Met with Eric Siegel and Georges Henri-Fourtier to discuss Four
Seasons Catering Permit. I advised them that the facility was
being operated in violation of the Redevelopment Permit. I
delivered to them a copy of the letter outlining the conditions
(this was also mailed to them on June 20, 1989). I recommended
that the premises should be brought into operational compliance
immediately. Both indicated that steps would be taken to correct
any violations. I later discussed this meeting with the
Assistant City Attorney.

George hadn't called him to discuss this and Chris replied that
George had not as yet. Chris went onto mention that both the
mayor and councilwoman - Anne Kulchin had voiced concern to him
over this issue but that he had been to busy to address it.

immediate attention in this matter is requested.

Dear Chris;
As you know we have closed the Eatery since December and
have been actively pursuing potential tenants to occupy
this space. Three factors are primary in determining a
lessee:
a. Compliance to operating conditions
b. Quality operator that fits in to our image
c. Ability of operator to profit and prosper in this location
Mr. Georges - Henri Fortier, owner of Four Seasons Catering,
is interested in leasing this location. His operation is, in
my opinion, a very good fit to the above criteria. His
principle source of business will be the operation of the
location as support for his off-site catering business. Ad-
ditionally his concept fits in well with the other operations
and decor of the Inn.
We look forward to his Deli providing much needed support for
our internal needs. In reviewing the conditions, Mr. Fortier
has no issue with any, except for possible reconsideration of
the restriction to "on" sale beer and wine.
As a catering kitchen and deli/market (geared to take out and
off-site as was the Eatery), Mr. Fortier would like to be able
to allow on-site consumption of beer and wine. He is not, as
we were not, proposing a bar. We leave that to Fidels. He
is also not requesting longer hours: 11-7 pm non-summer,
11 am - 9 pm summer. We view the beer and wine as simply an
amenity for casual consumers - typically walk by traffic, con-
sumed on the open patio.
Both Mr. Fortier and I would appreciate your help in obtaining
release from this condition. I believe Mr. Fortier will pro-
vide a quality operation that both I and the City of Carlsbad
can be proud of.

Dear Chris:
This letter is a follow-up on the request for a marked walkway
across Ocean Ave., mid block between Elm and Oak.
This is a highly congested crossing area due to the public beach
access way. Presently due to high pedestrian use and limited
visibility by motorists because of curb parking, a safety
problem is prevalent.
Thank you for your immediate attention to this problem. It is
our recommendation that a cross-walk be put in on Ocean Ave,
half-way between Elm and Oak as soon as possible.

SUBJECT: RETAIL GAZEBO AT CARLSBAD INN, RP 84-3,
LOCATED AT 3001 CARLSBAD BOULEVARD.
At the Design Review Board meeting of December 6, 1986, staff
was directed to prepare a report on the retail gazebo at the
Carlsbad Inn. RP 84-3, THE CARLSBAD INN, was approved by
Housing and Redevelopment Commission Resolution No. 03 3 on
April 17, 1984. That approval requires development to occur
substantially as shown on the exhibits. Review of the
exhibits, dated February 27, 1984 and March 13, 1984, fails
to show any such retail gazebo.
The City first became aware of the gazebo from a landscape
plan dated July 2, 1984. The plan indicates the gazebo would
have six (6) three foot long benches installed in the
interior. The architecture of the gazebo was described by
Mr. James Watkins, President, Winner's Circle International,
at a meeting of the Design Review Board on November 14, 1984.
At that time no mention was made of any use beyond small
social functions.
On December 17, 1986, a business license application for
"Suzanne's", a flower and gift shop operated by Susan and Tom
Schumaker, was denied by the City of Carlsbad due to
incorrect information. The application stated operation
would be from the lobby of the hotel, while in fact it was
from the gazebo. In either case, an amendment to the
existing redevelopment permit would be required.
The Carlsbad Inn is a multi-use project divided into four
physically distinct parts; hotel, condominiums, restaurant,
and retail. The landscape architecture is not only an
aesthetic amenity that beautifies the project, but it also
helps to define it. The gazebo is part of the landscape
architecture and to abandon it to a retail use would, in
staff's opinion, diminish the project.
The original plan was well conceived by the applicant and
well received by the City. Attempts to modify the overall
concept since then have not met with similar success due to
the initial design's maximum intensification of uses. The
City's position has been that there is not room on site for
expansion or intensification beyond what has already been
approved. A retail use in either the hotel or gazebo would
require additional parking. This use belongs in the retail
building. It is not in keeping with the scale or intensity
of development of the original approval if allowed in any
other area.

