ROLL CALL - All Commissioners were present. I PLEDGE. OF ALLEGIANCE APPROVAL OF MINUTES A motion was made to approve the minutes of January 25, 1978, with the addition of Commissioner Jose's comments regarding CUP-147 to be considered at the Planning Commission meeting of February 15, 1978. APPROVAL OF RESOLUTION NO. 1431 A motion was made to approve Resolution No. 1431 WRITTEN COMMUNICATIONS - None. ORAL COMMUNICATIONS Commissioner Larson gave a brief discussion of the meeting he attended sponsored by the California League of Cities in the San Diego section of Coronado. He stated that the meeting was very goq$,and Jae suggested to the Commission that if they do continue this on a local basis that everyone should try to attend them, he also suggested that they should have more in the future, maybe three or four times a year. Commissioner L'Heureux, indicated that Oceanside's City Council raised the pay for Planning Commissioners' to $50.00 a meeting, a maximum of $150.00 per month. He indicated that the Carlsbad Planning Commission was one of the lowest paid in the County. Bud Plender, Assistant Planning Director, introduced the new Associate Planner, Don Rose, to the Planning Commissio and indicated to them that he will be in charge with the Planning Commission agenda and that he would be attending the Planning Commission meetings. PUBLIC HEARINGS (Continued) ,. (1 ) .Case No. CUP-1 47, Prest Best Corporation , request for a Conditional Use Permit for the expansion of an existing service station to permit a laundry and dry cleaning pick-up service. Bud Plender, Assistant Planning Director, indicated that he had received a letter from the applicant requesting that this item be continued because they had read the report and'would wish to discuss the. conditions with the oil company to determine if the oil company would pu.t them in. Bud suggested a four week continuance but also indicated that it was a public hearing for discussion and questions. PRESENT ABSENT IOT I ON JY ES IOT I ON 1Y ES X F F I - CITY OF CARLSB'AD PLANNING COMMISSION MEETING FEBRUARY 8, 1978 CITY COUNCIL CHAMBERS PAGE TWO (2) Chairman Jerry Rombotis, in answer to a question gave a brief discussion on thermeaning of a.non-conforming gas srat.ion. He indicated that gas stations under our present zoning ordinance required a Conditional Use Permit but that this gas station was in existance before the ordinanct and therefore did not require a Conditional Use Permit, but that it does not meet the present standards for a gas station and those standards were in the areas of land- scaping, public improvements, e.g, sidewalks and that is why it is non-conforming at the present time. A motion was made to continue CUP-147 to March 8, 1978. NEW PUBLIC HEARINGS (2) Case No. CT 77-18, G.J. Linquiti, request for the conversion of an apartment complex to a 19 unit airspace condominium on 1.15 acres on property generally located on the west side of Jerez Court north of Gibraltar in La Costa Sounth, Unit No. 5. Bud Plender, Assistant Planning Director, gave the staff presentation. He explained that this request was a technical problem because Ytie building permits were processed for a condominium meeting condominium standards with two hour fire walls, individual meters, etc. The reason it is a conversion is because to get the sewer permits they had to get building permits as an apartment within a time period. Mr. Plender stated that the staff looked at this more as a straight condominium not a con- version. He indicated a problem with this project in that the request is for 19 units but that the Leucadia County Water District only issued16 sewer permits and he suggestec that the Planning Commission should add a condition if they wished to approve it, that would allow a 2 phase development and this condition would be to substitute the extent that the first phase would be the 16 units with the sewer permit, the second phase would be the final 3 units and they could be built only after receiving sewer permit from Leucadia County Water District. Mr. Plender felt that this was enough guarantee to assure that t.hey will nor be built until the sewer permits were granted. He rec- ommended that this application be approved with the added condition. ,, Commissioner L'Heureux, expressed concern of-whether or not any conditions were necessary to cover what physically happens to the 3 lots between now and the time they are built. He questioned if they were going to remain mud piles or if they were going to be landscaped in some temporary fashion or what kind of uses were going to be made of that, he added that we would be talking about in 2 or 3 years. Bud Plender, Assistant Planning Director, in answer to Commissioner L'Heureux's auestion he stated that condition no. 3 in the staff report indicated that the landscape plans would include the area of the deleted units and stated that the Planning Commission would have to reword that condition. MOT I ON AYES ABSTA I N I A - CITY OF CARLSBAD PLANNING COMMISSION MEETING FEBRUARY 8, 1978 CITY COUNCIL CHAMBERS PAGE THREE (3) Lester Brown Turner, 1920 Ma.gdalene \Jay, San Diego, CA., ! stated that they were gping to landscape those 3 vacant 4 units because it may be about 2 or 3 years before they do get t'he sewer permits. He indicated that regarding recreational faci 1 ities that they had decks off the 1 iving room with barbeque facilities available for each unit. He stated that it was a good project because it gives people what they are really after a low homeowner association maintenance fee in an area of high recreational activity. Fred Powell, Architect, stated that he has worked very closely with the staff and that they have been very help- ful with us in helping us to know what the requirements are and we have been trying to meet all of their require- ments and also deleted 3 unit5 to build a parking lot and make it a better project. A motion was made to approve CT 77-18, with condition no. 3 to be reworded regarding landscaping, and that an additional condition be added as number 4 to include that "the maximum number of units that can be built as 19, 16 of which have permits and 3 which are pending. The first phase would be the 16 units and the second phase would be the final 3 units and that they can only be built after they have received the permits from the Leucadia County Water District'! (3) Case No. SNC-11, Revered Federick Florek, request for a street name change from Alfanje Street to Santa Isabel Street. Bud Plender, Assistant Planning Director, gave the staff report. He indicated that no one was addressed on the street . A motion was made to approve SNC-11. NEW BUSINESS (4) Case No. PCD-13, County of San Diego, finding of General Plan Consistency for: purchase of property .. for airport clear zone purposes. Bud Plender, Assistant Planning Director, gave the staff report. He stated that this was consistent with the General Plan Land Use density for that area.
