HomeMy WebLinkAboutCD 2020-0016; LANIKAI LANE GATED GALLERY; Admin Decision LetterDecember 16, 2020 Bill Hofman 3152 Lionshead Avenue Carlsbad, CA 92010 SUBJECT: CD 2020-0016 (DEV09027)-LANIKAI LANE GATED GALLERY Ccityof Carlsbad BFILE COPY /Y/a.,·/4d 12/;a/20 The City Planner has completed a review of your application for a Consistency Determination on the property located at 6550 Ponto Drive (APN: 214-150-09-00), which is a modification to PUD 15-11/CDP 15-23 that approved the installation of a decorative vehicular entry gate. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • The addition of a vehicular gate on the south end of the property for the exit-only driveway. • Installation of two trellis structures located at the main entry and one at the south exit gate. • The installation of nickel gap shiplap horizontal steel panel fencing with stone veneer pilasters in lieu of the previously approved tube steel gate. • Revisions to the conceptual landscape plans to match the approved landscape construction drawings on file. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No praject condition, feature, facility ar amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed modifications only include a material and design change to the approved vehicular gate that will be in the same location and the same height os the approved project, and the addition of a matching vehicular gate at the south exit-only driveway. The upgrades to the landscaping and the additian of three trellis structures are consistent with the approved project and will Improve the praject's design. 2) The request represents on upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the revision includes an upgrade in the design and materials of the gate and adds a matching gate at the southerly exit- only driveway and enhances the street frontage by providing for consistency across all ingress and egress points. The proposed modifications also include improvements to the approved landscaping, and the addition of three trellis structures that will accent the landscaping design and meet setback requirements. All the proposed revisions will improve the compatibility with the surrounding neighborhood. 3} The proposed revision does not change the density or boundary of the subject property. The proposed revisions do not create changes of greater than ten percent because the height and location of the gate is the same as the approved plans. In addition, the new gate at the southerly exit-only driveway and the three trellis structures that will enhance the design of the street frontage meet the applicable development standards of the Carlsbad Municipal Code regarding height and setbacks. 7) The proposed change will not result in any significont environmental impact, and/or require additional mitigation because the proposed modifications continue to be categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301{e) -Existing Facilities of the state CEQA Guidelines. The proposed modifications do not create any potential impacts not previously addressed. 8} The proposed change would not result in any health, safety or welfare impacts. 9} There were not any major issues ar controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved because the proposed modifications represent minor changes to the site. The revised main entry gate does not change the height and location of the approved gate. Furthermore, the addition of a vehicular gate at the southerly exit-only driveway, updated landscaping, and three trellis structures will improve the overall design by providing consistency across the street front of the property. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
