Dear Mr. & Mrs. Shores:
The Planning Director has completed a review of your application for an Administrative
Variance at 5305 Carlsbad Boulevard (APN: 210-120-27). After careful consideration of
the circumstances surrounding this request, the Planning Director has determined that the
four findings required for granting an Administrative Variance can be made and, therefore,
approves this request based on the following findings.

Findinns:
1. There are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or
class of use in the same vicinity and zone because the structures on the lot are
existing buildings setback a significant distance from a bluff top providing
environmental benefits. The requested setback variance applies to a proposed
interior property line separating the two parcels being created. The lot is
substantially larger in size than the surrounding neighborhood. There is ample lot
area to subdivide the parcel per the R-1 Zoning Ordinance. Other lots in the area
average 6,500 sq. ft. whereas the proposed minor subdivision will have lot sizes of
8,000 and over 32,000 sq. ft.
2. The requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone
but which is denied to the property in question because the existing lot sizes in the
vicinity are significantly smaller in area than the existing parcel and there is ample
area to subdivide the property into additional lots while complying with the
required minimum lot size. The surrounding properties have been subdivided into
lot sizes with an average of 6,500 sq. ft. The standard lot size for the R-1 zone is
7,500 sq. ft. The existing garage would have to be relocated to provide the required
20 foot front yard setback on the panhandle lot. Relocating the garage to another
part of the lot could reduce a view corridor to the ocean from Carlsbad Boulevard.

3. The granting of this variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in the vicinity and zone in which the
property is located because the reduced front yard is on a proposed panhandle lot.
The reduction is behind the lot that has street frontage and will not be noticeable
from the street. The ten foot front yard proposed will allow adequate structure
separation.
4. The granting of this variance will not adversely affect the comprehensive General
Plan because the proposed minor subdivision will conform to the General Plan
density of RLM (0-4 units per acre). The reduced front yard of ten feet will provide
the minimum building separation required for structures.
You have the right to appeal this decision to the Planning Commission within ten days of
receipt of this letter. Appeals must be submitted in writing to the Planning Commission
at 2075 Las Palmas Drive in Carlsbad, along with a payment of $110.00. The filing of
such appeal within such time limit shall stay the effective date of the order of the Planning
Director until such time as a final decision on the appeal is reached. If you have any