Attached please find the plan to convert the Grunion's Run
Restaurant in the Carlsbad Inn to a Retail Bakery in
compliance with the option in your letter of Jan. 29, 1986.
We are saddened that we have been unable to find a solution
to the parking requirement because we believe the Grunion's
Run was a viable asset to the resort and the community.
However, we are extremely pleased to have such a fine local
baker and businessman as Peder Norby to establish an
authentic retail Danish Bakery which will fit so well into
the Carlsbad Inn theme of "European Elegance on the
California Coast".
The misunderstanding on the original Grunion's Run proposal
and the tremendous loss of time and funds as a result of
that miscommunication has been unfortunate. Our intent has
always been to have the Carlsbad Inn represent the epitome of
the goals and concepts set forth in the community's Village
Design Manual, as our desire has always been to contribute
and be a part of the Carlsbad Community.
In order to accomplish the conversion as quickly as possible
to satisfy the Commission's requirements, we therefore
request your approval at the earliest possible date.

Thank you for your efforts on this matter. We believe it is in
the best interests of all concerned to resolve the parking issue
as directed by the City Council in Resolution 060 as soon as
possible.
The staff's preliminary thoughts on a possible Garfield Street
parking district are excellent and would seem to offer the most
logical and viable solution. Additionally, the surplus parking
to be created over and above that required by Resolution 060
would be of significant benefit to the community.
To accomplish the above in an expedient manner, please accept
this letter as our commitment to pay for the estimated $50,000 to
$60,000 in improvement cost for the entire area. Additionally,
we would agree to enter into an agreement with the city to
participate in a parking district for our proportionate share of
the area so created.

The council approved in concept your request for the Grunion's Run
Restaurant, subject to the following conditions:
1. you must acquire 23 additional parking places within a reasonable
distance from the project.
2. You must sign an agreement stipulating that no permtts will be
issued on the retnatning time-share units until additional parking
has been acquired.
3. On-site parking set aside for the future time-share units must be
made available for the Grunion's Run Restaurant.
4. If the additional parking cannot be acquired, you must either convert
the restaurant to retail space or reduce the number of future time-
share units.
The Council did not authorize the use of the Grunion's Run Restaurant
until a resolution and an agreement, including all of the aforementioned
conditions, are approved by the City Council, at which time a one-year
Conditional Use Permit will be granted.

As per our conversation on Monday, February 3, I am in accord with
the conditions set forth by the staff and Redevelopment
Commission and will sign the appropriate documents when finalized
by the city attorney. The item will be placed on the agenda for
February 18, 1986. Should the documents not be ready prior to my
departure for New York on February 5, I will sign them when I
return February 12.
Until subject agreement on the Grunion's Run is ratified by the
Council on February 18, the Grunion's Run shall operate only as a
retail facility with furnishings, Koi, art, and bakery products.
Assuming all other items are complete, the occupany permit will
be issued for the building without the stairs off the trellis
area which is being re-submitted for your consideration. As
previously agreed, we agree that the upper room for which the
stairway is required will not be open to the public until such
time as the stairway is approved and completed.
Hopefully this covers the loose ends,
in this matter.

Dear Mr. Salomone:
Your very busy schedule has prevented my talking
to you - although Bibi has been most helpful in trying
to get us together. Therefore, I thought it best to
write you of our concerns on the recent decision by
the Council to reverse your denial of the Carlsbad
Inn/Grunion»s Rim project.
As we own the property at 3065 Ocean Street we
have been concerned with the parking limitations in
the area for a long time. To that end I appeared be-
fore the Planning Commission and your office when the
permit for Mr. Watkin's development was first granted.
At the time it was obvious to us that the parking and
traffic problems so generated by large-scale develop-
ments in that part of the beach area were going to be
severe•
Since then our plans to remodel our own building
have had to be put on hold because of the Zone Overlay
Ordinance passed last summer. We are caught in the maze
of speculation about what the City intends to do and
^hen they intend to do it. We have talked to Mike Holz-
millar and members of the City Council who say that they
are going to hire a consultant to recommend a solution -
a study which will take at least 6 months to complete.
As of now I see no indication that such a person has been
hired or a study begun.
In our talks with Don Agatep he has suggested that
we contact you about our dilemma as our idea of creating
a parking district/lot in the general vicinity of Garfield
between Elm and Grand falls within your jiurisdiction.
Kindly advise how we can proceed and when we can get
together on the phone to discuss the problem further.

