MEASURE A Shall Ordinance No. CS-283 of the Carlsbad City Council adopting the Agua Hedionda South Shore Specific Plan (203.4 acres east of the 1-5 freeway between the Agua Hedionda Lagoon and Cannon Road}, which designates 21.6 acres of additional open space, for a total of 176.7 acres of open space for public access, preservation of natural habitat, and agriculture, along with devel<1pment of 585,000 square feet of visitor-serving commercial uses on 26.7 acres be adopted? CITY ATTORNEY'S IMPARTIAL ANALYSIS Measure A proposes a Specific Plan governing future land uses and development in the Agua Hedionda South Shore area. It amends the General Plan, Agua Hedionda Land Use Plan, and Zoning Code to facilitate development of visitor-serving commercial uses, increase open space, allow public access to open space, and continue agricultural uses. Measure A was originally proposed by a citizen initiative signed by at least 15% of Carlsbad ·registered voters. On August 25, 2015, the City Council unanimously approved the Specific Plan by Ordinance No. CS-283. Subsequently, citizens circulated a referendum petition signed by at least 10% of the voters which required the City Council to reconsider Ordinance No. CS-283. The City Council then called a special election to allow voters to decide Measure A. The Specific Plan encompasses 203.4 acres of privately owned land east of the 1-5 freeway between Agua Hedionda Lagoon and Cannon Road. The western 48.3 acres have been designated for commercial use since at least 1982. The eastern 155.1 acres were designated open space in 2006 by Proposition D. The Specific Plan re-designates 21 .6 acres from commercial uses to open space. Up to 585,000 square feet of commercial uses in an outdoor shopping, dining and entertainment promenade is proposed on the remaining 26.7 commercial acres. City staff estimates a resulting $2,575,000 net annual increase in general fund revenues. Public access to the open space would be provided through trails, picnic and vista areas, agriculture, farm to table dining, an outdoor classroom and amphitheater. Measure A is not subject to review under the California Environmental Quality Act. The California Supreme Court held that a report prepared pursuant to Elections Code section 9212 is the exclusive means for assessing environmental impacts of initiatives. The City prepared a 9212 report at City Council direction. The 9212 report reviewed the proponent's environmental analysis for compliance with City l development standards. Staff determined environmental impacts were identified and mitigated, consistent with comparable development projects in the City and that the project met or exceeded city development standards, with the exception of traffic. Regional traffic growth will exceed City standards with or without the project. Measure A improves traffic by implementing traffic mitigation measures. PR-09A0-1 N SO 001-008 CITY ATTORNEY'S IMPARTIAL ANALYSIS (continued) The Specific Plan establishes development standards and design guidelines. Matters not specifically regulated by. the Specific Plan are subject to the Carlsbad Municipal Code and other City regulations. Future approvals and determinations regarding development in the Specific Plan area shall be made by the City Planner and are ministerial in nature. The California Coastal Commission will be required to approve the Specific Plan after voter adoption. By its terms, Measure A shall not be amended or repealed without a vote of the people for 15 years. Thereafter, it may be amended or repealed by the City Council or a vote of the people. PR-09A0-2 N SO 001-009 ARGUMENTS IN SUPPORT OR OPPOSITION OF THE PROPOSED LAWS ARE THE OPINIONS OF THE AUTHORS. ARGUMENT IN FAVOR OF MEASURE A The Carlsbad City Council urges voters to study the FACTS and vote Yes on Measure A. Development is allowed on this land and has been since the 1980's. The proposed. open-air shopping and dining promenade will take up 26.7 of the 48 acres zoned for ~ommerc1.al ~se. If Measure A is not approved, another plan could build on the entire 48 acres, w1th no obligation to improve the adjacent open space or provide any access to the public. City planners, traffic engineers and environmental manag.ers ~a~e thor~ughly evaluated ~easure A and found it MEETS or EXCEEDS city standards for he1ght lim1ts, environmental protection, and most importantly, vastly complies with 10 of the 11 standards in the city'~ award~winning growth management plan. Regional traffic growth will exceed city standards With or Without the plan. These are the FACTS. City staff and independent experts have verified that voting Yes on A means: IMPROVED TRAFFIC FLOW compared to the status quo because of builder-funded improvements to roads and traffic signals as a part of the plan. MORE OPEN SPACE than Carlsbad has today. Miles of new TRAILS with picnic areas. Family-run