NOTICE OF COMPLETION ACCEPTING THE CONSTRUCTION OF WATER TRANSMISSION MAIN REPLACEMENT IN EL CAMINO REAL FROM PALOMAR AIRPORT ROAD TO FARADAY DRIVE

Adopt Resolution No. 675 accepting the construction of Water Transmission Main Replacement in El Camino Real, 20" & 24" Water Main from Palomar Airport Road to Faraday Drive, authorization to file the Notice of Completion and to release the 10% retention funds.
ITEM EXPLANATION
On August 2, 1989, the District signed a contract with L.H. Woods & Sons, Inc. of Escondido, California for $494,128.50 for the construction of the Water Main Transmission Replacement in El Camino Real, 20" & 24" Water Main from Palomar Airport Road to Faraday Drive.
The project involved construction of a 20" & 24" water main in El Camino Real from Palomar Airport Road to Faraday Drive replacing the existing water main. The contractor, L.H. Woods & Sons, Inc., has completed all work under the terms of their contractual agreement with the District, and the project is now ready for acceptance.
The entire project has been inspected and accepted by the staff and is now ready for formal acceptance by the Board.
FISCAL IMPACT
The 1989-90 budget for this project's construction totaled $612,500. Actual costs are as follows: The total cost of construction for original contract amount, change orders and deduct per contract amounts to $548,507.63. The District holds $54,850.76 as a ten percent (10%) retention due and payable to the contractor thirty-five days following the filing of the Notice of Completion. Ample funds are available for this project.

NOTICE OF COMPLETION
Notice is hereby given that the project known as Water Transmission Main Replacement in El Camino Real, 20" L 24" Water Main from Palomar Airport Road to Faraday Drive contracted with L.H. Woods & Sons, Inc. has been completed in accordance with the plans and has been accepted by the Board of Directors of the Carlsbad Municipal Water District on the F day of , 19m. -

RESOLUTION NO. 675
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT ACCEPTING CONSTRUCTION OF WATER TRANSMISSION MAIN REPLACEMENT IN EL CAMINO REAL FROM PALOMAR AIRPORT ROAD TO FARADAY DRIVE - CMWD PROJECT NO. 85-605
WHEREAS, the Board of Directors of the Carlsbad Municipal
Water District has determined that L. H. Woods t Sons, Inc. has
completed the subject project in accordance with the plans,
specifications and terms of the contract document; and
WHEREAS, the District Engineer has recommended that the
Board of Directors accept the facilities constructed by L. H.
Woods & Sons, Inc., authorize the Secretary to file a "Notice of
Completion", and authorize the General Manager to release the
final retention of $54,850.76.
NOW THEREFORE, BE IT RESOLVED, by the Board of Directors of
the Carlsbad Municipal Water District:

That the above recitations are true and correct.
That the construction of the water main transmission
replacement in El Camino Real from Palomar Airport Road
to Faraday Drive, Project No. 85-605, is hereby deemed
complete and hereby accepted.
That the Secretary is hereby authorized and directed to
record the "Notice of Completion".
That the General Manager is authorized to release the
final retention of $54,850.76, the securities held to
insure faithful performance, to L. H. Woods and Sons,
