CALL TO ORDER The meeting was called to order at 6:35 p.m. by Chairman Schick. ROLL CALL Commissioners present: Chairman Schick, Commissioners Rombotis, Jose, Marcus, Larson Commissioners absent: Commissioners Leeds, Friestedt Ex Officio members present: Dan Hentschke, Assistant City Attorney, James Hagaman, Planning Director Staff present: Charles Grimm, Associate Planner Consultant present: Margaret Goldstein PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Chairman Schick. II. AGENDA ITEM COMMUNICATIONS Chairman Schick explained that the purpose of this meeting is to continue with the Housing Element of the Carlsbad General Plan. Chairman Schick recommended that a final vote not be taken at this time, but rather to review all the remarks made and changes recommended to this document. Consultant is to note such remarks and changes and return the document to the Planning Commission. At the next meeting on this document, the Commissioners would then reflect on the entire document with remarks and changes and amend, as required. A vote will be taken at that time. Or perhaps there would be some point to be returned to the Consultant for rewording before forwarding to the Council. Chairman Schick explained that this is a public hearing and it is a continuation in consideration of the Housing Element for the City of Carlsbad. III. CONTINUED PUBLIC HEARINGS Housing Element. Staff Report: Charles Grimm reported that this is a continuation from February 6. At that meeting, the Commission completed P discussion on Sections I and II. Discussion is to begin now on Page 21, Section III, Implementation and to continue through Appendices. These sections do not in themselves establish any policies or programs. Staff feels the major issues Commission should look 'at include the priorities which are identified in the Implementation section and also the party responsible for carrying out the priorities, as well as the funding to be allocated to carry out these priorities. The Appendices contain the studies and.statistics that were required as preliminaries to the Housing Element. These are the studies the Committee used to make their decisions on the proposed Element. This section should be studied for completeness and accuracy because it does become a part of the Housing Element. It does not establish any goals or policies. On the advice of the City Attorney, this hearing was renoticed in the newspaper. Planning Commission Discussion Chairman Schick stated there have been developments from the City Council relating to the moratorium. Regarding mobile home parks, Commission should be apprised or have a copy of that ordinance in order to introduce passages of that at the appropriate chapter. Staff is requested to provide that as part of the package - the finalized action. Chairman Schick requested the start of a page-by-page review, starting on Page 21. Commissioner Rombotis asked what is the role of the Planning Commission in recommending funding to the City; Staff replied this does not establish funding but is only a recommendation. The guidelines require the City to establish priorities on various programs and to give an idea of funding necessary to implement them. James Hagaman, Planning Director, stated this is a recommendation to Council which would have to be incorporated in the budget at their discretion. The State is looking for a commitment. They will be looking at it on a two-year review period to see how the cities are doing. The Commission does have a role . in this. Commissioner Jose stated the Council will have to determine the allocation of funds for this purpose. He feels the Commission is not in a position to state how much should be allocated; James Hagaman replied that Commission will just recommend and the Council has discretion to proceed or not. P.C.Minutes Page 2 - Commissioner Rombotis stated that if he recommends funding, he wants to know where it's going. Chairman Schick said that when talking dollars, he wants to define the objectives of these dollars. These are stated very broadly in the study. He feels this would come piece by piece in the budget review. Commissioner Marcus asked what is meant by $50,000 for the years 1980-82; Consultant replied that is total funding for the two-year period. Chairman Schick stated Commission has no way to analyze the dollar value. Page 21 - Section III. Implementation. Commissioner Larson asked if it is the intention of the Committee for Commission to work on all 4 priorities at once; Consultant replied that out of 10 possibilities in the Policies section, the Committee felt priority should be assigned to these 4, not necessarily in numerical order. 