Hr. Ji• Gaiser, 3340 Ridgecrest Drive, addressed the C011111ission and gave the reasons why he felt that if an extension is granted, a time frame for the completion of El• Avenue should be set up. Nothing has been done even though the prior owner/developer was to have completed Elm Avenue in exchange for the higher density granted on this property. Further, the City Council in the past month agreed to pay $285,000 of the taxpayers monies to assist the new developer with Elm Avenue. COl'Mllissioner McFadden stated that she did not support this project originally because of the high density involved. She agreed with Hr. Gaiser and added that she feJt that the density should be reduced C011111ensurate with the amount of 1110nies that Carlsbad has to pay to put Elm Avenue through. Referring to the granting of an extension, C011111issioner Holmes inquired whether this project will come under the current ordinances or under the ordinances under which it was originally filed. Dan Hentschke, Assistant City Attorney, responded that the conditions that applied at the time the applicant got the original per•it continue to prevail. However, conditions can be changed or added on this type of a project if the C011111ission deems it necessary. Chail"lllan Schlehuber stated that he would reluctantly go along with the extension due to the decision made by the City Council to support this project. He pointed out that it was included in the original resolution that Elm Avenue had to be in after 120 units. He stated that to ifflpleiaent the Council's action, staff ls rec011111ending that two additional conditions be placed on any project that the Planning C01111lssion may approve tonight--(1) a condition enforcing the traffic impact fee itself, and (2) a condition requiring the developer to C0111ply with the provisions of City Council Ordinance No. 9791 (Public Facilities Fee raised fr0111 21 to 2.51) or any subsequent ordinance or policy i~plementing or establishing a develop111ent 111anagement system or public facilities financing or phasing programs. PUBLIC HEARINGS 4) ZC-342 -CITY OF CARLSBAD (Alga Hills) -Request for a Zone Change from RD-H to RD-M-5 for a 64-acre site located at the southeast corner of Alga Road and Allcante Road. Charles Gri11111, Assistant Planning Director, gave the presentation on this itetn as contained in the staff report. He gave the background of the project, and stated that staff is rec011111endlng approval of this project with the addition of the traffic impact conditions established by the City Council, and the deletion of Conditions Nos. 7J and 74 (outdated traffic conditions). Dan Hentschke, Assistant City Attorney, stated that the General Plan densities set forth in Resolution No. 2550 (first finding) should be changed from 8-15 du's/acres to 4-8 du's/acres to reflect the lower density recently i•plenented by the City Council. In response to questions posed by C011111issioners Mc Fadden and Hall, Hr. Griawn advised that Condition No. J1 requiring the lot sizes to be J,500 square feet will be enforced. Further, Hr. Grinwn explained the reason why density credits were given for the powerline easement. Chairman Schlehuber declared the µublic hearing opened ~t 6:)1 p.m. and issued the invitation to speak. Bob Ladwig, Rick Engineering, addressed the Commission on behalf of the applicant, and stated that the tentative map has been sublllitted and 111eets the minimum requirement of the J,500 square feet. Hr. Ladwig requested that (1) the word "industrial" be stricken fr0111 Condition No. JJ, and (2) correct staff report to read "widening of internal streets frOIII 24 feet to )2 feet, with the exception of three very short streets". C01aissioners McFadden and Hall inquired re9arding the c011pletion of sidewalks around the cul-de-sacs, particularly the 24' width streets. Hr. Ladwig stated that there are no sidewalks in the cul-de-sacs itself. COMMISSIONERS 6) CT-85-10/PU0-81 -RICE PROPERTY -Request for approval of a 196-lot tentative tract map and 189-unit planned unit developniert, located east of Rancho Santa Fe Road and Avenida La Posta in the southern end of the City. Charles Cri-, Assistant Planning Director, gave the presentation on this item as contained in the staff report using a transparency map depleting the site and its lPcation. He gave the background of the project, and stated that staff ls rec011111ending approval of thb project, with the substitution of the new traffic impacts conditions. Chairman Schlehuber declared the public hearing opened at 6:40 p.111. and issued the J.nvltatlon to speak. Bob Ladwig, Rick Engineering, representing the developer, stated that they agree with the staff report and offered to answer questions. Bill Steffan, 1085 Rancho Santa Fe, addressed the C~ission and C0111plained about the drainage of the property. He circulated pictures to substantiate his c0111plaint that the drainage problems have caused serious d•age to his property. He pointed out the problems that he is facing to get this lllatter taken care of since his property is in the County, but the party responsible for th~ drainage probletns is in the City of Carlsbad. He added that the City put in two desiltation basins which worked d\..,ring the tirst rain, but are no longer working. At the request of the C~ission, Hr. Clyde Wickh11111, Associate Civil Engineer, pointed out the location of