Description/Explanation:
Sa11 Diego County Water Authority with Poseidon Resources are seeking to revise a portion of the
Carlsbad Seawater Desalination Project's pipeline alignment to an approved pipeline alternative
alignment located in the City of Carlsbad, within the Maca rio Canyon area. Approximately 2,300 feet of
54" diameter pipeline located along Cannon Road and Faraday Park around Macario Canyon will be
relocated and tunneled from Calilnon Road to Faraday Park under Macario Canyon. The pipeline
alignment modification involves approximately 1,800 feet of trench less pipe installation and. shifts the
location of the pipeline in this area approximately 600 to 800 feet to the south. The project will consist
of 54 inch pipeline in a 108 inch horseshoe shaped tunnel from a construction pit located on Cannon
Road down a 12% slope approximately 860 feet in the Santiago Sandstone Formation. A second a
construction pit located east of Faraday Road will be used to tunnel in the opposite direction 940 feet
through the alluvial material using either a tunnel shield or tunnel boring machine (TBM). The tunneled
pipeline will be constructed at a depth ranging from 20 to 80 feet. ·In addition, to allow for.
maintenance, an approximately 12' x 12' by 2-3' high pumping w~ll cover will be installed at the pit
located just east of Faraday Road and an access road from Faraday Avenue to the pump well cover (see
attached maps).

To address post-development pollutants that may be generated from development projects, the City requires that new
development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management
Practices (BMP's) into the project design per the City's Standard Urban Stormwater Management Plan (SUSMP). To
view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carlsbadca.gov/standards.
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application
(subdivision, discretionary permits and/or construction permits). The results of the questionnaire determine the level of
storm water standards that must be applied to a proposed development or redevelopment project. Depending on the
outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject to additional criteria
called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the
storm water standards applied to a project.
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts.
City staff has responsibility for making the final assessment after submission of the development application. If staff
determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than
initially assessed by you, this will result in the return of the development application as incomplete. In this case, please
make the changes to the questionnaire and resubmit to the City.
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the
questions, please seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new development application submission.
Only one completed and signed questionnaire is required when multiple development applications for the same project
are submitted concurrently. In addition to this questionnaire, you must also complete, sign and submit a Project Threat
Assessment Form with construction permits for the project.
Please start by completing Section 1 and follow the instructions. When completed, sign the form at the end and submit
this with your application to the city.
Examples: single family homes, multi-family homes,
Automotive repair shop. A facility categorized in any one of Standard Industrial Classification (SIC) codes 5013,
5014, 5541, 7532-7534, and 7536-7539

Hillside development. Any development that creates more than 5,000 square feet of impervious surface and is , located in an area with known erosive soil conditions, where the development will grade on any natural slope that is

areas that require routine use of fertilizers and pesticides. In most cases linear pathway projects that are for infrequent vehicle use, such as emergency or maintenance
access, or for pedestrian or bicycle use, are not considered Pollutant-generating Development Projects if they are built with pervious surfaces or if they sheet flow to
surrounding pervious surfaces.

Time limits on the processing of discretionary projects established by state law do not start until a
project application is deemed complete by the City. The City has 30 calendar days from the date of
application submittal to determine whether an application is complete or incomplete. Within 30 days of
submittal of this application you will receive a letter stating whether this application is. complete or
incomplete. If it is incomplete, the letter will state what is neeljled to make this application complete.
When the application is complete, the processing period will start upon the date of the completion letter.

The authorization for the General Manager, with the concurrence of the General Counsel, "to do any and all
things and to execute and any and all documents" necessary or advisable on behalf of the Water Authority is
granted in paragraph 23 of Resolution No. 2012-18 adopted by the Water Authority Board of Directors on
November 29, 2012. That paragraph reads in full:
"The Authorized Officers are hereby authorized and directed, jointly and severally, with the concurrence of
the General Counsel, to do any and all things and to execute and deliver any and all contracts and documents
which they may deem necessary or advisable in order to consummate the transactions contemplated or
authorized by this resolution. The authority of the Authorized Officers and the General Counsel under this
resolution may be delegated as provided in the Water Authority's Administrative Code."
Resolution No. 2012-18, made all required CEQA findings and approved all contracts required of the Water
Authority for the desalination project, including the Design Build Agreement for the Product Water Pipeline.
On September 26, 2013, the Water Authority board of directors adopted Resolution No. 2013-22 that approved
the addendum to the project EIR and authorized the General Manager to execute amendments to the Design
Build Agreement for pipeline realignment in Marcario Canyon.

4. A mitigation reporting or monitoring plan was adopted for this project.
5. A statement of Overriding Considerations was adopted for this project.
6. Findings were made pursuant to the provisions of CEQA and CEQA Guideline 15091.

This early public notice is to let you know that a development application for a an Addendum to a
previously adopted Environmental Impact Report and an Amendment to a previously approved Coastal
Development Permit for the Desalination project within your neighborhood has been submitted to the
City of Carlsbad on September 5, 2013. The project application is undergoing its initial review by the
City.
LOCATION: Generally located within a portion of Macario Canyon, Veteran's Memorial park and right-of-
way of Faraday Avenue.
PROJECT DESCRIPTION: To realign and install approximately 1,000 lineal feet of a previously approved
underground pipeline and install a vault to convey desalinated water.
Please keep in mind that this is an early public notice and that the project design could change as a
result of further staff and public review. A future public hearing notice will be mailed to you when this
project is scheduled for public hearing before the Planning Commission.

The Parks and Recreation Department has prepared this comment letter with the purpose of our
review and comments to be forwarded as conditions of the project and as a way to provide
further direction and comments on the construction plans. Please include the following with the
responses you are preparing to Poseidon 1 for SDCWNPeter Mclaggan.
Drawing No. SD-22: Fencing and gate on north side of Faraday Ave. at Veteran's Park
1. Please include in construction peeler pole fencing along the park boundary on the north
side of Faraday Ave. Fencing shall match the existing fencing along Faraday Ave. park
boundary further east. A detail of the fence installation is provided on MWD Drawing
PD-2 to include on sheet SD-22 and is attached to sheet SD-22 of the Parks and
Recreation plan review set of drawings.
Extent of fencing to begin at Whitman Way and continue eastward to connect to the
existing fence at the trailhead is also shown on Sheet C-301, Site Plan mark up.
2. Revise details to include the gate access at Veteran's Park to be a wood peeler pole
gate per MWD Drawing No. PD-2. A copy of the detail is attached to this memo for
reference and to sheet SD-22 of the Parks and Recreation plan review set of drawings.
3. Preference is for 6" protection posts to be 6" diameter wood posts with beveled top to
match the peeler pole posts used for post n-rail fencing along Faraday Ave.
4. Add a detail to show a 6' high wood screen fence around the concrete pad where the
tunnel pit access is located within the park.

Additonal landscape improvements at tunnel pit at Veteran's Park
1. See mark up and notes on review plan set of drawings, regarding addition of screening
fence, landscaping and irrigation around the tunnel pit that is to be located within the
park. Add the requested landscape items on the site plan or provide an additional
landscape plan sheet to show the requested landscape improvements at the tunnel pit at
Veteran's park. The added landscape items/plan sheets shall be subject to submittal by

Note: There is no water meter currently servicing the park site. Therefore, Poseidon

Condition Request:
Poseidon is to be responsible for installing all mainline, water meter, and irrigation
system to support the landscaping as well as the screening fence to screen the pad and
above ground equipment at the tunnel pit. In addition Poiseidon is to be responsible for
the ongoing water expenses and the ongoing maintenance for the
irrigation/landscape/screening fence.

1. Revise steel protection post to be 6" diameter treated wood post to match posts used for
the peeler pole fence along park boundary.
Drawing No. TC 302:Traffic Control Plan, Stage 26
It appears that during construction that on street parking at the Veteran's Park trailhead
may not be available to the public. If parking will not be available on Faraday Ave. at the
north side of the street adjacent to the park due to construction, please provide the traffic
control plans and signage to that effect so the general public will be aware that the trail
head access parking is not available. If it is possible to keep the on street parking
available to the public at the trailhead, then add safe traffic control that will allow for
access to on-street parking at the Veteran's Park trailhead.

