Recommended Action Adopt a Resolution authorizing an application to the California Department of Water Resources Water Desalination Grant Program Round 4, for construction of the Carlsbad 5 Flow Control Facility, Project No. 5038 . Executive Summary On June 16, 2017, the California Department of Water Resources (DWR) issued a proposal solicitation package for Round 4 of the Water Desalination Grant Program (Grant) to support desalination projects that enhance local water supply reliability. The Carlsbad Municipal Water District (CMWD) is planning to construct the Carlsbad 5 Flow Control Facility (FCF) to directly accept CMWD's desalinated water to enhance supply reliability and diversify the water portfolio. CMWD would like to submit an application for the Grant for construction of Carlsbad 5 FCF and is seeking the Board's support of this Grant application. Discussion Desalination is becoming a key strategy to help address California's water supply challenges. The Carlsbad Desalination Plant was commissioned in December 2015 and is a key component of San Diego County's water portfolio. On April 12, 2016, the CMWD Board adopted Resolution No. 1547 which authorized the execution of a Uniform Contract between the San Diego County Water Authority (SDCWA) and CMWD to purchase treated water from the Carlsbad Desalination Plant and promote local supply reliability. At this meeting, the Board also authorized execution of the First Amendment to the Reimbursement Agreement between CMWD and SDCWA to reimburse SDCWA for the planning and design of the Carlsbad 5 FCF. The California DWR has been actively supporting projects that advance desalinated water as one of the many water resource management strategies in the state to help meet supply needs and enhance water supply resiliency and reliability. The grant program is largely funded by the Water Quality, Supply, and Infrastructure Improvement Act of 2014 (Proposition 1). Eligible construction projects can receive up to 50 percent of estimated construction costs. Page 473 Staff has reviewed the California DWR's scoring system for the award of Grant funds and believes that the Carlsbad 5 FCF is consistent with the Grant's priorities. Fiscal Analysis Professional services are required from RMC Water and Environment to prepare the Grant application and feasibility study for a fee of $33,087. Staff will incur minor administrative costs to manage the consultant. The Board has previously approved funding for the planning and design of the facility by adopting Resolution No. 1547. Sufficient funds are currently available in Project No. 5038 {Carlsbad 5 FCF) to prepare the Grant application. If successful, CMWD may receive Grant funding for the design and construction of the flow control facility in an amount up to 50 percent of the design and construction cost, which is currently estimated at $3.4 million. If the Grant is awarded, staff will return to the Board for its consideration to accept the Grant and a request for appropriation. Next Steps Staff will prepare and submit the application to the California DWR prior to the due date of Sept. 1, 2017. CMWD staff will provide continued support and oversight to the staff of SDCWA during the design of the Carlsbad 5 FCF. At the completion of design, staff will return to the Board to request funding for the construction of the Carlsbad 5 FCF, Project No. 5038, and to amend the Reimbursement Agreement with SDCWA. Environmental Evaluation (CEQA) A Final Environmental Impact Report (FEIR 03-05 SCH No. 2004041081) was prepared for the Desalination Plant Project and certified by the City Council at its June 13, 2006 meeting in compliance with the California Environmental Quality Act {CEQA) Guidelines Section 15090. In 2009, the City Council considered and approved an addendum to this FEIR. Flow control facilities were considered in this first addendum, and it was acknowledged that an exact location was not determined and would be subject to further review. Staff will review the existing environmental documentation to determine if it is sufficient or if additional environmental review will be required. Public Notification · This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Page 474 RESOLUTION NO. 1583 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT {CMWD), AUTHORIZING AN APPLICATION TO THE CALIFORNIA DEPARTMENT OF WATER RESOURCES WATER DESALINATION GRANT PROGRAM ROUND 4, FOR CONSTRUCTION OF THE CARLSBAD 5 FLOW CONTROL FACILITY, PROJECT NO. 5038. EXHIBIT 1 WHEREAS, the Board of Directors of the Carlsbad Municipal Water District {CMWD) has determined it necessary, desirable and in the public interest for CMWD to purchase desalinated water from the San Diego County Water Authority {SDCWA) and to construct the Carlsbad 5 Flow Control Facility to further diversify CMWD's water portfolio and enhance supply reliability; and WHEREAS, on April 12, 2016, the CMWD Board adopted Resolution 1547 which authorized the execution of a Uniform Contract between SDCWA and CMWD to purchase treated water from the Carlsbad Desalination Plant; and WHEREAS, pursuant and subject to all of the terms and provisions of the Water Quality, Supply, and Infrastructure Improvement Act of 2014 {Proposition 1, California Water Code Section 79700 et seq.), the California Department of Water Resources is sponsoring Round 4 funding of the Water Desalination Grant Program (Grant) and issued a proposal solicitation package for said funding on July 16,2017;and WHEREAS, the Grant funding for the design and construction of the Carlsbad 5 Flow Control Facility may be awarded in an amount up to 50 percent of the estimated $3.4 million design and construction cost. NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the executive manager, or designee, is hereby authorized and directed to sign and file, for and on behalf of CMWD, an application for Grant funding from the Department of Water Resources for an amount not to exceed $3,400,000, for the Carlsbad 5 Flow Control Facility, Project No. 5038, under the terms and provisions of the Water Desalination Grant Program. 3. That CMWD authorizes the aforementioned representative, or designee, to certify that CMWD has and will comply with all applicable state and federal statutory and regulatory requirements related to any federal and state funds received. That the executive manager, or designee, is hereby authorized to negotiate and execute, upon approval by the general counsel and final approval of the contract by the Board of Directors, a funding agreement and any amendments or change orders thereto and certify funding disbursements on behalf of CMWD that are in substantial conformance, as determined by the office of the general counsel, with this Resolution.
