A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
3 MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONTRACT FOR CONSTRUCTION OF THE EL CAMINO REAL 24-
4 INCH TRANSMISSION MAIN, FLOW CONTROL STATION,
WIDENING NORTH OF COUGAR DRIVE, AND MEDIAN
5 IMPROVEMENTS, PROJECT NOS. 3843, 3920, & 3920-A AS
COMPLETE.

WHEREAS, the construction of the El Camino Real 24-inch Transmission Main, Flow
Control Station, Widening North of Cougar Drive, and Median Improvements, Project Nos. 3843,
6 3920, & 3920-A, has been completed to the Board's satisfaction by TC Construction Company,
9 Inc. on March 3, 2010; and
10 WHEREAS, the formal project Notice of Completion has been prepared; and
11 WHEREAS, all project costs have been established to date.
12 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:

1. That the above recitations are true and correct.14
2. That the El Camino Real 24-inch Transmission Main, Flow Control Station,

Widening North of Cougar Drive, and Median Improvements, specifically identified as Project Nos.

3843, 3920, & 3920-A is deemed complete and is hereby accepted by the Board of the Carlsbad
17
Municipal Water District of the City of Carlsbad.

3. That the Secretary of the Board is hereby authorized and directed to execute and
19
record the Notice of Completion for the El Camino Real 24-inch Transmission Main, Flow Control
20
Station, Widening North of Cougar Drive, and Median Improvements, Project Nos. 3843, 3920, &
21 3920-A.

PASSED, APPROVED AND ADOPTED at a Joint Special Meeting of the
Carlsbad Municipal Water District Board of Directors and the Carlsbad City Council,
held on the 23rd day of March, 2010, by the following vote:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
