NOTICE OF COMPLETION FOR
MTG. 11/08/94 CONSTRUCTION OF PONTO SEWER MAIN
DPT. ENG REAUGNMENT AND EXISTING MANHOLE REPAIRS
Adopt Resolution No. accepting the construction of Ponto Sewer Main Realignment r,6 and Existing Manhole Repairs in the City of Carlsbad, CMWD Project No. 93-403, Contract No. 3432, as complete and directing the Secretary to record a Notice of Completion and release of bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On June 14, 1994, Drainage Construction Co., Inc. was awarded a contract in the amount of $311,592.00 for construction of the Ponto Sewer Main Realignment and Existing Manhole Repairs at the locations shown on the attached Location Map - Exhibit 1.
Drainage Construction Co., Inc. completed the work on September 1, 1994. City forces have inspected said construction and found it to be satisfactory. Staff recommends formal acceptance by Board of Directors of the Carlsbad Municipal Water District.

RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF CARLSBAD, CAUFORNIA ACCEPTING CONSTRUCTION OF PONTO SEWER MAIN REAUGNMENT AND EXISTING MANHOLE REPAIRS PROJECT, CMWD PROJECT NO. 93403, CONTRACT 3432 AS COMPLETE
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined
Drainage Construction Co., Inc., has completed the construction of the Ponto Sewer Main
Realignment and Existing Manhole Repairs in the City of Carlsbad, in accordance with the plans,
specifications and terms of the contract document; and
WHEREAS, the Board of Directors of the Cansbad Municipal Water District have previously
appropriated certain funding for said project: and
WHEREAS, the District Engineer has recommended that the Board of Directors accept
the construction by Drainage Construction Inc. authorize the Secretary to file a “Notice of
Completion’, and authorize the General Manager to release the final retention fund upon passing
the thirty-five (35) day lien period following the filing of the Notice of Completion.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the Ponto Sewer Main Realignment and Existing Manhole
Repairs Project, specifically identified as CMWD Project No. 93-403, Contract No. 3432, is
deemed complete and hereby accepted.
3. That the Secretary, is hereby authorlzed and directed to record the Notice of
Completion.
4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful perfom78nce, Drainage Construction Co., Inc. at the end of the
35 day lien period following the recording of the ‘Notice of Completion’.

5. That the Accountant is hereby authorized a&directed to allow the project account
to remain open utitil such time as all related services and costs are identified and secured.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 8th day of NOVEMBER , 1994 by the following vote, to wit:
