Conmissioner Jose, stated that regarding Mr. James Hagamah's mm of June 8, party honoring Mark Nelson and Jo Ward that Mr. Nelson might be going to Mexico , and , that it would be best to check with Mark to see when the party would be convenient. Bud plender, Assistant Planning Director , asked that this itern be ccmtinued until June 22, 1977 in order for additional work and notices nesessary to ccmply with the Enviromntal Protection Ordinance of 1972. A Pbtion was made to continue Cup-128 (A) for the reasons presented by staff. (3) Case No. CUP-138, H. W. Butts - Approval of a Con- ditional Use Permit to operate a residential care facility at property located at the southeast comer of Kelly Drive and El Camino &al. Mr. Bud Plender gave the staff pres&ation. He stated that a cup is required for this use and that the applicant has requested to increase car facilities fm the present four to six peysons. Staff reccpranends approval with the condition that the CUP be reviewed on a three year basis. m. -Plender stated that this care facility was in existance before the ordinance was established and therefore there is not a previous CUP. The neighbors were mtif ied under normal notification procedures. There were various questions raised regarding the folldng: 1. Is there a requirement by the City for covered parking. Was this in violation of C.C.& R's? 2. Was Condition No. 2 of the staff repart intended for thi: particular permit or is it personal to the Butts. 3. It was requested the last sentence of Condition No. 3 be reworded since it gives the impression that after three years the permit may be revoked. 4. Is there legal parking on the site? 5. Is the garage conversion-legal? 7. What is the status of the shed? , 6. The entrance way is of inportant concern. Mr. Plender stated that -ts for a garage conversion is that substitute parking has to be beyond the setback area. Secondly, such a location could be covered in the future with a carport or a garage. He stated that a certain percentage of winduws has to be provided. Mrs. Butts, 4810 Kelly Drive, Carlsbad, stated that she has been running the harrre and has worked.with the &ple for about 8 years and that the hame does have parking area for 3 to 4 cars. She said they muld put in trees, She indicated that the storage shed is used for storing a mtorcycle and that it is kept locked. A mtion was made to continue CUP-138 a the Planning ccpranission meting of June 22, 1977 based on the discussion of tk meting tonight and the staff report to dekermine if *re is legal parking on site and if the garage conversion is legal. CaTNCIL cr3wmRs THREE (4) Case No. CT 77-8/SDp 77-1, k1l-Y & msted approval of a Site bevelopnent Plan for apartments, four-plexes, a ccmercm~ center, and approval of a tract mp for tk four-plex site on property generally localied on the east side of El Easement. ' c;rmino Real between Alga Road and S.D.G. & E Mr. Bud Plender presented the staff report. He indicated that the school letter was not received, and therefore this case should be continued to June 22, 1977. Mr. Plender stated scane corrections on staff report: Page 5, the Archaeology Report can be surrmed up to indicate all of the requirerents of the conditions that have to be met. On Page 6 a condition should be added: The northern portion shall be developed as part of the aprtmnt -lex as a duplex or single family unit and all maintenance equipnmt shall be in an enclosed building, and that the site plan shall be approved by the Planning Conmission. On Page 8, No. 30, parking spaces as sham on the plan not approved to met the ordinance requirements. Mr. Bud Plender suggested that staff will take another look at the Archaeology &port. mlly Pulaski, 417 Main Street, Newport Beach, California, - stated that the l~pocrraphy _and archaeology was studied and had a meting with- staff to review this report. He stated that all conditions are acceptable and that they would be incorporated in the project. He stated that several items are to be resolved, but however the general concept and specific things had been met and the issues had been discussed. - -~~ ~ -" 1. Coarmissioner &d was- interested if the design of I ~~~~~~~~~ the buildings are going to be ccknpatible to surroundinc areas and the Scenic Highway Element. Frank Mola, 417 Main Street, Newport Beach, Calif stated that this situation where there is no alley behind the four-plexes is handled with a 20' drive. Also, that it 'doesn't need a recipricol easement becam it: is in the deed restrLction. Charles Bull, Project Archaeologist, 5620 Friars Road, San Diego, Calif, stated that the grading cut is going to be less than 60 centkters,and in saw places less. He also stated that the munt of excavation was good and also the mitigation masures will preserve the scientific value of the site. c IF Mr. Bud Plender said that traffic, of the caranercial portion would have to,be reevaluated by the traffic engineer when new plans are sulmitted. Also that water energy conservation be considered in reference to swimning pool. A Pbtion was made to continue CT 77-8/SDP 77-1, requesting the revision of staff report and review conditions therein. (5) Side Yard Calculation: Mr; Bud Plender explained haw the side yard calcu.2ations mrk against developrnent at reverse pie-shaped lots. He submitted staffs reccmm-dd changes as policy and ordinance mdmnts to rectify this problem. Planning ccarmission No. 1373 determining side yard setbadcs on reversed pie -shaped lots. Policy No. 12. Resolution of Intentia No. 187, pertaining to the definition of "Lot Width" reversed pie-shaped lots. Case No. ZCA-87. (6) Drought Resistant Landscaping, Mr. Bud Plender explain- ed what the Parks and Recreation Department is doing regarding drought resistant landscaping in Open Space maintenance areas. A Minute Pbtion was made requestin! a City Council Policy for drought-resistant landscapin! and water conserving irrigation on all private land- ~~ scaping plans. A. Minute Fbtion was also made requesting the City - . Council to direct a study on the long term impacts of Open Space costs and maintenance, and to develop mthods to reduce the need for open' space maintenance areas through grading restrictions, etc. (7) Organization of Staff Reports - A "Ute Pbtion was made creating a camittee of: Woottward, Ftmbotis and Larson toinake suggestions on a nm organization to staff report.
