Enrolled Vetoed Chaptered Summary: The California Building Standards Law provides for the adoption of building standards by state agencies by requiring all state agencies that adopt or propose adopt ion of any building standard to submit the building standard to the California Building Standards Commission for approval and adoption. Current law requires an adopting agency to submit the notice and initial statement of reasons for proposed building standards to the commission. If, after review, the commission determines that the notice and initial statement of reasons comply with the Administrative Procedure Act, existing law requires that the commission submit the notice to t he Office of Administrative Law for the sole purpose of inclusion in the California Regulatory Notice Register. This bill would, until January 1, 2029, exempt from the requirements of CEQA, housing projects that meet certain requirements. The bill would require a lead agency, if it determines that a housing project is exempt from CEQA under the above provision, to file a specified notice with the county clerk in each county in which the project is located. Current law requires state agencies to work to maximize specified objectives. This bill would include, as objectives to be maximized, building resilient communities by developing projects that incorporate, to t he maximum extent feasible, cool surface materials and investing in communities to develop community-specific climate resilience plans and to establish community resilience centers to mitigate impacts of local climate risks. Summary: Current aw requires the State Air Resources Board, by October 1, 2018, to prepare and update, at least once every 5 years, a statewide strategy to reduce emissions of toxic air contaminants and criteria air pollutants in communities affected by a high cumulative exposure burden. Current law requires the state board to select locations around the state for the preparation of community emissions reduction programs, and to provide grants to community-based organizations for technical assistance and to support community participation in the programs. Current law requires an air quality management district or air pollution control district containing a selected location, within one year of the state board's selection, to adopt a community emissions reduction program . This bill would prohibit a district that contains a selected location from authorizing a new major source, or revisions to an existing source, that increases toxic air contaminants and criteria air pollutants above the levels included in the community emissions reduction plan for that location without requiring the major source Page 9/70 complex, including a requirement that the master-meter customer charge each user at t he same rate that would be applicable if the user were receiving gas or electricity directly from the gas corporation or electric corporation. This bill would replace "electrical corporation" with "load-serving entity," defined as including electrical corporations, community choice aggregators, and electric service providers, in many of these provisions relative to. the responsibilities of an electrical corporation and master-meter customer when electrical service is provided by a master-meter customer to users who are tenants of a mobilehome park, apartment building, or similar residential complex. This bill would make a nonsubstantive change to the language requiring that the governing body of a community choice aggregator adopt a policy expressly prohibiting dissemination of false information relative to the community choice aggregator's rates or terms and conditions of service. Current law specifies the number of incentives or concessions that an applicant can receive. Current law specifies that an applicant shall receive 3 incentives or concessions for projects that include at least 30% of the total units for lower income households, at least 15% for very low income households, or at least 30% for persons or families of moderate income in a common interest development. This bill, instead, would authorize an applicant to receive 3 incentives or concessions for projects described above that include at least 12% of the total units for very low income households. Existing law exem pts specified occupations and business relationships, including persons providing professional services under specified circumstances. Current law instead provides that these exempt relationships are governed by the multifactor test previously adopted in the case of S. G. Borello & Sons, Inc. v. This bill would replace the submission limit and instead exempt still photographers, phot oj ournalists, freelance writers, editors, and newspaper cartoonists from the application of Dynamex and these provisions based upon different specified cr iteria, including that these persons provide professional services pursuant to a contract that includes specified items, as provided. This bill would revise the requirements of the housing element, as described above, in connection with identifying zones or zoning designations that allow residential use, including mixed use, where emergency shelters are allowed as a permitted use without a conditional use or other discretionary permit. If an emergency shelter zoning designation where residential use is a permitted use is unfeasible, the bill would permit a local government to designate zones for emergency shelters in a nonresidential zone if the local government demonstrates that the zone is connected to amenities and services, as specified, that serve homeless people.
