In answer to query, staff assured the Comnission the fire department had no ooncern with the traffic circulation. Chairman Schlehuber ~ned the public hearing at 7: 17 p.m. and issued the invitation to speak. Mr. Barry Bender, Rick Engineering, 3088 Pio Piro Drive, addressed the Comnission, stating they ooncurred with the oonditioos of approval. He stated they had met with the fire department and they were satisfied with the circulation plan and the distrib.Jtion of fire hydrants. 'nle turn would be re-engineered to aCUJ1111odate a 45-foot radius. Carrnissioner Friestedt asked whether there are plans for a drive-through at the bank and was told there are none at the present time. He stated that would necessitate a re-sutrnittal of plans and a oonditional use permit. Mr. Bender replied they were aware of this. Mr. Albert Kercheval, Kercheval and Associates, Inc., 9420 Farnham Street, San Diego, addressed the camdssioo, stating his firm is under oontract for the design of the highway and bridge on the subject project. Be stated it is 75 percent undetway, and they are awaiting the ruling of any mitigation fran the EIR. Mr. Kercheval stated the noise level had been discussed and would be resolved as they carry out the design. camdssioner Schlehuber asked whether baffle walls had been considered, and Mr. Kercheval answered on the south edge. In answer to whether it would be four feet high, he stated it could be, but would not be aesthetically pleasing. It oould be a ooncrete block or jersey rail. 'lbat would help kill the noise. The noise level is at the maxinl.un where the transition is fran the fill and the tq, of the existing wall make the change--could be 150 feet or so. In anwer to query, Mr. Kercheval indicated that a jersey rail was described as a ooncrete barrier, such as is on the freeway, which could be used on both sides as safety feature, as well as blocking noise patterns. Also, the height of a jersey rail was given as 2 feet 6 inches. This effectively screens the noise and provides safety, and a higher wall would not be necessary. The Camrl.ssion determined fran information provided by staff that the noise level in the nobile hane park is 70 decibels except for ooe small area in the interior that is 65 decibels. There is no way this level can be lowered, but the problem is to keep this level fran going any higher. Mr. Hiram Hoskin, 7307 San Luis, representing the Lakeshore Gardens Association, addressed the Camrl.ssion regarding the ooise inpact to the park. His oomnents are attached as part of the reaord. Mrs. Rubye Karo, 7006°San Bartolo, addressed the camdssioo regarding the safety and security of Lakeehore Gardens, and her oomnents are attached as part of the reoord. Since no one else wished to speak on this matter, the public teetino,y was closed at 7:43 p.m. The ca.nissioo discussed the wall surrounding the park and it vaa determined to be 5 feet in height fran the inside of the parlc and 6 feet fran the outside. The 1apact of the ooise at the spot where the road o:mes above the wall was discussed and where the roac:May is above the wall for a distance of approximately 350 feet. The camniBSioo addressed the safety and security pcd>l-which exlat in the park, but determined they are alrealy problema that exist and would not be exacerbated by this project. oo..iaaioner Roax>tis stated the EIR adequately a1dreaed the noise problem. Bill Hofman, Principal Planner, gave the staff report en this item using a transparency showing the locatioo of the property. Staff does not support this request but 1D1ld support a General Plan Amendment en this particular property to RI>-fl, if affordable housing is ~ided. Harold Curry, 3135 Blenkarne Ori ve, addressed the Ocadaaion stating he was the author of the report the caaiaaionen had ocpiee of, and stated he oould find nothing in the General Plan adverse to the increased density he was requesting. Re urged the Carrnission to approve this request. '1'he Assistant City Attorney stated this request was not cnnsistent with the General Plan as the City Attorney's office reads it. 'Ille General Plan allows for 10 to 20 units per acre, and 30 units would be a 50 percent increase in the allowable density. After OJDferring with staff as to ability of streets to hamle additional traffic and the general character of the neighborhood, the City Attorney's office ooncluded this project was not oonsistent. The original staff determination was made in error. 'Ille Carrnission discussed the different alternatives available to the AR)licant on this project and the feasibility of increased density in this area.