1. Preserving Housing and Neighborhoods. Commissioner Rombotis asked if there is any conflict in this; Consultant replied that the Committee recommends proceeding, however there are some distinct weaknesses, and it is also recommended that some other sources for rehabilitation assistance be looked at. Chairman Schick feels there are some borderline areas as to mobile home parks. Page 21 - No recommendations. Page 22 - 2. Adequate Provision (6460). Commissioner Marcus suggested word change from "pursue" to "consider" in the previous meeting. She stated that she feels now that the word "pursue" will have to go back in. Consultant replied that in the one area that Commission was firm on, they will use "consider" and not "pursue". This was another area - the Political Action area. Chairman Schick asked if the $50,000 was just for salary; Consultant replied that the major item is salary. Chairman Schick stated the figure $50,000 is mentioned more than once and asked what objective will be solved with this money; Consultant replied that the major component would be salary for accomplishing this objective. The new Section 8 appli- cation, organizing a referendum and presenting alternative ways would be a block of about two years' work. P.C.Minutes Page 3 ,- Consultant stated that developing senior citizen housing is considered a priority. Page 22 - No recommendations. Page 23 - 3 Achieving Affordability (6454). Chairman Schick notes that "Planning Commission" should be changed to "Planning Department". Comment by Public - Suggestion received that in middle of page 23 the wording "small" percentage should be changed to "fair share of"; Chairman Schick replied this would be a fair share collectively. Commissioner Rombotis asked Staff - if you include "fair share" or "small percentage", do you also get some EDU's to take care of that. The Council has not seen fit in their sewer allocation to do that. There is conflict in page 23 and existing ordinances; Staff replied there is a recommendation that Council set aside a certain number of EDU's. James Hagaman stated this is a difficult point with the existing policy of the Council. Allocations now list low and moderate income housing as a consideration. We don't have an answer to that at this point. Chairman Schick stated that this Housing Element is not going to necessarily give the implementing instructions; it will establish the broad guidelines. Commissioner Rombotis said he wants Council to incorporate these density bonuses, if the developer so chooses to implement them. The sewer allocation will have to be changed. Chairman Schick stated that as a follow-on here we should note to the Council that we have to be consistent here. James Hagaman replied that this will be a difficult problem for them to deal with at this time. Consultant stated that in the actual action in the Policy section, it is 15% of below market units. Changes to Page 23: Change Planning Commission to Planning Department. Add 15% of below market units is called for. P. C. Minutes Page 4 f- - Page 24. Commissioner Larson feels No. 4 may have already been accomplished. Commissioner Rombotis agrees and feels the General Plan already has accomplished this. They feel this cost of $12,500 would involve only a look at the General Plan. Chairman Schick stated that total correlation is needed and that is what this Housing Element will do with the General Plan. We have never had a total Housing Element. Commissioner Larson agrees that we need that correlation. Consultant stated that the Committee feels the policy framework is in the General Plan. This just follows the General Plan. Commissioner Jose does not feel that Carlsbad is "the major industrial center in North County". (man in audience - member of Committee ) said that no, the Committee did not go into (those former plans). His thought was that if projects come up for zone changes, they were thinking of a more concentrated density allocation. The thought was to increase the density, not just residential housing per se. If they wanted to make some changes in the Housing Element in the future, they might want to consider shifting some of the densities closer to those arterials. I concur that we don't need to spend the $12,500. Chairman Schick replied that we do need the funds because all the elements of the General Plan have to tie in together totally. When you listen to the way various cities have been brought to task because some segment has not been totally correlated, you realize the need for this. Consultant replied that the words needed here are "correlation" between the employment centers and the type of housing and also "correlation"between the type of housing that has access to job supply. Commissioner Jose suggested addition in line 3 of page 24 to read "the city is one of the major industrial centers". Chairman Sehick said that responsibility for correlation of this to the General Plan will rest with the Planning Department. corm., Larson opted for a complete rewrite of Section 4 (pages 23, 24). Commissioner Rombotis felt this is not appropriate for a city of 9 miles from one end to the other. Commissioner Jose agreed. P.C.Minutes Page 5 Dan Hentschke stated that the concept is that the Housing Element is part of the General Plan and that