Commissioner Fikes was excused from-8:OO P.M. to 8:15 P.M. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES A motion was made to approve the.Minutes of the Redevelopment Workshop, September 7, 1977, with the - added notation that Commission Rombotis was excused at 8:15 P.M. WRITTEN COMMUNICATIONS - None ORAL COMMUNICATIONS - None PUBLIC HEARINGS The items on the agenda were taken in the following order Items 1, 4, 5, 3 and 2. (Continued) (1) Case No. V-271, Mbert Gillingham (aright) - Reques' for Variance to reduce' front yard setback from 10 fe' to 7 feet on property located on the south side of Tamarack Avenue between Garfield and Carlsbad Blvd. Mr. Bud Plender, Assistant Planning Director, stated that the applicant had requested that this case be withdrawn as they have worked out the problem so that a variance is not necessary. ' The public hearing was closed at 7:lO P.M. A motion was made to withdraw Case No. V-271 as requested by the applicant. ~- .~~ ~ ~ (2) Case No. CT 77-15, Ken Reynolds - Request for approv, of a subdivision to provide 40 single family residential lots on approximately 174 acres on property located on the south side of El. Camino Real between Kelly Drive and Hidden Valley Road. Mr. Bud Plender gave the staff,presentation on CT 77-15 and Item No. 3 - SUP-2 concurrently. He stated that although the staff presentation and the public hearing would be held together, the voting on the motions should first take into consideration SUB-2. Commissioner L'Heureux questioned the public noticing.. He felt that staff had an obligation to send notices to people located within the 300' surrounding area even though they are not listed on the iatest assessment roils. Mr. Ken Reynolds, urban planner and general contractor, anc applicant, stated he is the one responsible for the design of this tract and for the preliininary grading plan. Items 5, 6, 21, 23 and 29 were clarified and Items 13, 17 and 28 were modified. (See motion.) Commissioner Woodward was concerned about traffic conflict on El Camino ReaYHer experience was that it was very difficult to negotiate a left hand turn onto El Camino Real from the area of the prowsed intersection. Comispioner Rombotis - stated that lot No. 37 had little building area because of grading and easements. In answer to questions about the sewers, E. Tim Flanagan, City Engineer, said they would.require the lateral from the main in the street stubbed out to the property so that it would be a minor changeover when the sewer capacity was available. Generally speaking the City has not required homeowners to tie into the sewer service until their septic system needed repair or major overhaul. Mr. Flanagan had no advance knowledge that the homeowners would have to hook up with the sewer service within a given period after the sewer capacity is available In answer to a discussion regarding traffic, Mr. Flanagan stated.that the traffic study from Mr. Cook was based on the assumption that 55 miles per hour was the prevailing speed on El Camino Real while in fact souiihbound it is 62 miles per hour and northbound 60 miles per hour. As the area is built up Mr. F.lanagan felt the traffic would possik slow down. Long range traffic plans include full inter- sections at Kelly Drive and on Cannon Road. The City Engineer did not plan to have a series of medium openings. Mr. Mike S%ook, 4941 El Camino, spoke in opposition to the approval of this map. His main concerns were the traffic .problems, that too many homes in the area on septic taliks was undesirable, that the usage of electricity would be a problem since they have had four blackouts in the past year and a half and that the size of the subdivision did not seem large enough to allow horses. The road that the developer would like to update and improve is owned partially by him and he has no plans at thistime to cooperate with Mr. Reynolds. He stated that he obviously did not want the subdivision *ere because it would disturb his view. Mr. Frank Fehr, 4982 Via Marta, was concerned that the impact of septic5 tanks used . by so many residents would be considerable. He felt that the owners should be required to tie into the sewer system as soon as sewer capacity is available. He also fe'lt that the traffic increase would be a serious problem. He would like to see another access to this development. .. Mr. Ken' Reynolds in rebuttal stated that he had met .with' ' the Shooks'and had discussed most of the objections raised at-the meeting. Regarding the private road, he would hope they could work together; however,'he 'does have land available for its wnstruction if they will not allow construction on their property. He said he would comply with all of the County health standards regarding the septic tanks and did not foresee any difficulty. The homes will be in line in price and size with the existing homes. Mr. Reynolds felt they had taken a positive look at the traffic situation in hiring a traffic specialist. The public hearing closed at 9:35 P.M. / ... . .. Commissioner L'Heurew said he was not satisfied with the information from staff as:.it relates to possible environ- mental problems. He is particularly concerned about the grading erosion and siltation problems especially since this property