HomeMy WebLinkAbout2015-09-22; City Council; Resolution 2015-235Exhibit 1 1 RESOLUTiON NO. 2015-235 3 2 A RESOLUTION QF THE CITY CQUNCIL QF THE CITY QF CARLSBAD, CALIFORNIA, AUTHORIZING EXECUTION QF THE FIRST AMENDMENT TQ THE BOARD QF STATE & COMMUNITY 4 CORRECTIONS POUCE GRANT FUNDS MEMORANDUM QF AGREEMENT AND ACCEPTING $27,665 FRQM THE CITY QF SAN 5 DIEGO FQR AB109 ENFORCEMENT 6 y WHEREAS, the State of California enacted AB109 in October 2011, a corrections 8 realignment plan, which transfers the responsibility for low-level prison inmates from the state 9 corrections system, to county/local systems; and WHEREAS, in November 2012, California voters approved Proposition 30 which created a constitutional amendment to provide ongoing funding to counties, in order to counteract the risks associated with realigned offenders released locally; and 10 11 12 13 14 WHEREAS, the Board of State and Community Corrections (BSCC) Police Grant Funds 15 Memorandum of Agreement between the County of San Diego, the City of San Diego, and San Diego jurisdictions, was executed on Oct. 15, 2014 to systematically allocate the funds to jurisdictions based on based on a 50/50 allocation by population size and number of probationers, with a primary goal to monitor AB109 realigned offenders released offenders in San Diego County; and 21 WHEREAS, the City of Carlsbad Police Department is one ofthe participating agencies in 22 the agreement; and 23 WHEREAS, the First Amendment to this Agreement will allow the City of San Diego to 24 distribute $1,415,440 received from the State for Fiscal Year 2015-16 to San Diego junsdictions; 25 and 26 2y WHEREAS, Carisbad's share of these funds will be used by the Police Department to 28 conduct additional enforcement activity in the City of Carlsbad. 16 17 18 19 20 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of CaHsbad, California, 2 as follows that: 3 1. The above recitations are true and correct. 4 2. The Interim Chief of Police is authorized to execute the First Amendment to the Board 5 of State and Community Corrections Memorandum of Agreement. 6 7 3. The City of CaHsbad will receive $27,665 from the City of San Diego. These funds will 8 be used by the Police Department to conduct additional enforcement activity with regard to AB109 realigned offenders in the city. 4.
