To view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carisbadca.Qov/standards. Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary permits and/or construction permits). The results of the questionnaire detennine the level of storm water standards that must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject to additional criteria called 'Priority Development Praject Requirements'. Many aspects of project site design are dependent upon the storm water standards applied to a project Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility fbr making the final assessment after submission of the development application. If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than initially assessed by you, this will result In the retum ofthe development application as incomplete. In Ihis case, please make the changes to the questionnaire and resubmit to the City. If you are unsure about the meaning of a questton or need help in determining how to respond to one or more of the questions, please seek assistance from Land Development Engineering staff. Dear Tim Henion, The Planning Director has completed a review of your application for a Minor Conditional Use Permit Extension MCUP 07-14x1 - T-MOBILE WESELOH CHEVROLET HUMMER to allow the continued operation and maintenance of an existing Wireless Communication Facility at 5335 Paseo Del Norte. A notice was sent to property owners within a 300' radius of the subject property requesting comments regarding the above request. No comments were received within the ten day notice period (ending on October 27, 2011). After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting a Minor Conditional Use Permit Extension can be made and therefore, APPROVES this request based on the following findings and conditions. Findings; 1. All of the findings contained in the Planning Director's decision letter, dated December 28, 2007 for MCUP 07-14, apply for this extension and are incorporated therein by reference and remain in effect. 2. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 3. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301 - (Existing Facilities), of the state CEQA Guidelines. Additionally, as T-Mobile must comply with FCC regulations, radio frequency emissions from the proposed facility are below levels established as acceptable by the FCC, and are therefore not considered a health hazard. The WCF shall be required to be redesigned so that it is integrated with and complements the design of the existing building by adding architectural elements to fully conceal the antennas and equipment cabinets. A redesign of the site shall be submitted at least 90 days prior to the expiration date. Engineering; 4. Developer shall comply with the City's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution treatment practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable. Developer shall notify prospective owners and tenants ofthe above requirements. Developer shall comply with the City's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution treatment practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable.
