ROLL CALL: Chair Montgomery, Commissioners Anderson, Geldner, Luna, Meenes and Segall STAFF PRESENT: Assistant City Attorney Kemp, City Planner Neu, Associate Planner Harker, Associate Planner Garcia, Associate Planner Dan, Administrative Secretary Brown and Senior Office Specialist Hardy APPROVAL OF MINUTES: Minutes of the Regular Meeting held July 18, 2018, were approved, 6-0. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None Chair Montgomery directed everyone’s attention to the slide on the screen to review the procedures the Commission would be following for that evening’s public hearing. CONSENT CALENDAR: City Planner Neu stated Agenda Item 1 would normally be heard in a public hearing context; however, the project appears to minor in routine and nature with no outstanding issues and staff is recommending approval. He recommended the public hearing be opened and closed, and that the Planning Commission proceed with a vote as a consent item. If the Planning Commission or any members of the public wish to pull the items, Staff would be available to respond to any questions. Chair Montgomery asked if any members of the Planning Commission wished to pull the item listed. Seeing none, he asked if any members of the public wished to speak on the item listed. Seeing none, he opened and closed public testimony. PLANNING COMMISSION Planning Commission Minutes August 15, 2018 Page 2 1. CDP 2017-0068 (DEV2017-0226) – CIARMOLI RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of 2,062 square feet of habitable space additions to an existing single-family residence within the Mello II Segment of the city’s Local Coastal Program located at 4205 Skyline Road within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303, additions to an existing single-family residence, of the state CEQA Guidelines. MOTION: ACTION: Motion by Commissioner Anderson and duly seconded by Commissioner Meenes to Adopt Planning Commission Resolution No. 7305 APPROVING Coastal Development Permit CDP 2017-0068, based upon the findings and subject to the conditions contained therein. VOTE: 6-0 AYES: Chair Montgomery, Commissioners Anderson, Geldner, Luna, Meenes, and Segall NOES: None PLANNING COMMISSION PUBLIC HEARING: NEW APPLICATIONS: Chair Montgomery opened the public hearing on Agenda Item 2. 2. CT 2018-0005/PUD 2018-0002/CDP 2018-0021 (DEV2017-0204) – VILLAGE WALK – Request for approval of a Tentative Tract Map, Planned Development Permit and Coastal Development Permit to allow the demolition of four existing residential units and the development of an eight-unit, residential air-space condominium project on a 0.39-acre site located at 341-347 Oak Avenue, within the Mello II Segment of the Local Coastal Program and within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15332 “In-Fill Development Projects” of the State CEQA Guidelines and will not have any adverse significant impact on the environment. City Planner Neu introduced Agenda Item 2 and Associate Planner Garcia reviewed a PowerPoint presentation (on file in the Planning Division). Planning Commission Minutes August 15, 2018 Page 3 DISCLOSURES: Commissioner Meenes stated that he drove by the site and viewed the project from the sidewalk. Commissioner Geldner stated that she drove by the site. Commissioner Anderson stated that she drove by the site. Chair Montgomery asked if there were additional questions of staff. Commissioner Anderson asked about condition 29 added to the Planning Commission resolution per the errata sheet. Associate Planner Garcia explained that a CEQA Categorical Exemption shall not be used for a project which may cause a substantial adverse change in the significance of a historical resource. The existing structures have not been found to be historically significant. Chair Montgomery asked if the applicant would like to make a presentation. Tony Sfreddo, applicant, made a presentation and stated he would be available to answer questions. Commissioner Anderson asked if the units would be sold to individuals. Mr. Sfreddo answered “yes”. Chair Montgomery asked if there were additional questions for the applicant. Seeing none, he asked if there were any members of the public who wished to speak on the project. Donald Beaver, resident, spoke about the impacts that the project would have on his neighboring property. He noted that the proposed project would add to the traffic impacts for the area. He requested a 10-foot separation between property lines. Lastly, he stated that the limited separation between properties would kill up to 80 percent of his landscape due to lack of sun. He explained that he is happy to see the property improved, but asked that the Commissioners consider the impacts to his property. Commissioner Luna asked Mr. Beaver to locate his property on the PowerPoint slide. Mr. Beaver pointed out his property on the slide. He added that he also has a concern about the air conditioner units which are proposed to be located eight feet from his front door. Laurie Boone, resident, spoke in support of the project. Chair Montgomery closed public testimony. Mr. Sfreddo, applicant rebuttal, explained that the building’s west side is 10 to 12 feet from the property line. He noted that the air conditioning condensers are approximately 18 feet from the adjacent building. Planning Commission Minutes August 15, 2018 Page 4 Associate Planner Garcia explained that the minimum set back on the west side is 8 feet with the building being 10 to 12 feet. The project exceeds the setbacks on both sides, as well as, the rear setbacks. He noted that there are no standards for air conditioning units in the setbacks and no noise attenuation is being proposed. Engineering Manager Geldert spoke about the traffic concerns that were brought up along Oak Avenue. He stated that a traffic study was not performed for this project. He answered Chair Montgomery’s question, by stating that the ADT is about one every half hour pending on peak use. He explained that the area is impacted by traffic due to the location being near the beach, restaurants, parking, etc. He noted that this project does not create an impact as it does not significantly increase