strawberry farming is made SUSTAINABLE for future generations. . PRESERVATION and enhancement of lagoon wildlife, wetlands and water quality. California Coastal Commission approval IS required. A YES on A vote makes financial sense because revenue from retail sales will provide, at NO COST TO TAXPAYERS: $16.5 million for open space restoration and maintenance. $2.6 million annually for police, fire, parks, libraries and other city services. A donation of 155 acres of open space to a conservancy to ensure it remains well- maintained and permanently accessible to the public. The truth is no other project could build on the entire 48 acres zoned for commercial use because a large portion of the site is under power lines, precluding any buildings. The proposed mega mall does not meet or exceed all of Carlsbad's existing development standards -the Council's own project report documented this. A 500,000-square-foot mall is not a permissible use under the City's General Plan designation for this property. Neither is a big-box store like Walmart. Access and environmental impacts are unknown. It is the wrong location for a mega mall. The City's 9212 report claims traffic will be improved with the project. Actually, the mega mall will attract over 12 million customers annually. Any solution to traffic congestion depends on 1-5 ramp improvements -not scheduled to begin until 2035 or later. Even worse, Caltrans says the development "would limit or preclude" a needed direct access ramp on Cannon Road and "there are no other feasible (Carlsbad) sites." The Council arguments claims Measure A makes financial sense. In truth, Carlsbad taxpayers could pay millions to relieve congestion, clean up environmental damage, and make up for the tax revenues lost from businesses cannibalized by this mall. ARGUMENT AGAINST MEASURE A MEASURE A IS BAD FOR CARLSBAD Measure A allows an oversized, 500,000 square-foot shopping mall on the Agua Hedionda Lagoon. This L.A.-style development, with massive multistory buildings and parking garages, is nearly twice the density of Carlsbad's largest existing mall. YEARS OF TRAFFIC CONGESTION The developer projects this mall will draw shoppers from throughout the region, generating more than 24,100 new car trips daily on Interstate 5, Cannon, and nearby roads. But Caltrans says it cannot widen the highway or expand ramps for at least 19 years. Taxpayers could end up spending millions to fix these traffic problems. SIDESTEPPED SAFEGUARDS Spending over $5 million on slick TV commercials and mailers, the L.A. develo~e~ is using Measure A to avoid California environmental law and Carlsbad's bwldmg standards, limiting citizen review and accountability. After failing to block a public vote, the developer convinced the City Council to call a special election, costing taxpayers over $500,000, versus spending $35;000 to vote in November. BLANK CHECK The developer has never provided detailed drawings of what will be built or disclos~d specifics of land use. Incredibly, Measure A exempts the development from Carl.sbad s existing general plan, zoning, grading, height and other regulations and prohibits any changes for at least 15 years --even if the development creates unforeseen, costly problems. MAKES MOCKERY OF OPEN SPACE The Agua Hedionda Lagoon provides recreational opportunities th~t are pa~ of Carlsbad's lifestyle. Measure A jeopardizes existing south-shore public recreational beach access rights. Measure A claims to protect open space, but about 90% of.that open space is already permanently protected by Carlsbad voters. IMPROVES TRAFFIC FLOW Yes on Measure A requires the developer to spend $9.4 million on traffic improvements which will improve future traffic flow. Although the standard is still exceeded due to regional traffic growth, overall traffic growth is improved by Measure A. CAL TRANS will complete the 1·5 widening to SR 78 by 2021 which includes the extension of carpool lanes from Encinitas to SR 78. SAFEGUARDS CARLSBAD Measure A complies with all laws and is consistent with or exceeds city, state and federal regulations, including height restrictions and Carlsbad's General Plan and it complies with 10 of 11 Growth Management Plan standards. The plan must be approved by the California Coastal Commission and all building plans must be approved by the City of Carlsbad. REGULATES LAND USE' . Measure A is a Specific Plan, a type of land use plan that has been used dozens of times in Carlsbad, including in Bressi Ranch, Aviara, La Costa and other neighborhoods. DELIVERS OPEN SPACE Measure A will permanently conserve, protect and maintain over 176 acres of newly accessible open space and agricultural lands, including 21 acres of new open space, with all maintenance costs to be covered by the plan in perpetuity, at no cost to taxpayers. The plan also protects agricultural farming for future generations.