Hr. Steffan's property on the transparency map, and stated that there are four other holleowners involved in this area, Mr. Ladwig reappeared and stated that they are currently in the process of taking care of this problem as required by Condition No. 33 of the Resolution. Wlckhc1111 explained that as one of the teaporary erosion control •easures, staff r~nded that a couple of basins be installed to catch SOiie of the silt running off of the fanlng aotlvlty. The basins worked well during the first rain, then blew out during the second rain. Mr. Wickhaa lnfonaed that staff ls trying to get the basins repaired and replaced in a working aanner, and affir-d that the drainage proble■ will be taken care of. Mr. Wickham replied that fr0111 a construction standpoint, they are; but fr0111 a farming standpoint, t hey are n~t. The desiltation systems in this case were placed by the farming activity. Mike Holmiller, Planning Director, pointed out that as a result of the problems that were encountered with this particular farming operation, there was a City Council Ordinance passed several 1110nths ago which requires that an agricultural permit be granted by the City Council before faming on any vacant piece of property that has not already been used for agriculture. The City Engineer will then look at the request to 111c1ke sure that there ls proper drainage from the farming operation. 7) CT 85-21/LCDP 85-3 -PARK VIEW EAST -Request for a 36-lot/35-unlt tentative tract 111c1p and a La Costa developaent permit for Neighborhood St-10 of the La Costa Master Plan, located along the west side of Mission Estancia approximately 280 feet south of La Costa Avenue, Charles Grl-, Assistant Planning Director, gave the presentation on this lte.i as contained in the staff report and pointed out the site with the aid of a transparency •ap. He called attention to a 111e1110 frOffl the Engineering Departllent which corrects a few minor errors in the wording of the Resolution approving this project. Mr. Gr1-gave the background of the project and stated that staff ls ireoa.aending approval of this project with the ac!dition of the new traffic lapact conditions and the d l~tion of the old traffic !Jnpact conditions. l11 reaponae to Coalssloner McFadden's inquiry regarding Condition No. 72, the sewer drainage, Hr. Mr. Ryan pointed out~ correction in the ronditlons of approval--Conditlon No. 43 should read 36 feet as opposed to 40 feet. He stated that they are in agreement with the conditions that staff ls adding, and proposed the addition of another condition which was rec0111111ended by Commissioner McBane dealing with a flopping of Lots Nos. 8 and 36 thereby allowing a better visual corridor. There being no other persons in the audience desiring to address the C011111isslon, Chairman Schlehuber declared the public hearing closed at 6:58 p.m. In response to Chairman Schlehuber, Mr. Wickham responded that staff has no problem with the addition of the condition to flipflop certain lots. The Planning Co11111lsslon recommended approval of the Negative Declaration and adopted the following Resolution with the addition of the traffic impact conditions as established by the City Council and the deletion of Condition No. 61; further, to a111end Condition No. 43 to read 36 feet instead of 40 feet, to anend Condition No. 63 to replace the word "La Costa" with the word "El Camino Real", add a condition that will flipflop Lots Nos. 8 and 36 placing the recreation facility in the view corridor, and delete Condition No. 30: RESOLUTION NO. 2552 APPROVING A 36-LOT TENTATIVE TRACT WtP ARI> 35-0AIT LA COSTA DEVELOPMENT PERMIT C.. RECESS The Planning Commission rec~ssed at 7:15 p.m. and reconvened at 7:25 p.m., with all members present. 10) CT 84-43/CP-302 -CASA LOMA CJNOOS -Request for approval or a tentative tract map and condominium permit to develop 18 units along the north side of Luclernaga Street, at the first undeveloped property east of Cebu Street. Charles Grimm, Assistant Planning Director, gave the presentation on this item as contained in the staff report, and with the ald or a trarsparency map, pointed out the site location or the project. He gave the background or the project and mentioned the concerns or the Planning C011111isslon regarding the site design and ar chi tecture. Hofman reappeared before the Conwnlsslon and stated that the applicant has hired a new architect. He requested that the Planning Conwnls~lon table this matter for a 60-day period. In response to a question, Hr. Hofman added that th~ applicant ls willing to lose one or two units upon Implementing the new parking standards; however, they will try to redesign the project in such a way so as not to lose any of the units. A motion was passed to continue CT-84-43/CP-302 -Casa Loma Condos for 60 days as requested by the applicant. 