traffic. Commissioner Geldner stated that when she drove by the project, there was a lot of auto, bicycle and foot traffic. She asked about a method for adding four-way stops in the area. Engineering Manager Geldert stated that, if prompted, four way stops would be evaluated by the traffic division but adding stop signs is not part of this project. Commissioner Anderson asked whether the north east public parking lot would be impacted when the train track is changed to double tracking. Engineering Manager Geldert stated that he is not sure of any impacts at this time. Commissioner Segall asked for clarification on the property lines. Associate Planner Garcia stated that the subject property is required to have an 8-foot setback and the plans show a 10-foot setback. Commissioner Segall asked what separates the two properties. Mr. Sfreddo stated that there is an existing five-foot wall between properties. Commissioner Segall asked if the air conditioning units could be placed on the roof top. Associate Planner Garcia stated that a pitched roof is being proposed for the project. Commissioner Meenes asked about a decibel / location requirement. Associate Planner Garcia stated that he is not aware of a requirement. Commissioner Segall noted that there would be more of a noise/vibration bouncing of the existing wall and back on the subject property. PLANNING COMMISSION DISCUSSION: Commissioner Luna stated that the project meets the guidelines so she supports the project. Commissioner Anderson stated that she has sympathy for the neighbors with all the foot traffic in that area, but supports the project. Chair Montgomery stated that the project meets the findings so he supports the project. MOTION: ACTION: Motion by Commissioner Anderson and duly seconded by Commissioner Meenes to Adopt Planning Commission Resolution No., including Errata Sheet, APPROVING, Tentative Tract Map CT 2018-0005, Planned Development Permit PUD 2018-0002, and Coastal Development Permit CDP 2018-0021, based upon the findings and subject to the conditions contained therein. CDP 2018-0013 (DEV12037) – HOEHN HONDA – Request for approval of a Coastal Development Permit for a 723-square-foot addition to the Hoehn Honda car dealership located at 5199 Paseo Del Norte within the Car Country Specific Plan, the Mello II Segment of the Local Coastal Program and Local Facilities Management Zone 3. The parcel is not located within the California Coastal Commission’s appeal jurisdiction. The project qualifies as a CEQA Guidelines Section 15301(e)(1), Existing Facilities, Categorical Exemption. City Planner Neu introduced Agenda Item 3 and Associate Planner Harker reviewed a PowerPoint presentation (on file in the Planning Division). Seeing none, he asked if the applicant would like to make a presentation. Omar Paraiso, architect, stated he would be available to answer questions. Commissioner Meenes asked about the service aisle that encroaches on the existing landscape, and what is being proposed to soften the area. Seeing none, he opened and closed public testimony. PLANNING COMMISSION DISCUSSION: Commissioner Segall supports the project and thanks Car Country Carlsbad for the improvement of the building. CT 2018-0001/PUD 2018-0001/CDP 2018-0003 (DEV2017-0221) – WALNUT BEACH HOMES – Request for approval of a Tentative Tract Map, Planned Development Permit and Coastal Development Permit to allow the demolition of two existing residential units and the development of an 11-unit, residential air-space condominium project on a 0.57-acre site located at 362 Walnut Avenue, within the Mello II Segment of the Local Coastal Program and within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15332 “In-Fill Development Projects” of the State CEQA Guidelines and will not have any adverse significant impact on the environment. Associate Planner Garcia explained that there is nothing proposed to extend the street at this time. Chair Montgomery asked if there were additional questions of staff. Seeing none, he asked if the applicant would like to make a presentation. Kevin Dunn, applicant, made the presentation. Additional hand outs and samples were presented to the Commissioners and stated he would be available to answer questions. Commissioner Geldner stated that she has some concern with the architectural sidings/pop outs. Mr. Dunn explained that it is hard to see the different plane in the area of the siding material on the renderings. He noted that it is a contemporary design. Chair Montgomery asked about the items that would make the project comply to the required development standards. Kirk Moeller, architect, stated that there are a variety of roof plans along with recessing windows and doors a minimum of two inches. Commissioner Anderson asked about the size of the windows and why so many bathrooms are being proposed for each unit. Mr. Moeller explained that the smaller windows are located along the staircase and the larger windows have been placed on the landing. There are bedrooms on all three levels so they are proposing full bathrooms for each bedroom. Chair Montgomery asked if there were additional questions for the applicant. Seeing none, he asked if there were any members of the public who wished to speak on the project. Seeing none, he opened and closed public testimony. PLANNING COMMISSION DISCUSSION: Commissioner Segall stated that he supports the project. Commissioner Anderson stated that she supports the project but is not fond of the architecture. Commissioner Geldner stated that she supports the project because it meets the standards. She spoke about her concerns with the balance in elevations and architecture. Chair Montgomery thanked the architect for the additional handouts. PLANNING COMMISSION COMMENTS: Commissioner Segall stated that he had submitted three programs for next year's Planning Commission Academy. He reminded the Commissioners to send him any additional programs that they would like to submit. The deadline for submittal is Monday, August 20, 2018. Chair Montgomery brought up the interpretation for the development standard referring to varied window shapes in table E. CITY PLANNER COMMENTS: None. CITY ATTORNEY COMMENTS: None.
