatures in opposition to this name change. The Fire and Pol ice Departments also oppose this change. Resolution of Intention No. 135 - Street Name Change, Elm Avenue, was continued until the Ami1 14. 1977 Plannina Commission due to lack of a quorum. ., Resolution of Intention No. 139. - Street Name Change, SNC- I I I A motion was made to accept R of I No. 139. (9) Resolution df' Intention No. 142 - Street Name Change for Velero Court to,Velero Street, and a change for Retiro Street to Del Rey Avenue A motion was made to continue this item to allow staff to come up with another name for "Velero" as it sounds too'much 1 i ke "Bolero" which hac )]been a recomnended street name change to be considered by the City Counci 1 (SNC-I 1. (10). Resolution of Intention No. 143 - Street Name Change for A motion was made not to accept this Resolution of Intention. Marron Road. (11) Report on the Duck Feeding Area at the Buena Vista Lagoon. Commissioner Rombotis abstained from discuskion. .Lhis item. Tim Flanagan suggested that civic groups work together towards providing amenities around this area. He stated that the Chamber of Commerce feels a different area should be created for the duck feeding. The Haymar cul-de-sac would be good but it is in Oceanside. The City and the State Highway Dept. had entered into an agreement to return ownership of publicly held rights-ef-way back to the.origina1 owners, which is creating the present problems of retaining the existing duck feeding area. He stated that .Parks and Recreation is recommending fencing the area at this time, but P&R has not submitted a capital improvements program for the area. He suggested that input should be given to the City Council before such a program is initiated. A motion was made that the Planning Commission request that the City Council reconsider their capital improvements program to allow additional funds for presetvation of th.is site in the City of Carlsbad .instead of having it relocated in Oceans i de ..
