City Co uncil Chamber 1200 Ca rlsbad Vi ll age Drive Carlsbad, CA 92008 April 15, 2020 CALL TO ORDER: 6 p.m. ROLL CALL: Anderson, Geidner, Lafferty, Luna, Meenes, Merz, and Stine APPROVAL OF MINUTES: Motion by Commissioner Stine, seconded by Commissioner Luna, to approve the Feb. 19, 2020 meeting minutes, as amended. Motion carried 7 /0. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None PLANNING COMMISSION PUBLIC HEARING: Chair Anderson reviewed the procedures the Commission would be following for that evening's public hearing. City Planner Neu requested that item 3, the project titled Loker Avenue, be pulled out of order and approved on consent. He stated the project is routine in nature and there was no public input or concerns received on the project. 3. CT 2019-0005/PUD 2019-0005 (DEV2019-0104) -LOKER AVENUE -Request for approval of a Tentative Tract Map and Nonresidential Planned Development Permit for a one-lot subdivision with 10 nonresidential airspace condominium units on a 12.4-acre site previously developed with 10 existing light industrial buildings located at 2720-2738 Loker Avenue West in the P-M (Planned Industrial) Zone, and Local Facilities Management Zone 5. The City Planner has determined that this project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment and is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15315 (Minor Land Divisions) of the State CEQA guidelines. DISCLOSURES: Commissioner Merz disclosed he has leased and sold industrial buildings in the immediate a~ea of the project and is very familiar with the site. Commissioner Meenes and Geidner disclosed they drove by the site. ACTION: Motion by Commissioner Meenes, seconded by Commissioner Merz, to adopt Resolution No. 7366. Motion carried, 7 /0 Planning Commission Minutes April 15, 2020 Page 2 Chair Anderson opened the public hearing for Item 1. 1. CDP 2019-0023 (DEV2019-0158) HERNANDEZ RESIDENCE -Request for approval of a Coastal Development Permit (CDP) to allow for the demolition of an existing single-family residence with a detached one-story garage and the construction of a 2,422-square-foot, two-story single-family residence with a detached 489-square~foot one-story garage within the Mello II Segment of the city's Local Coastal Program located at 3677 Garfield Street within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The city planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a), construction of a single-family residence, of the state CEQA Guidelines. City Planner Neu introduced Agenda Item 1 and stated Senior Planner Jones would make the staff presentation (on file in the Planning Division). Senior Planner Jones gave the staff presentation. DISCLOSURES: Commissioner Meenes and Merz disclosed they drove by the site. Commissioner Lafferty disclosed she drove by the site and checked the library's digital list of historical properties and confirmed the property is not on the list. Commissioner Geidner and Chair Anderson disclosed they looked at the property on google earth. DISCUSSION: Commissioner Lafferty requested modifications be made to the height and location of the light pole on the deck. She wants to ensure the light does not affect the neighbors. Chair Anderson and Commissioner Meenes agreed that is also a concern of theirs. Sam Chereskin, applicant for the project, agreed the lighting design for the staircase can be modified. Senior Planner Jones stated the proposed condition would be "The proposed lighting at the spiral staircase does not trespass onto adjacent properties and is not visible." City Planner Neu added the lighting condition would include seeing the proposed lighting on either the project exhibits or building plan submittal to ensure it satisfies what has been discussed. Chair Anderson asked ifthere were any members of the public who wished to speak on the project. Seeing none, she opened and closed public testimony at 6:39 p.m. ACTION: Motion by Commissioner Luna, seconded by Commissioner Meenes, to adopt Resolution No. 7362, as amended. Motion carried, 7 /0. CDP 2019-0032 {DEV2019-0133) -LOVE RESIDENCE -Request for approval of a Coastal Development Permit to allow for the construction of a new 2,535-square-foot single-family residence with an attached two-car garage within the Mello II Segment of the city's Local Coastal Program located at 4615 Telescope Avenue within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303{a) -construction of a single-family residence -of the State CEQA Guidelines. City Planner Neu introduced Agenda Item 2 and stated Associate Planner Danna would make the staff presentation (on file in the Planning Division). Associate Planner Danna gave the staff presentation. DISCLOSURES: Commissioner Merz disclosed he drove by the site. Commissioner Meenes disclosed he drove by and walked the site. Chair Anderson and Commissioner Geidner disclosed they looked at the property on google earth. Chair Anderson asked if there were any members of the public who wished to speak on the project. Seeing none, she opened and closed public testimony at 6:54 p.m. ACTION:. Motion by Commissioner Lafferty, seconded by Commissioner Stine to adopt Resolution No . 7367. Motion carried, 7 /0. 4. AMEND 2020-0001/AMEND 2020-0002 {DEV 08014) -VILLAGE AND BARRIO MASTER PLAN AMENDMENTS -Request for a recommendation to approve amendments to the Village and Barrio Master Plan and Local Coastal Program to change the approval authority from Planning Commission to City Council for site development plans, conditional use permits, coastal development permits, and variances in the Barrio districts {BP, BC and VBO) of the Village and Barrio Master Plan . The city planner has determined that the amendments are exempt from the California Environmental Quality Act {CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) because the amendments (a change of approval authority for development permits) does not have the potential to cause a significant effect on the environment. City Planner Neu introduced Agenda Item 4 and stated Senior Planner Jesser would make the staff presentation (on file in the Planning Division). Senior Planner Jesser gave the staff presentation. Planning Commission Minutes April 15, 2020 Page 4 DISCUSSION: Chair Anderson, Commissioners Stine, Merz, Meenes, and Geidner shared concerns that recommending the change of approval authority from Planning Commission to City Council in the Barrio districts will add another layer of review for projects, cause the council hearings to be heavier, discourage development in the village and barrio, raise costs for the applicant, and lengthen the process for permits. Commissioner Lafferty asked if the city will be able to meet compliance set out in SB 330, specifically the amount of hearings and timeliness of hearings, if the commission recommends the change of approval authority from Planning Commission to City Council in the Barrio districts. She shared concerns that if there are objective design standards and an architectural review board added to projects in the Village and Barrio districts that it could affect the requirements of SB 330. She stated she supports a consistent review process and would like to see changes made holistically and not piecemealed. City Planner Neu stated he believes the city would be able to comply with the maximum number of hearings requirement but has a concern that timelines in SB 330 would be challenging to meet with the proposed change. Commissioner Luna suggested a third hybrid option where the Planning Commission final action automatically goes to City Council in a process similar to processing final maps. She stated this would be a minor time delay and provide City Council the opportunity to pull the item if needed. The Planning Commission will recommend the alternative option that changes approval authority from City Council to Planning Commission for permits in the Village district to ensure the equivalent level of permit review and approval throughout the Village and Barrio Master Plan. They agreed this will reduce the amount of public hearings for permits in the Village districts. Chair Anderson asked if there were any members of the public who wished to speak on the project. Seeing none, she opened and closed public testimony at 7:38 p.m. Motion by Commissioner Merz, seconded by Commissioner Geidner, to adopt Resolution No. 7565 as amended. Motion carried, 7 /0. PLANNING COMMISSION REPORTS COMMENTS: Commissioner Lafferty shared concerns about affordable housing. Chair Anderson encouraged the commission to watch the Housing Element Advisory Committee meetings. She stated the meetings have valuable information about housing. Commissioners Meenes, Merz, and Stine thanked the city council for the opportunity to attend the League of California Cities Planning Commission Academy they attended in March. · CITY PLANNER REPORTS: City Planner Neu gave an update on the Housing Element Advisory Committee.
