A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE CONTRACT DOCUMENTS, PLANS AND
SPECIFICATIONS FOR THE POINSETTIA COMMUNITY PARK PHASE IV
DOG PARK PROJECT, CIP PROJECT NO. 4608, AND AUTHORIZING THE
CITY CLERK TO ADVERTISE THE PROJECT FOR PUBLIC BIDS
WHEREAS, in 1992, the City Council approved the Master Plan for Poinsettia Community Park,
previously known as Alta Mira Community Park; and
WHEREAS, in 2014, the City Council approved an amendment to the Poinsettia Community Park
Master Plan, which included - amongst other amenities - an off-leash dog park (dog park) in a central
area of the community park; and
WHEREAS, per City Council direction, construction documents were subsequently prepared
for the Poinsettia Community Park Phase III Improvements Project, which included a multi-sport
arena field, an enlarged playground, and a dog park (Resolution No. 2014-280); and
WHEREAS, in September 2016, the City Council approved the Phase III Improvements Project's
plans/specifications and authorized the advertisement for bids; and
WHEREAS, prior to staffs request of the City Council to award the construction contract, and
after posting signs in the park indicating that the associated improvements would be 'Coming Soon',
multiple residents requested the dog park be moved from its' master planned location in a grass-
laden detention basin, expressing a desire to save the 'grassy bowl' as an unstructured play area; and
WHEREAS, in September 2017, the City Council directed staff to revise the plans/
specifications for the Phase III Construction Project to remove the dog park and explore its' relocation
to an area in Poinsettia Community Park, previously envisioned for a multi-generational community
center (Resolution No. 2017-185); and

WHEREAS, after seeking community input on a possible relocation site for the dog park, staff
found that nearly 80% of the 678 responses were supportive of relocating the dog park; and
WHEREAS, in January 2018, the Parks & Recreation Commission supported the alternate dog
park location and recommended that staff advise the City Council accordingly; and
WHEREAS, on Feb. 13, 2018, the City Council authorized staff to pursue relocation of the dog
park as a separate project — i.e., Phase IV Dog Park Project (Resolution No. 2018-020); and
WHEREAS, in June 2018, staff entered into a Professional Services Agreement with a design
firm to prepare a conceptual plan and visual simulations for the dog park; and
WHEREAS, in November 2018, the conceptual plans were submitted to the Planning Division
with applications for a Conditional Use Permit (CUP) Amendment and a Coastal Development Permit
(CDP); and
WHEREAS, in accordance with the City Council's Public Involvement Policy (Policy No. 84),
public notification and information signs were installed at the dog park site advising of the
application, and inviting interested parties to access information via a website link; and
WHEREAS, on Aug. 21, 2019, the Planning Commission approved the CUP Amendment and
CDP for the Phase IV Dog Park Project; and
WHEREAS, although the addition of a parking lot was not required in conjunction with the
approvals for the dog park, staff received correspondence from numerous patrons and neighbors
about the demand for parking during heavily attended park activities; and
WHEREAS, staff has observed illegal overflow parking on the park's grass, planters and
sidewalks during such activities; and

WHEREAS, to help alleviate the demand for parking during those peak periods, and to
accommodate additional handicapped accessible spaces near the dog park, staff recommended
adding a parking lot north of the dog park, with approximately 30 standard spaces, two handicapped
accessible spaces, and four electric vehicle spaces with charging stations; and
WHEREAS, staff also identified the need for the addition of a restroom facility within this area
of the park for patrons of the pickleball courts, upper tennis courts and the proposed dog park; and
WHEREAS, on Oct. 31, 2019, the Planning Division approved a Consistency Determination for
the subject parking lot and restroom facility, confirming these amenities are consistent with the uses
previously allowed in Poinsettia Community Park under the approved CUP and CDP; and
WHEREAS, on Nov. 18, 2019, the Parks & Recreation Commission recommended the City
Council approve an amendment to the Poinsettia Community Park Master Plan to relocate the
proposed off leash dog park and add an adjacent parking lot and restroom facility; and
WHEREAS, on Dec. 10, 2019, the City Council approved that amendment and staff
subsequently worked with the design consultant to develop the project's contract documents, plans
and specifications; and
WHEREAS, the contract documents, plans, and specifications for the furnishing of all labor,
material and equipment necessary to construct the Project have been prepared, are on file in the city
clerk's office, and are incorporated by reference; and
WHEREAS, the estimated construction cost of the dog park, parking lot and restroom is
$2,042,205, and total project funding, in an amount of $2,082,140 from the General Capital
Construction Fund, was approved in the FY 19-20 and 20-21 ClP Budgets; and

WHEREAS, staff anticipates returning to the City Council with a request for appropriation of
additional funds at the time of award of a construction contract.
WHEREAS, On Oct. 7, 1992, the Planning Commission approved CUP No. 92-5 and adopted a
Mitigated Negative Declaration and a Mitigation Monitoring and Reporting Program for the Poinsettia
Community Park; and
WHEREAS, on Aug. 21, 2019, the Planning Commission found that the Phase IV Dog Park
Project is within the scope of the prior environmental document and no further environmental
documentation is required per California Environmental Quality Act Guidelines Section 15162; and
WHEREAS, all applicable mitigation measures contained in the prior environmental document
have either been satisfied previously, will be incorporated into the Phase IV Dog Park Project's
construction documents, plans/specifications, are existing Parks & Recreation Department policy,
and/or are conditions of approval in Planning Commission Resolution No. 7343 for the Phase IV Dog
Park Project; and
WHEREAS, the addition of the parking lot and restroom are also within the scope of the prior
environmental documents and are consistent with the uses allowed in the Poinsettia Community Park
Master Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct,
2.That the contract documents, plans and specifications for the Poinsettia Community
Park Phase IV Dog Park Project (CIP Project No. 4608) have been prepared, are on file in
the city clerk's office, and are approved.

3. That the city clerk of the City of Carlsbad is authorized and directed to publish, in
accordance with State law, a notice to contractors inviting bids for the Poinsettia
Community Park Phase IV Dog Park Project (CIP Project No. 4608) in accordance with
the referenced contract documents, plans and specifications.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 12th day of January, 2021, by the following vote, to wit:
