A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO ORION
CONSTRUCTION CORPORATION FOR AN AMOUNT NOT TO EXCEED
$1,859,895 FOR THE CONSTRUCTION OF THE DRAINAGE MASTER PLAN
PROJECT: BCA -TAMARACK AVENUE, PARK DRIVE AND MONROE STREET,
PROJECT NOS. 6001, 6608 AND 6617.
EXHIBIT I
WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary,
desirable, and in the public's best interest to construct the Drainage Master Plan Project: BCA -
Tamarack Avenue, Park Drive and Monroe Street, Project Nos. 6001, 6608 and 6617 (Project); and
WHEREAS, on Nov. 7, 2017, the City Council of the City of Carlsbad adopted Resolution No.
2017-213 approving plans and specifications for the construction of the Project; and
WHEREAS, the City of Carlsbad received seven sealed bids on Jan. 3, 2018 for the construction
of the Project; and
WHEREAS, Orion Construction Corporation submitted the lowest responsive and responsible
bid to construct the Project in the amount of $1,859,895; and
WHEREAS, there are sufficient funds available in the Pavement Management Program,
Northwest Quadrant Storm Drain Program, and the Drainage Master Plan Project: BCA to complete the
Project; and
WHEREAS, subsections 3.28.040(C)(S) and 3.28.090(8) of the Carlsbad Municipal Code
authorize the city manager or designee to approve change orders in the amount equal to the
contingency set at the time of the Project award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid of $1,859,895 submitted by Orion Construction Corporation for the
construction of the Drainage Master Plan Project: BCA -Tamarack Avenue, Park Drive
and Monroe Street, Project Nos. 6001, 6608 and 6617 is accepted and the mayor is
hereby authorized to execute a contract for this Project.
3. That the city manager or designee is hereby authorized to approve construction change
orders up to $220,000.
EXHIBIT I
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and
insurance policies within 20 days of adoption of this Resolution. The city manager may
grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 13th day of February, 2018, by the following vote, to wit:
