Thomas 6125 Cornerstone Ct., #200 San Diego, CA 92121 - SUBJEC": PIP 89-10(A) - WBAD OAKS PREMIER BUSbESS PROPERTLES The City has completed a review of the application for a Planned Industrial Permit for development located at 2777 Loker Avenue West. It is the Planning Directois determination that the project is consistent with the City's Planned Industrial Zone regulations (Chapter 21.34) and with all other applicable City ordinances and policies. The Planning Director, therefore, recommends APPROVAL of this request based on the following: 1. The site indicated by the Planned Industrial Permit is adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required by this chapter. 2. The improvements indicated on the Planned Industrial Permit are located in such a manner to be related to existing and proposed streets and highways. 3. The improvements as shown on the Planned Industrial Permit are consistent with the intent and purpose of this zone and all adopted development, design, and performaace standards as set forth in this chapter. Conditions: 1. Approval is granted for PIP 89-10(A) as shown on Exhibits "A", dated July 15,1991, on file in the Planning Department and incorporated herein by reference. PIP 89-10(A) is subject to all conditions of PIP 89-10, dated November 6, 1989, incorporated herein by reference and on file in the Planning Department, except Condition No. 15 which is replaced by Condition No. 10. All uses established in this structure shall be consistent with Section 21.34.020 (Permitted Uses). AU roof appurtenances shall be shielded from view and architecturally integrated with the building design. Unless otherwise stated, this industrial project shall comply with all applicable City ordinances and requirements. The developer shall provide the City with a reproducible 24" x 36" mylar copy of the site plan as approved by the Planning Director. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer prior to building, grading, or improvement plan submittal, whichever occurs first. The mezzanine addition and tenant improvement creates a demand for 21 parking spaces in addition to the site's &sting 232 parking spaces. These additional spaces are located at the south portion of the lot, as shown on Exhibit "A". Any change in the size or location of these spaces will require an amendment to this permit. The two "dock-high" bays located directly north of the proposed parking must contain permanent walls entirely enclosing each of the two bay doors as shown on Exhibit "A". No utilization of these bays may occur and any full or partial removal of these walls would violate this permit regardless of any change in tenants. A uniform sign program for this development shall be submitted to the Planning Director for his review and approval prior to occupancy of any building. Prior to issuance of tenant improvements and/or business licenses for interior building-space within this project whichever comes first, the proportion of office, manufacturing, and warehouse uses for each building must conform to the approved proportion of use listed in Exhibit "A", so as to not increase parking demand according to City codes. .... Ware & Malcomb Architects July 15, 1991 Pane 3 11. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. 12. Prior to the issuance of the Certificate of Occupancy there shall be a deed restriction placed on the deed to this property subject to the satisfaction of the Planing Director notifying all interested parties and successors in interest that the City of Carlsbad has issued a Planned Industrial Permit PIP 89-10 and Planned Industrial Permit Amendment PIP 89-10(A) on the real property owned by the declarant. Said deed restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the deed restriction. Said deed restriction(s) may be modified or terminated only with the approval of the Planning Director, Planning Commission or City Council of the City of Carlsbad whichever has final decision authority for this project. h Ennineerinn Conditions: 13. 14. 15. Pretreatment of the sanitary sewer discharge from this project may be required. Jn addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste water discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge permit application requirements have been met, all applicable fees paid and permit issued. ~t the time of building permit the developer shall pay a park-in-lieu fee of $.40 per square feet. This project is located in Zone 5 Local Facilities Management Plan. Recent traffic monitoring has revealed that Palomar Airport Road from El Camino Real to the eastern City limit falls below the adopted performance standard. Therefore, prior to the issuance of a building permit, the owner shall participate in the guarantee of a proportional share of the cost of improving this segment of Palomar Airport Road. Fire Conditions: 16. Prior to issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Ware & Malcomb Architects July 15, 1991 Pane 4 17. plans and/or specifications for fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction 18. Buildings having an aggregate floor area exceeding 10,OOO square feet shall be protected by an automatic sprinkler system.
