CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF CT 99-06 PALOMAR FORUM - MELROSE DRIVE (FORUM),
CT 98-10 CARLSBAD RACEWAY - MELROSE DR./FORUM,
AND CT 98-10 CARLSBAD RACEWAY - MELROSE
DR./RACEWAY AS COMPLETE.
WHEREAS, the construction of Palomar Forum - Melrose Drive (Forum) as shown on
Drawing No. 399-4 has been completed to the City's satisfaction by Palomar Forum
Associates, L.P. on July 16, 2008; and
WHEREAS, the construction of Carlsbad Raceway - Melrose Dr./Forum as shown on
Drawing No. 399-4 has been completed to the City's satisfaction by Fenton Raceway, LLC on
July 16, 2008; and
WHEREAS, the construction of Carlsbad Raceway - Melrose Dr./Raceway as shown on
Drawing No. 399-4 has been completed to the City's satisfaction by Fenton Raceway, LLC on
14 July 16, 2008; and
WHEREAS, the formal project Notices of Completion and Acceptances of Public
" Improvements have been prepared; and
17 WHEREAS, all project costs have been established to date.
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
19 California, as follows:
20 1. That the above recitations are true and correct.

2. That Palomar Forum - Melrose Drive (Forum), specifically identified as Project
22
No. CT 99-06, Drawing No. 399-4, Agreement No. SEC04062, is deemed complete and is hereby
23
accepted by the City Council of the City of Carlsbad.

3. That Carlsbad Raceway - Melrose Dr./Forum, specifically identified as Project
25
No. CT 98-10, Drawing No. 399-4, Agreement No. SEC04146 is deemed complete and is hereby
26
accepted by the City Council of the City of Carlsbad.

4. That Carlsbad Raceway - Melrose Dr./Raceway, specifically identified as Project
No. CT 98-10, Drawing No. 399-4, Agreement No. SEC04144 is deemed complete and is hereby
accepted by the City Council of the City of Carlsbad.
5. That the City Manager is authorized and directed to execute the Acceptances of
Public Improvements for CT 99-06 Palomar Forum - Melrose Drive (Forum), Drawing No. 399-4,
6 Agreement No. SEC04062 / CT 98-10 Carlsbad Raceway - Melrose Dr./Forum,
7 Drawing No. 399-4, Agreement No. SEC04146; and CT 98-10 Carlsbad Raceway - Melrose
8 Dr./Raceway, Drawing No. 399-4, Agreement No. SEC04144.
9 6. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
10 execute and record the Notices of Completion for CT 99-06 Palomar Forum - Melrose Drive
(Forum), Drawing No. 399-4, Agreement No. SEC04062 / CT 98-10 Carlsbad Raceway - Melrose
12 Dr./Forum, Drawing No. 399-4, Agreement No. SEC04146; and CT 98-10 Carlsbad Raceway -
13 Melrose Dr./Raceway, Drawing No. 399-4, Agreement No. SEC04144.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 20^ day of October. 2009, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