is at the mouth of the wildlife preser He was also concerned with the desirability qf using septic tanks in a large development. He does not think the subdivision is designed for horses although trails havl . been provided. He feels thatan Environmental, Impact Repo: on this property would have made him more comfortable. Commissioner Woodward said she would vote against this project because she does not think the traffic has been adequately addressed. Her main concern was getting out onto El Camino Real along with other questions raised by Commissioner L'Heureux. A motion was made to approve CT 77-15 based on the finding and subject to the conditions in the staff. report with the following corrections and changes in the conditions: No. 13 - Last sentence should read Where applicable slope! over five feet in height shall be contour graded." No. 17 - Last line - "or relocated or lot line . ' adjusted.. .I' NO. 28 - Line 3 "encunhrances or as approved by the City Engineer. I' Resolution NO. 1414 (4) Case No. SUP-29 Ken Reynolds - Request for Special USI Permit No. 2, $0 develop within the Aqua Hedionda Flood Plain, west of El Camino Real, on property located on the south side of El Camino Real between Kelly Drive and Hidden Valley Road. A motion was made to approve SUP-2. based on the findings in the staff report and with an additional finding that: ;'%!he effect of filling will be minimal because it will raise the water level less than three inches at the statio] Furthermore, the conditions as stated in the staff report with an additional condi.tion that: The approval of SUP-2 is for development as proposed in CT 77-15 only. Resolutioll No. 1415 (4) Case No. ZCA-93, City of Carlsbad - Request for approval to allow restaurants/on sale alcohol in C-1 zone. Mr. Bud Plender gave the staff presentation. He stated that Item No. 5, ZC-196, should be explained first as it is background for the zone code amendment. The City Council requested in their report back to the Planning Commission that the property in question on the zone chan be changed to C-1-Q, and asked the Planning Commission to amend the Zone code to the sale of alcoholic beverag in the C-1 zone by Conditional Use Permit. Mr. Plender stated that the reason the City Council wanted a C-1-Q zont is that it is the zone specifically designated to implement the neighborhood land bategory of the General Plan. OF c MEETING * CARLSBAD Mr. Nick Banche, 3464 Ridgecrest, said he understood that the Council agreed that Mr. Burnett should have a restaurant with the ability to sell liquor which is what Mr. Burnett was concerned with. He went along with what- ever action wdt3 necessary to accomplish this. Mr. William Burnett, Pacific Mutual Building, Los Angeles, asked for clarification of the.reference to special parkinc that might be required. He wanted reassurance-that extra- ordinary parking requirements would not be required. He said he found the requirement that' it be a bona fide restaurant completely acceptable and had no problem with the traffic question. Staff reminded the Planning Commissioners that the zone code amendment did not refer to any specific area, but would be the general guide line to follow regarding neighborhood centers. Public Hearing closed at 7:50 P.M. A general discussion by the Commissioners concerned the . parking requirements of the.ordinance and how they relate to a development, commissioner Watson suggested that the developer would know what uses were intended generally 'for his development and as long as he stayed within the stated planned uses, the parking would present no problem. Commissioner Fikes felt that when an investor purchased land based on the City requirements for parking that . the investor 2hould;be protected from extra-ordinary demand Chairman Larson expressed concern that the sale of liquor after the hours of the restaurant would not be a good use for the neighborhood. A. motion was made to approve ZCA-93 with a modification- of an additional finding that: All measures necessary to insure compability of the use with the.neighborhood have been proposed as conditional and for the- reasons given .in the staff report. Resolution No. 1416. NEW BUSINESS . (5) Case No. ZC-196, City of Carlsbad IC Mr. Bud Plender said a report is to be submitted to City Council containing Planning Commission comments regarding the zone change to C-1-Q instead of C-2-Q as the Planning Commission had recommended. A Minute Motion was made approving the zone change to . C-1-Q and staff was directed to return the report to City Council. (6) Case No. CUP-140, County of San Diego Mr. James C. Hagaman, Planning Director, asked the Commissioners to clarify the recqrd. If the City Council in any way disagrees with the action of the Planning Commission, the code is written that City Council must refer it back to the Planning Commission. However, since it has been thoroughly reviewed it.is necessary to make an interpretation of 'that. MOTION AYES NOES *. Due to the County’s final time restraint on their facility and the Planning Co+ssic has thoroughly reviewed it and set forth a list of conditions that would have been imposed had it been approved, the Planning Commission will concur with the determination of the City Council.