all elements of the General Plan, while addressing specific areas, relate to the other areas of the General Plan. There is a need to correlate the two. (Public) asked whether Commission could drop the funding entirely. Recommendation on #4, 'pages 23 & 24. Commissioner Rombotis questioned the need for #4 (pg. 23, 24) and moved to strike it. Second by Commissioner Jose. All agreed, except Chairman Schick who would like to keep that in. Also add in line 3 of page 24, "the city is one of the major industrial centers". Page 25. Chairman Schick commented on the language in Review; Charles Grimm replied this input was cation. Suggestion: Add "Their comment has within the document." Page 26 - no recommendations. State of California by oral communi- been incorporated Page Al, Appendix A. Commissioner Jose questioned the last paragraph, sentence 2 under paragraph 1,and stated that Vista is east of Carlsbad and Oceanside is north. Page A2., Figure I to be replaced. Figure 2 has been corrected on EIR. Consultant stated they will use the same map on Figure 2 as the EIR. Chairman Schick asked if tracts 179 and 180 are incorporated as a single document; Consultant replied they are shown on one map with a boundary line between the two and you can see them on the big map in the EIR. Chairman Schick stated this does not lend itself to identification of either one of those tracts. Page A5. Chairman Schick asked whether it might be well to incorporate in Table 1, page A5 the Table 3 on page A8; Consultant agrees. Commissioner Rombotis asked Consultant where the figures on A5, Table 1 came from; Consultant replied those are the State estimates, which they received partly from local jurisdiction and partly from their census data and projections. P.C.Minutes Page 6 - Page A6. Commissioner Larson commented on Table 2, the last 4 figures on household incomes, and feels those figures are inaccurate. If more accurate figures are available, they should be inserted here and also :in last paragraph of A7. Chairman Schick agreed with this; Consultant said there are no better figures available. Commissioner Rombotis stated that when other State agencies try to implement this, they will use these numbers. He believes income in Carlsbad is much higher, and questions using these figures. (man in Public Audience - on Committee ) stated those figures were taken at faith and concurred with Commissioner Larson. Commissioner Larson recommended deletion of these figures; Chairman Schick stated that the figures should at least be qualified - that lacking a base, these figures will be updated. Charles Grimm agreed these figures are not good, but hes- itated to remove the category. Commissioner Rombotis stated that the day may come when the City is required to implement this and would not like to see implementation based on these figures. The Coastal Commission at this time is implementing the housing guide- lines they have adopted. Consultant said they could add another column with current estimates. Recommendation on Table 2, Page A6. Add a column of current figures and state "this to be revised". Page A9. Chairman Schick stated that in paragraph i, Home- ownership Patterns, we should recognize that there are 2nd home patterns. Commissioner Larson questioned paragraph j, Occupancy/Vacancy, and asked if there was more accurate data; Consultant replied that 1980 estimate could be added, but those estimates tend to be high. Commissioner Larson asked whether it wouldn't be more accurate to use the 4% figure in sentence one (as stated in last sentence of para. j). (lady in audience) asked whether second or seasonal homes could be broken out in separate figures. P.%.Minutes Page 7 Dan Hentschke stated there is a tendency to think of vacancy rates only in the terms of rentals. This paragraph addresses occupancy rate of all dwellings. In order to help the Council implement their condo conversion ordinance, perhaps these should be broken up, as audience suggested. If we do consider condo conversions based on vacancy rates, we need accurate figures in the General Plan. Commissioner Rombotis suggested that "vacancy" should ! be defined; Consultant replied it has to be available for rent or sale. Commissioner Rombotis would like to see those figures reflected. Commissioner Larson asked if those figures are available; Consultant replied most of these are houses for sale, mostly in La Costa. Apartment and mobile home vacancies are very low. Commissioner Larson stated he would recommend City Council get these figures and they should state "under construction , available for sale, summer rentals, etc." Chairman Schick said it should state the objective is to update these figures. Commissioner Rombotis said that vacant houses for sale'in La Costa would have nothing to do with condo conversions. (Public audience) stated that figures are misleading if summer rentals and rentals in La Costa are used. Chairman Schick replied that this plan is to deal with' the