It is obvious, based upon our recent conversation and a physical
inspection of the property, that the intended use of the first and
second floors, that portion of the building facing Carlsbad Blvd.,
is for a full bar and restaurant.
Please note that discretionary approval for your project was based
upon conditions relating to:
1. 132 Time-Share Condominiums
2. 66-Unit Hotel
3. An existing 4,900 square-foot restaurant, "Fidel's"
4. 10,300 square feet of retail stores
A bar and/or restaurant is not permitted.
Should you desire to include a bar and restaurant at this location,
you must obtain a Major Redevelopment Permit and a Conditional Use
Permit for the sale of alcoholic beverages.
Until appropriate discretionary approval is granted (Design Review Board
and Housing and Redevelopment Commission), you are specifically not
permitted to:
1. Sell alcoholic beverages in the building or patio area, and
2. Provide food service within the building or patio area.
You may provide hotel room service or the sale of pies and bakery goods.
Individual sales of non-alcoholic beverages is permitted provided no
restaurant is created. The two service windows ( to the bar and kitchen
areas) must be closed and designed so that no food or beverage service
may occur through the windows.

As stated, we have been somewhat frustrated by the progress of the
City on the proposed Elm Avenue/Carlsbad Boulevard improvements
and thus I had prepared the attached letter to go before the City
Council.
We feel we have provided the City with a very quality product and
have lived up to all our representations. As you know, we had
hoped the City would have completed the landscaped median and
other public improvements appropriate for the area upon our
opening. We had also hoped that our beach club and tennis club
proposals would have been approved by this time as it has been
over a year.

to what course we can take.

I know how very busy you are and thus I don't like to impose on
your time. However, there are a few items of importance to the
Carlsbad Inn that seem to have come to a halt. I really would
appreciate your advice and guidance on what to do.
(1) First is the median on Carlsbad Boulevard and proposed
improvements of the Elm Street interchange. (See enclosed letter
proposed to City Council.)
(2) Second is the proposed beach club. We feel the beach
club and above improvements will be as beneficial to the entire
community as to the Inn. (See separate enclosed letter.)
(3) The final item is a request. I am sure you are aware
we had hoped to open the entire resort in May but due to delays
it now appears it will be late September to coincide with the
Scripps Hospital benefit we are hosting. The hotel, however,
will be completed with the exception of the elevator and possibly
some offsite improvements. We, of course, have posted a bond to
assure completion of all offsite improvements. I am sure you can
appreciate how important the July 4th weekend is to us. There
simply will not be enough rooms in the area to accommodate the
demand. We would therefore like to request a meeting onsite
July 2nd to hopefully secure an occupancy permit for the first
and second floors commencing July 3rd. I know this may be an
imposition but it would truly be appreciated if there is anyway
possible you could help and fit it into your schedule.

As discussed in 1984, the beach club element is very important to
the Carlsbad Inn Beach and Tennis Resort. We feel it is also
very important to the city to provide a well-maintained and
orderly means for our several hundred guests to enjoy the beach
with minimum impact on the community beaches.
Last year when we met with the head of each city department,
everyone concurred with the desirability of the facility and we
had hoped it could be completed with the Inn. We submitted the
requested Land Use Planning Application on March 5, 1985 together
with requested documentation.
Several months ago we were requested to send letters to the
adjacent property owners to see if they had any objections.
Since none of us have heard any objections I feel it is only
fair that we should be allowed to proceed. Since considerable
time has been lost, I would like to respectfully request that it
be placed before the city council at the earliest possible date
in order that we may complete the project in a timely manner for
the benefit of our guests and the community.
I would appreciate any advice on how to best proceed.