The preliminary staff report for the above referenced project will be sent to you via email on Wednesday,
October 23, 2013. This preliminary report will be discussed by staff at the Development Coordinating
Committee (DCC) meeting which will be held on October 28, 2013. A twenty (20) minute appointment has been
set aside for you at 9:30 a.m. If you have any questions concerning your project you should attend the DCC
meeting.
It is necessary that you bring the following required information with you to this meeting or provide it to your
planner prior to the meeting in order for your project to go forward to the Planning Commission:
1. Unmounted colored exhibit(s) of your site plan and elevations. For residential projects of 2 or more
homes a typical street scene of the elevations shall be provided. The corresponding rear elevations
for the homes shown for the typical street scene shall also be provided; and
2. A PDF of your colored site plan and elevations.
The colored exhibits must be submitted at this time to ensure review by the Planning Commission at their
briefings. If the colored exhibits are not available for their review, your project could be rescheduled to a later
time. The PDF of your colored site plan and elevations will be used in the presentation to the Planning
Commission and the public at the Planning Commission Hearing. If you do not plan to attend this meeting,
please make arrangements to have your colored exhibit(s) and the PDF here by the scheduled time above.
Should you wish to use visual materials in your presentation to the Planning Commission, they should be
submitted to the Planning Division no later than 12:00 p.m. on the day of a Regular Planning Commission
Meeting. Digital materials will be placed on a computer in Council Chambers for public presentations. Please
label all materials with the agenda item number you are representing. Items submitted for viewing, including
presentations/digital materials, will be included in the time limit maximum for speakers. All materials exhibited
to the Planning Commission during the meeting (slides, maps, photos, etc.) are part of the public record and
must be kept by the Planning Division for at least 60 days after final action on the matter. Your materials will be
returned upon written request.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Division has reviewed
your Environmental Impact Report Addendum and Coastal Development Permit Amendment,
application nos. EIR 03-05(B) and COP 04-41(A), as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which
must be submitted to complete your application. The second list is project issues of concern to staff. In
order to expedite the processing of your application, the "incomplete" items and your response to the
project issues of concern to Staff must be submitted directly to your staff planner; therefore, please
contact your staff planner directly to schedule a re-submittal appointment. As part of your re-submittal
package, please prepare and include with your re-submittal: (1) a copy of these lists, (2) a detailed letter
summarizing how all identified incomplete items and/or project issues have been addressed; and (3) five
(5) sets of revised plans. No processing of your application can occur until the application is determined
to be complete.
When all required materials are submitted, the City has 30 days to make a determination of
completeness. If the application is determined to be complete, processing for a decision on the
application will be initiated. In addition, please note that you have six months from the date the
application was initially filed, September 5, 2013, to either resubmit the application or submit the
required information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the application. If an
application is withdrawn or deemed withdrawn, a new application must be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Planning:
1. Depict the location of all existing major vegetation, showing size and type, within the project
area on Sheet C-301.
2. Provide documentation from the San Diego County Water Authority (SDCWA) stating that Frank
Belock has the authority to sign the application on behalf of the SDCWA.
3. Indicate the existing and proposed grade and structural elevations in relation to Mean Sea Level
(MSL) on Sheets C-455 and C-456.
4. Include elevations of all above grade structures as shown from the north, south, east and west
on Sheet C-453.
5. Show the entire construction area, including all staging of equipment and storage of materials
on Sheet C-301.
6. Highlight the areas that will have cut and fill grading (use different symbols for cut and fill) and
list cut, fill, import and/or export quantities on Sheet C-302.
7. Include the dimensions and square footage of each structure shown on Sheets C-302, C-455 and
C-456.
8. Provide a separate landscape plan and show plant species, quantity of each plant species and
their size (both size at planting and maturity) in a legend. Landscaping needs to be adequate to
screen the above grade structures. Furthermore, include all temporary impact areas that will
need to be hydro-seeded after construction is completed.
9. Only the pipe and ancillary facilities located from approximately station 109 (see plan sheet #C-
301) east to the pumping vault are within the city's coastal permit jurisdiction and included in
this CDP. The remaining pipeline is either within the California Coastal Commission's original
jurisdiction or has previously been approved. Please differentiate the project components within
the two jurisdictions and the project components that have previously been approved, using
different shades of gray and include a legend.

ISSUES OF CONCERN
Planning:
10. Submit a color rendering of the above grade structures and proposed vegetation as viewed from
Faraday Avenue looking east.
11. Include on all sheets the application numbers in the upper right corner {EIR 03-05(B) I CDP 04-
41(A)) and the project name (Desalination Project Changes).
12. Under general notes, drawing G-1, please add:
Before construction begins, a qualified biologist shall survey the construction route to
determine locations of habitat adjacent to pipeline construction and then mark these locations
with clearly visible orange construction fencing and signs, or other measures the biologist
determines appropriate, so that the habitat is protected from any encroachment or damage.
Further, the biologist shall monitor construction and coordinate with the contractor as
necessary to ensure compliance with the applicable requirements identified in mitigation
measure BI0-3, which are repeated in item "c)" of the Biological Resources section of the
Environmental Mitigation Measures in these plans.
Contractor shall avoid construction during the gnatcatcher breeding season or maintain noise
levels below 60 dBA leq at occupied nest locations if construction takes place during the
breeding season (i.e., February 15 through August 15). The maintenance of appropriate noise
levels shall be confirmed through protocol gnatcatcher surveys by a qualified biologist to
determine presence of all gnatcatchers within 500 feet of project construction and noise
measurements at nest locations during peak construction activity by a qualified acoustician.
13. Other items required and applicable to this project are noted on the redline drawings previously
distributed to you. Please return the redline drawings with your next submittal.
Parks and Recreation:
14. The traffic control plan should clearly show that on street parking for the public will be
maintaine.d at the trail head during construction of the pump station and ancillary structures.
Please indicate on the traffic control plan if pedestrians will have access to the trail head via the
sidewalk.
15. Revise steel protection post shown on Sheet C-455 to be 6-inch diameter treated wood post to
match posts used for the peeler pole fence located at the trail head.
16. Please include on Sheet SD-22 a peeler pole fence along Veteran's Memorial park boundary on
the north side of Faraday Ave. The fence shall match the existing fence that exists at the trail
head at Veteran's Memorial park. The fence shall begin at Whitman Way and continue
eastward to connect to the existing fence at the trailhead. A detail of the fence installation is
attached to the redline plan review the Parks and Recreation Department completed, which you
received on September 25, 2013. Furthermore, the requested location of fencing is also shown
on Sheet C-301 of the red line plans. Show entire length of fence on Sheet C-301.
