Chairman Rcxtkotis further info& the applicants that in light of tl?e absence of Camnissioners Jose and L'Heureux there was present a "bare quorum" and that if they wished to continue their items when they were called, they could do so. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES OF MAY 10, 1978 This item was continued to the June 14, 1978 meeting as only three of the four cadssioners present were eligible to vote on it. PUBLIC €lEAlUJGS (Continued) (1) CUP-150, Terrel Richardson - mest to allow a coanrolnity facility.(Carlsbad Girl's Club) to locate in a residential (R-1) zone, generally located on the east side of, Eureka Place, between Chestnut and Bassmod Avenue. m. Don mse gave the staff presentation. Conmissioner Yerkes stated for the record that he had read the minutes of the My 10, 1978 meting regarding CUP-150 and that he was prepared to vote on same. Mr. Joe Hunter, 2958 Madison, Carlsbad, mmber of the mard of Directors of the Carlsbad Girl s Club, addressed the Comnission, saying he muld be happy to answer any questions. coarmissioner woodward asked to clarify that' the piano would be mved and Mr. Hunter replied that it muld. Mr. Hunter,. in response to a question by Catmissioner Iarson regarding the position of the Girl's Club on making the required irtpr6vemnts, said that the Girl I s Club was prepared to meet the requiranents. Conmissioner Larson asked the applicant's representative whether the Girl's Club had estimated the cost of the required imrpvemnts and Mr. Hunter replied that except for the requirements of handicap ramps and perhaps extra bathrocans, which he was not aware of before the meeting, he felt the improvements wuld be under $1000. Mr. Hunter, in response to a question by cchmcissioner Larson regarding the existing fence, indicated that the south side and the back were the only sides without sore type of barrier at the present time. He further stated that he understood the need for a solid fence on the south side, adjacent to the neighbors, but that he muld ask to be allowed to construct a fence of wire and shrub along the back. t= I I." Mr. mse replied that# he, included it to man dny activities which we unusual in relation 'to girl s club activities, i .e. , free clinics; etc. . .. A motion was mde and approVea reccmmnding APPFWAL of CUP-150, based on the findings and subject to the conditions outlined in the staff report, with the following corrections : P. 5, condition #2 will include "sidewalks". P. 6, Condition #4 will read, 'I.. .barrier to be placed prior to occupancy," rather than "120 days frm the granting of this CUP." Also, Condition #4 will specify that the barrier adjacent to the neighbor on the south will be of solid material, while the barrier along the back my be a wire msh fence & plant .. mterial . PUBLIC HEARTNGS (New) (2) CC 78-2, 350 Jerez aurt - Request for a tentative subdivision map for three airspace condminium units on one lot. Site is 7535 Jerez Court, located on the west side of Jerez'CoWt, north of Gibraltar Street. Mr. Don mse gave the staff presentation. Comnissioner -son inquired as to the status of the city's schml fee ordinance and Mr. Hagaman, Planning Director, responded that it had been presented to the City Council and that it could be as long as three mnths before the ordinance took effect. Mr. Bob WiMnson, Partner, Jerez Ccanpany, Suite 332, 13215 Fast Pam, Whittier, CA 90602, addressed the Catmission. He described the prodessing of his application up to now. He notified the camnission that he had three sewer pennits and understood that he was No. 2 on the list for an additional tm sewer pefits. As far as ccsnplying with the requirements of a condmjnium code, Mr. Wilkinson said that he began his aMlication over a year ago and had no idea at all of any condminium code. He described the expense and expertise involved in the plans for the project He described his dealings with the various school districts indicating that letters =re available from all but the Encinitas school district. He indicated that one of the covenants of their non-profit homeawner's association was going to be that no children under 18 could be residents. He said that originally the application was for five units bzlt that it had been cut back to three units and that their intentions were to build the three units now and eventually add tw mre. He asked the Carmission to consider waiving the school availability requirerent in light of the covenant restricting the developtent to adults only. Mr. Don ~se, in response to a question by Ccarmissioner Woodward, said that it muld be difficult for the Cordssio to waive such a requirement. He said the Carmission could recamnend to the City Council that it be waived, if they wanted to do that, but that they would have to have saw pretty substantial findings. Ccarmissianer Yerkes cmmnted that it would appear that - a proposal such as this my have far-reaching affects, especially if excepting these cmmmities from school fees was the next step after excepting them froan school availability. . .. 1 c m. Wilkdnson pointed out the cost involved in getting the school availability letters and stated that he was not asking the Conmission to except them fran paying school taxes. Conmissioner Larson indicated that he appreciated the problems of the contractor that the owner of the property has. He said, however, that Carlsbad's General Plan does require that a finding be mde that all public facilities be guaranteed, and without the s&ml availability letters, that finding could not be mde. For that reason, he said that he could not look with favor upon this application, regardless of any other problems which may exist. comnissioner Woodward agreed with Conmissioner Larson adding that .because it was an adult comrmnity now did not mean that in the future it would not be open to everyone. Camissioner Yerkes indicated that he was not convinced that there was an overriding social, econmic, or fiscal benefit to the city which would justify approval of the project. Chairman -tis agreed, adding that he was sympathetic to the plight of the awlicant. He asked the applicant if he would.prefer a continuance or a denial. Mr. WiWnson pointed out to the camnission that it was his understanding that even if the City of Carlsbad does adopt an ordinance, it will only act in the nature of a collecting agency. In answer to Chairman mmtatis's question, he indicated he would prefer a denial, his intent being to take it to the City Council. A mtion was mde recornding DENIAL of CT 78-2, for the reason that it is not consistent with the General Plan in that it does not met the Public Facilities elemnt of. sam.
