A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONSTRUCTION CONTRACT ON THE ALGA ROAD, POINSETTIA
LANE, MELROSE DRIVE RECYCLED WATER TRANSMISSION MAIN
FOR THE ENCINA BASIN WATER RECLAMATION PROGRAM,
WHEREAS, the construction of the Alga Road, Poinsettia Lane, Melrose Drive Recycled
Water Transmission Main for the Encina Basin Water Reclamation Program, Phase II Project,
Project No. 3887-1B has been completed to the Carlsbad Municipal Water District's satisfaction
by Erreca's, Inc. on June 17, 2005; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Alga Road, Poinsettia Lane, and Melrose Drive Recycled Water
Transmission Main for the Encina Basin Water Reclamation Program, Phase II Project,
specifically identified as Project No. 3887-1 B, is deemed complete and is hereby accepted by the
Board of Directors of Carlsbad Municipal Water District of the City of Carlsbad, California.

3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
directed to execute and record the Notice of Completion for the Alga Road, Poinsettia Lane, and

PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal

Water District held on the 21st day of February , 2006 by the following vote, to wit:
