RECOMMENDED ACTION:
Adopt Resolution No. 830 accepting the construction of Roosevelt Street Sewer
Main Repairs between Oak Avenue and Grand Avenue in the City of Carlsbad, CMWD
Project No. 93-401, Contract No. 93-401, as complete and directing the Secretary to
record a Notice of Completion and release of bonds in accordance with State Law and City
Ordinances.
ITEM EXPLANATION:
On December 7, 1993, lnsituform Southwest was awarded a contract in the amount of
$69,815.50 to construct Roosevelt Street Sewer Main Repairs between Oak Avenue and
Grand Avenue.
lnsituform Southwest completed the work on March 11, 1994. City forces have inspected
said construction and found it to be satisfactory. Staff recommends formal acceptance by
the Board of Directors of the Carlsbad Municipal Water District.

RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF CARLSBAD, CALIFORNIA ACCEPTING CONSTRUCTION OF ROOSEVELT STREET SEWER MAIN REPAIRS BETWEEN OAK AVENUE AND GRAND AVENUE CMWD PROJECT NO. 93-401 CONTRACT NO. 3426 AS COMPLETE.
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined
lnsituform Southwest has completed the construction of the Roosevelt Street Sewer Main Repairs
between Oak Avenue and Grand Avenue in the City of Carlsbad, in accordance with the plans,
specifications and terms of the contract document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have previously
appropriated certain funding for said project; and
WHEREAS, the District Engineer has recommended that the Board of Directors accept the
construction by lnsituform Southwest, authorize the Secretary to file a “Notice of Completion”, and
authorize the General Manager to release the final retention fund upon passing the thirty-five (35)
day lien period following the filing of the Notice of Completion.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the Roosevelt Street Sewer Main Repairs between Oak
Avenue and Grand Avenue, specifically identified as CMWD Project No. 93-401 Contract No.
3426, is deemed complete and hereby accepted.
3. That the Secretary, is hereby authorized and directed to record the Notice of
Completion,
4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, to lnsituform Southwest at the end of the 35 day
lien period following the recording of the “Notice of Completion”.
5. That the Accountant is hereby authorized and directed to allow the project account
