Recommended Action Adopt a Resolution accepting bids and awarding a contract to Creative Home DBA CHI Construction for the construction of the La Costa Water Main Replacement, Project No. 5035. Executive Summary In 2013,a pipeline failed within the south golf course of the Omni La Costa Resort. The existing asbestos cement pipeline, constructed in 1961, has reached the end of its useful life and is in need of replacement. Approximately 580 linear feet of new pipeline will be constructed using a trenchless construction method to minimize damage to the existing golf course. The remaining 390 linear feet will be standard open -cut construction. Additionally, two nearby waterline segments located within substandard easements will also be replaced by a single pipeline. Service to customers will be maintained during construction with minor interruptions. Staff recommends accepting bids and awarding a contract to Creative Home DBA CHI Construction for the construction of the La Costa Water Main Replacement, Project No. 5035. Discussion In 2013, an asbestos cement pipeline failed within the south golf course of the Omni La Costa Resort and has since been out of service while a new alignment was negotiated with the property owner.In order to mitigate future line -breaks, interruption of service, property damage, and water loss, staff recommends replacement of the old pipeline within a new alignment. The revised alignment will allow more efficient access for maintenance and operations staff. The construction will include approximately 970 linear feet of 8 -inch high density polyethylene (HDPE) and polyvinyl chloride (PVC)waterline that will cross the south golf course and connect to the existing potable water distribution system adjacent to a condominium complex at 2500 Navarra Drive (2500 Navarra Drive Homeowners' Association). To minimize impacts to the golf course, approximately 580 linear feet of HDPE water line will be constructed using a trenchless construction method. The remaining 390 linear feet of 8 -inch PVC will connect to the condominium complex and will be completed with standard open -cut construction. 450 In addition, approximately 90 linear feet of new 8 -inch PVC waterline will be installed at 2522 Navarra Drive (La Costa Riviera Homeowners' Association) to provide a more reliable service to those customers and allow more efficient access for maintenance and operations staff. The current alignment is located between units in a very narrow easement which makes maintenance difficult. On April 25, 2017, through the adoption of Resolution No. 1565, the Carlsbad Municipal Water District (CMWD) Board approved plans and specifications and authorized the secretary to the Board to advertise to receive bids for the La Costa Water Main Replacement, Project No. 5035. On May 25, 2017, seven sealed bids were received for the construction of this project as shown in the following table: LA COSTA WATER MAIN REPLACEMENT, PROJECT NO. 5035 CONTRACTOR TOTAL BID 1.Creative Home DBA CHI Construction $364,392 2.J.R.Filanc Construction Company, Inc.$396,333 3.Burtech Pipeline, Inc.$446,100 4.Palm Engineering Construction Company $528,500 5.PAL General Engineering $640,650 6.CCL Contracting, Inc.$645,500 7.Genesis Construction $653,832 Creative Home DBA CHI Construction submitted the lowest bid in the amount of $364,392. The engineer's estimate of the construction cost of the La Costa Water Main Replacement, Project No. 5035, was $310,000. Staff has completed the review of the bid documents and has determined that Creative Home DBA CHI Construction is responsive and responsible and the confirmed low bidder. Creative Home DBA CHI Construction submitted a list of similar projects to show their capabilities and qualifications to perform the specified work. Creative Home DBA CHI Construction did not include notarization for their signatures which is a minor irregularity that staff recommends waiving under Carlsbad Municipal Code section 3.28.080(G)(3). Staff recommends that Creative Home DBA CHI Construction be awarded the contract. The construction contract contains general performance standards, references technical specifications, and includes a one year warranty period. A 10 percent retention will be withheld from each progress payment until final acceptance of the project. The construction contract includes liquidated damages which may be assessed in the amount of $2,500 per day for each day in excess of the time specified for completion of the work. The contract also contains provisions for an incentive program to incentivize the contractor to work diligently to complete the project ahead of schedule. For each calendar day the contractor completes the work early, the contractor shall earn $1,000, with a cap of $30,000. 451 Fiscal Analysis As shown in the table below, the estimated total project cost of $614,392 includes the following: construction contract;15 percent contingency for change orders management; construction management and inspection; engineering support for contractor shop drawings, requests for information and meetings; and community outreach. The project will be funded by the Limited Access Pipeline Relocation Program. Once this task is complete, staff will schedule a pre - construction meeting with Creative Home DBA CHI Construction and a Notice -to -Proceed will be issued. The duration of the construction contract is 89 working days, exclusive of weather related events and change orders that may extend the contract duration. Upon the successful completion of the project, staff will request that the executive manager accept the construction of the La Costa Water Main Replacement, Project No. 5035, and direct the secretary to the Board to record a Notice of Completion and to release bonds. Environmental Evaluation (CEQA) The project is exempt from the California Environmental Quality Act (CEQA)per State CEQA Guidelines Section 15301(b)—repair and minor alteration of existing facilities, including public utility services, involving negligible or no expansion. 452 Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. CMWD staff will work closely with Omni La Costa Resort staff for any needed outreach. WHEREAS,the Carlsbad Municipal Water District (CMWD)Board of the City of Carlsbad, California has determined it necessary, desirable, and in the public interest to replace the water main within and adjacent to the golf course at the Omni La Costa Resort; and WHEREAS, on April 25, 2017, through the adoption of Resolution No. 1565, the CMWD Board approved plans and specifications, and authorized the secretary to the Board to advertise to receive bids for the La Costa Water Main Replacement, Project No. 5035; and WHEREAS, seven sealed bids were received on May 25, 2017, by CMWD for the construction of this project; and WHEREAS,the lowest responsible and responsive bid was submitted by Creative Home DBA CHI Construction in the amount of $364,392; and WHEREAS,sufficient funds exist in the Limited Access Pipeline Relocation Program,CIP No. 5035, for the completion of this project; and WHEREAS the project is exempt from CEQA per State CEQA Guidelines Section 15301(b)—repair and minor alteration of existing facilities, including public utility services, involving negligible or no expansion. NOW, THEREFORE,BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City of Carlsbad, California,as follows: 1.That the above recitations are true and correct. EXHIBIT 1 2.That the minor irregularity in the bid submitted by Creative Home DBA CHI Construction, in failing to include notarized signatures,is hereby waived under Carlsbad Municipal Code section 3.28.080(G)(3). 3.That the bid in the amount of $364,392 submitted by Creative Home DBA CHI Construction for construction of the La Costa Water Main Replacement, Project No. 5035,is accepted and the president of the Board is hereby authorized to execute a contract with Creative Home DBA CHI Construction. 4.That the executive manager or designee is hereby authorized to approve construction change orders up to $55,000 and incentive awards up to $30,000. 5.That the award of this contract is contingent upon Creative Homes DBA CHI Construction, executing the required contract and submitting the required bonds and insurance policies,as described in the contract,within 20 days of adoption of this Resolution.The executive manager may grant reasonable extensions of time.
