Background The City of Carlsbad owns the 75-unit Tyler Court Senior Apartments, which provides affordable housing to very-low and extremely-low income seniors. The city contracts with WSH Management, Inc. for management of the property. Discussion At approximately 11:30 a.m. on Oct. 9, 2020, the Tyler Court Senior Apartments property manager notified his supervisor about a reported COVID-19 positive case on the property. Shortly thereafter, the property manager distributed a notice to all residents informing them of the positive COVID-19 test and the steps taken with respect to enhanced cleaning and sanitizing of common areas of the property per CDC guidelines, especially of those areas that the infected person may have come into contact (Attachment A) .. While it appears that the proper County of San Diego health protocols were followed, city staff did not learn of this incident until a third party contacted one of our elected officials later that afternoon. It was at this time the managing supervisor provided city staff additional detail of the protocols they followed that day, including the standard daily electrostatic sanitizing/wiping down of common areas in the morning, and then the deep cleaning and electrostatic sanitizing of common areas in the afternoon, after learning of the positive COVID-19 case. The managing supervisor stated that the on-site property manager responded to five resident inquiries regarding the notice, reassuring them of the ~afety measures in place at Tyler Court since earlier in the year. This is the second incident in five months where city staff were not properly informed of an emergency situation at Tyler Court Senior Apartments. The other involved an incident occurring on ) Council Memo -Tyler Court Senior Apartments -Positive COVID-19 Case Oct. 22, 2020 Page 2 June 22, 2020, where the Carlsbad Fire Department responded to a medical aid call to Tyler Court, where an occupant in one of the units was found deceased. Similarly, staff learned of the incident after a third party contacted one of our elected officials. In response, on Oct. 2.1, 2020, the City Manager sent a letter to WSH Management, Inc. stressing the importance of providing timely emergency related updates about Tyler Court in order to allow for adequate time to understand the circumstances surrounding the emergency so that we can properly inform Carlsbad public officials or provide assistance if appropriate {Attachment B). Shortly after the letter was sent, the supervising manager for WSH Management, Inc. responded via email where she agreed to make every effort to notify the city as soon as possible regarding all emergency situations at Tyler. Court {Attachment C). Next Steps Staff will continue to monitor for any additional impacts of the COVID-19 case at Tyler Court. Staff will also continue to stress the importance of improved communications with WSH Management, Inc. The infected person was last in the common areas or building on October 07,2020. We are aware of the person's path of travel while in the building and are in the process of deep cleaning the main lobby, elevators, and common areas with which that the person may have come into contact. As we have informed you in previous notices, Tyler Court Apartments has enhanced its cleaning and sanitization protocol to include specifically wiping down, cleaning, and disinfecting all major common area high-touch contact points, including restrooms, door knobs, elevator cabs and call buttons, etc., and has increased the frequency of such cleaning measures. In addition to these continuing efforts, we will be immediately deep cleaning all common areas that the infected person may have come into contact with, in accordance with the CDC guidelines. In accordance with CDC guidelines, we encourage anyone who believes they may have been exposed to COVID-19 or who has flu-like symptoms, such as a fever, cough, sore throat, and shortness of breath to contact your healthcare provider. We appreciate your understanding as we all deal with this situation. As the_ owners of the property we appreciate your company's management of Tyler Court, however, the City needs to be kept . informed of all significant events that occur at this location in a prompt, timely manner. On Oct. 9, 2020, at 11:36. a.m. the onsite property manager notified you via email that one of the residents at the Tyler Court Senior Apartments tested positive for COVID-19. Following the notification, we understand th'at the residents were notified per County of San Diego health standards, and COVID-19 cleaning protocols were initiated. Unfortunat~ly, city staff did not learn of this incident until a third party contacted one of our elected officials later that afternoon. This prompted city staff to make calls to investigate the information. Staff eventually connected with you via phone around 4:30 p.m. that afternoon and received your email at 5:41 p.m., where you detailed the notifications to residents and other protocols that w~re followed. This is the second recent example where city staff were not properly informed of an emergency situation at Tyler Court Senior Apartments. On June 22, 2020, the Carlsbad Fire Department responded to a medical aid call to Tyler Court, where an occupant in One of the units was found deceased. City staff learned of this incident early afternoon on June 23, 2020, from an elected official who had been informed by a third party. When contacted by our city staff, you indicated that you had not yet heard of the incident from your own onsite property manager. It is important that city staff be provided emergency related updates about Tyler Court immediately in order to allow for adequate time to understand the circumstances surrounding the emergency so that we can properly inform Carlsbad public officials or provide assistance if appropriate. It is our expectation that steps will betaken moving forward to avoid situations l[ke those described in this ter.
