HomeMy WebLinkAboutCD 2019-0011; CARLSBAD FLORAL TRADE CENTER; Admin Decision LetterJanuary 2, 2020 Christopher Calkins 7220 Avenida Encinas, Suite 204 Carlsbad, CA 92011 SUBJECT: CD 2019-0011 {DEV12035)-CARLSBAD FLORAL TRADE CENTER ('Cityof Carlsbad The City Planner has completed a review of your application for a Consistency Determination on property located south of Cannon Road and east of Car Country Drive (APN: 211-023-11-00), which is a modification to CUP 12-10/CDP 12-19/MS 12-03 that approved the construction of the Carlsbad Floral Trade Center and Market Place. The project includes the construction of a five-phase, seven-building development that includes a floral trade center and market place, microbrewery, winery, culinary center, and retail space totaling 132,352 square-feet. The development also includes gardens, orchards, and parking . • The subject Consistency Determination is preceded by Consistency Determination CD 15-13, which allowed a square footage increase to the trade center and market place building, a square footage increase and combination of the culinary and education center with the winery, a reduction of the micro- brewery building height and square footage, the addition of public restrooms, relocation of truck loading docks on two buildings, adjustments to the size of the onsite bio-retention basins, and additional minor changes and adjustments. After careful consideration of the request, the City Planner has determined that the current request meets all of the findings below and APPROVES this request. The proposed modifications include: • Revision to the project phasing in order to build an access driveway and seasonal parking area prior to trade center and marketplace construction (the original Phase 1 becomes Phase 2 and so forth). • Minor revisions to the original Phase 1 to adjust the trash enclosure location, accommodate electric vehicle charging stations, and other minor dimensional changes. • Revisions to the tentative map, grading, drainage, and utility plans in order to conform with current standards. • Revisions to the conceptual landscape plans to match the current landscaping plans on file. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the overall project does not significantly change and the proposed land uses and project layout remain unchanged. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the revision adds approximately 400 parking spaces for overflow Flower Fields visitor parking, which alleviates traffic and parking congestion in the surrounding area during the peak visitor season. The seasonal parking area will be located in the area that is scheduled to be developed during phase three. At that time, the seasonal parking area will be removed to make room for the phase three development. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the overall project does not significantly change since a seasonal parking area is temporarily added to the future site of phase three. The Planning Commission adopted a Negative Declaration for the project through Resolution No. 7023 on December 4, 2013, and the current request does not create any potential impacts not previously addressed. 8} The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the proposed revision mainly adds temporary seasonal visitor parking by adding one phase to the development of the site. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