11) ZCA-190 -C1TY OF CARLSBAD -To consider whether additional ,reas of designated open space should be used to calculate permitted residential densities. Mike Holzmiller, Planning Director, gave the presentation on this item as contained in the staff report. He gave the background on the proposed zone code amendment. He explained how staff Cdllle up with an official populatl~n estimate of 1)7,000, and proceeded to give staff's analysis of the impact in terms of density reductions relative to the four items which the Planning Comn11sslon recommended be excluded from being used to calculate residential density. ~halrman Schlehuber declared the public hearing opened at 7:48 p.m., and issued the invitation to speak. Mr. Doug Avis, Bierl-Avis, 11300 Sorrento Valiey Road, San Diego, addressed the C~lsslon and gave the reasons why he opposes the inclusion of the four recommendations of the Planning C<>Nllsslon; ln particular, RecOffllllendatlons Nos. 1 and 2. He requested that the Planning C0111111lsslon look at a less restrictive use of the 251 to 40l slopes. The City has taken the po$ltion that development should be allowed within the 251 to 40l slopes which is a partial precedent relatin~· to the issue of counting dens! ty wl thin those areas. Further, Hr. Avis added, as to Reco.iendatlon No. 2, there ls the pote~tlal problem of lands that enc0111pass major arterials not being de:eloped because of the 111ajor economics of not being able to calculate density. Hr. Avis pointed out the need for clarification as to what has actu~lly transpired in this 111atter. Jim Hicks, 2910 Managua Place, address the Commission and expressed hls concern regarding the first two rec0111111endatlons of the Planning Cof'lllllsslon; especially, the 251-4()1 slope issue. He stated that he did not re,illze that areas that were 25!.-l♦O,, slo.:,es were designated open space areas and r·equested dar i flcatlon on that. If these areas are desJgr,ated open space, Mr. Hicks further inquired, then as such will there be no development permitted t~ereon. Hr. Holzmiller clar Hfod that the Planning Commlssion' s rec0111111endatlon does not deal with the issue of development, but merel.\' provides ~ 501 credit to the 25'-'- 40I slope areas. Hr. Hicks added that lf the intent of this recommendation was to reduce density, he felt that this has been adequately handled so far. Hr. Hicks suggested the Planning C011111ission analyze how many individual property owners are impacted and what densities per se are i•pacted. He requested that the questions raised be taken into conslderatloi, before a final determination ls made on this issue. Bob Ladwig, Rick Engineering, addressed the COllllllisslon and requested that the C01111lsion follow the recommendations of the Land Use C~lttee on the issue of the 251-40,, slopes which ls to treat these areas very sensitively in the planning process and that density credits be allowed. As to Rec«-endatlon No. 2, Hr. Ladwig stated that he felt that the C01alsslon should give S0111e credit for a roadway going through a property r at her than taking away density credits. He stated that he was in agreement with RecOMendation No . 3. However, he stated that he agreed with staff as to Rec011111endation No. 4 that it not be included, and felt that it ls a very negative indication to landowners in the City. Mike Howes, Senior Planner, stated that staff has contacted about 10-15 other cities in the State or California to get input from them; they have looked at other ordinances and have prepared a rough draft, or which COffllllissioners Holmes and Hall have a copy. Next week, the Hillside Committee will review this rough draft together d th staff. Chairman Schlehuber requested that a copy be given to Co11111issioner Schra11111 who will also be serving on that C<>ffWittee. COllllllissioner McBane rec011111ended that the recommendation from the Land Use Co11111ittee as to hillsides be considered by the Hillside Committee when they discuss the Hillside Ordinance. Commissioner Marcus requested that action as to Rec011111endation No. 1 be deferred until a report comes back from the Hlllside Co11111lttee. As to Rec011111endatlon No. 4, she stated that she would go along with staff's recommendation or not approving it to give staff more flexibility. Chairman Schlehuber concurred with C011111issioner Marcus, and added that he would not support Recommendation No. 2. Commissioner McFadden stated that she agreed with deferring Reconnendation No. 1. However, as to Recommendation No. 4, she commented that overall she felt that the case by case approach was no longer acceptable to many or the citizens of Carlsbad. She stated that she would be willing to allow 501 density credits for any land designated as open space. COffllllissioner McBane inquired regarding the wording of Ordinance No. 9795, under Section 21.44.230 (6) riparian woodland habitats. He inquirP.d if this should be two different categories, riparian habitats and woodland habitats. He suggested that the word "or" should be inserted as there can be significant woodland habitats which are not riparian. Assistant City Attorney Hentschke stated staff would llldke a note or this. ADDED ITEMS AND REPORTS Staff Dan Hentschke, Assistant City Attorney, informed that staff has finally come up with a time line to implement the Growth Management System, Public Facilities phase so that the Council can adopt an Ordinance on June 17. The Ordinance irust be in effect before the expiration of the moratoriun which ls July 20. The Planning Cor.-nission will have a chance to have a public hearing at its Hay 28th meeting on this to make a recommendation to the City Council. Mr. H~ntsohke suggested that the Planning Commission limit the items ~n the agenda of that meeting as this is a significant issue which will require a lot of discussion. It was that consensus of the Commission to limit the items to that particular report, and staff was so directed.