entire city. This will be directed in the implementation and it will be broken down. Page AlO. Chairman Schick suggests that census tracts'179 and 180 should be referenced as to where they are. Page All. Commissioner Rombotis asked where the 66,000' figure came from in paragraph 1. He suggested a'footnote as to this source. Page A13. Commissioner Marcus asked if there was some/ duplication in the 894 figure; Consultant will check for any repetition. Page A14, Para. 4. Commissioner Rombotis stated that ihe fair share figure is no longer 825; Staff replied a memo will be taken to Council. B.'C.Minutes Page 8 C - Chairman Schick asked if employment factors are broken down; Consultant replied that employment growth is done mainly by contacting major employers and getting their projections and also finding out if there is some new plan for employment. Chairman Schick stated this area's employment factor could be different from some areas, because of military, etc. Commissioner Jose asked if there will be some figures as to wage scale; Consultant replied this was one of the provisions under number 4 that was struck. Page A15. Chairman Schick said that in the last paragraph Oceanside and Vista are not mentioned; Consultant has figures and can put those in. Page A16. Chairman Schick asked how figures in Table 7 compare to the regional average. Public - questioned the Table 7 mobile home figures and feels the low figure is too high, and that the high figure should be 400. Recommendation: Addition of Regional column to Table 7. Page A18. Chairman Schick questioned the phrase "in the older north coast." He suggests eliminating that. Page A20. Recommendation by Dan Hentschke to add at end of first paragraph on mobile homes, "Recent legislation should change the concept people have about this." Page A24. Chairman Schick stated that Mobile Homes had previously been crossed out. Appendix B. Commissioner Rombotis suggested that Table 7, Page B7, should be extended to reflect current rates. Page B14. Chairman Schick suggested that the wording in line 9 should be two percent "can" cover fees. In the 2nd paragraph under 7, Chairman Schick stated the 850 units came out of Encina. Other districts play a part in the development. He recommends adding clarification to this paragraph. P.C.Minutes Page 9 Page B17. Commissioner Rombotis questioned the need of referring to pending legislation. He stated no objection to the wording, but just thinks it unnecessary. Chairman Schick asked where the figures 100 and 150 in the first line came from; Consultant replied that is used only to reflect a large number of units. Page B18, Table 10. Chairman Schick questioned the School Fee of $1,480, as it is not a set fee. Commissioner Rombotis suggests a footnote be added giving district figures. Chairman Schick asked if this figure is for an average house; Consultant replied this is just a true example. Commissioner Jose asked if the school fee is by bedroom; Commissioner Rombotis replied that in Carlsbad it is by unit. Appendix C. Chairman Schick stated that on page C14, 30. 2 (end of page) may need to be expanded. Consultant stated that the 7 items on pages Cl4 and Cl5 are the Committee's summary of what they thought the position of mobile homes should be in Carlsbad. Consultant said the Committee's comments on the items in the mobile home report start on page Cl0 and the 7 state- ments on pages Cl4 and Cl5 summarize their final position. Dan Hentschke suggested summarizing the actions the Council has taken and include an extra page as part of the Appendix. Since this is just a reference document, he suggests adding what is being done now. Chairman Schick said he feels this section is weak, compared to the rest of the document. He suggested bringing the 7 points (pages C14, Cl5) up front in the mobile home section. Consultant agreed, and stated that the action of the Council is what is jarring this thing a little bit. The Committee was against exclusive mobile home designations. Chairman Schick stated that if we differ from them, this should be reflected. Consultant said that also the latest action should be summarized and inserted. That should go with these items in the Community Profile Section. P.C.Minutes Page 10 Appendix D. Consultant stated there will be several additions to the Definitions section. Commissioner Rombotis stated he had a question on Page 1, Introduction, at the beginning of the packet. He asked whether the rate of growth had now peaked out. Consultant replied that growth between 1975-1980 has been greater than 1970-1975. Commissioner Rombotis states concern on rate of growth and asked that figures be reviewed. James Hagaman added that based on Council action March 4 on condo conversion, the Planning Department will probably come back with a revision or some conversation on Action 7 on Page '13, reflecting some of the Council actions. It was agreed that Housing Element will be continued to the regular meeting of March 26.