Dear Mayor Casler and City Council:
As the Carlsbad Inn nears completion, we hope you will agree that
the resort is of the quality represented. We thank you for your
enthusiastic and unanimous support which made it possible.
To date we have paid over $700,000 in fees and once in operation
would expect to even further enhance the city's coffers.
However, even more important, we look forward to becoming a part
of the Village and hope the entire community will enjoy the
Carlsbad Inn's promenades, patios, outdoor cafe's, courtyard,
plazas, gardens and many services. We hope the Inn will be a
part of the Village in which the citizens can meet friends and
enjoy the ambiance of their coast and unique village.
One element that divides the Village and detracts from the full
enjoyment of the Village character is Highway 101. As such, we
respectfully request the city give a high priority to
improvements of Highway 101 that would bring it in line with the
quality and the character of the community. We believe the
entire village would be enhanced by such improvements.
For example, daily, thousands of cars pass through Carlsbad on
Highway 101 and never realize that the "Village of Carlsbad"
exists. I have talked to dozens of people that have been
delighted when they find out about the many fine shops and
restaurants in the village. The reason many vacationers don't
know about the village is because Carlsbad Boulevard is just a
highway, a wide strip of block pavement with no appeal or
indication that there is a charming village just a few blocks
away.

Because of the Carlsbad Inn's quality and dominant location on
Highway 101 we will have no problem attracting clientle, but we
would prefer to become more a part of the whole Village than be
divided from it by the highway. We would hope the community
would enjoy the use of our facilities just as we would hope our
guests would enjoy the many fine shops and facilities in the
Village. Currently, however, the highway is a detriment to the
village atmosphere and the interplay between amenities of the Inn
and the Village.
We believe that the City of Carlsbad could make a strong
statement about the village character and quality of the
community by improving the unattractive intersection of Highway
101 and Elm Avenue. We believe the area can be significantly
improved by the addition of pavers at the crosswalks and improved
landscaping at the four corners. We believe that a landscaped
median strip in the center of the highway is imperative to that
statement of quality and the statement that this is the "Village
of Carlsbad". We believe the village character would be even
further enhanced by the addition of attractive ornate lighting
fixtures in the median or at the street corners which could
create a unique and attractive entrance to the Village of
Carlsbad so that the thousands of people who now just pass
through would know—this is the Village of Carlsbad and it is
special I
We had hoped that these improvements would have been completed
concurrently with the completion of the Twin Inns and the
Carlsbad Inn but somehow the plan has fal len by the wayside. We,
therefore, respectfully request the city council reconsider
making these improvements a high priority and establish a date
for their completion.

We have agreed to be responsible for 50% of the costs of design and
installation of the median. As you know we had intended to actually complete
the median along with our own offsite improvements, which will not be possible
because the required redesign has not yet been finalized. By the time your
side of the street can be improved, our offsite work will be conpleted and
therefore it would appear to us more feasible to have you install the median
along with your work on the easterly half of the roadway. We, of course,
would still be responsible for 50% of the costs of the median.

Re: Carlsbad Inn Beach Club
With this letter we are enclosing completed application, required
documents and applicable fees for the Carlsbad Inn Beach Club, a privately
owned and operated recreation and storage facility for the exclusive use of
owners and guests of the Clarlsbad Inn Beach and Tennis Resort.
From a design standpoint, the improvements have been planned to emulate
the beauty and charm of the resort.,.that of an early European, old world
cottage and grounds featuring an entry gate with carriage lights, balustrade
railings, vine covered trellises, french window panes, woods, plaster, etc.
Physical and visual separations between properties have been addressed with
our neighbors to assure privacy and overall compatibility.
The concept that you see here incorporates not only the elements we feel
are necessary to best serve our clientele's needs while using the beach during
their stay at the resort; but also will go a long way to reduce the impact a
198-room resort would otherwise create on our neightborhood beach. The
current design and detail also represents key features which were determined
important during recent discussions with City and Coastal Commission staffs as
well as neighboring property owners.
Here we would like to address the findings necessary for the City to
approve our proposed conditional use plan,
1) The proposed use is both necessary and desirable for the development
of our beachfront neighborhood because it will better provide for the
increased use and enjoyment of the beach by the owners and guests of
the 198-room Carlsbad Inn Beach and Tennis Resort. The spaces planned
in the proposed facility will offer an attractive and inviting
atmosphere for our guests, creating a very pleasant alternative for
their use during their stay. The management guidelines we are
proposing (see environmental impact assessment) would assure
harmonious relationship between the existing and proposed uses and, in
fact, would actually improve the security and maintenance of the
general area.

2) The proposed decking, landscape and enclosure improvements have been
. designed to accommodate the size and shape of the site and are
consistent with those on neighboring properties.
3) Yards, setbacks, walls, fences, landscaping and other features have
been planned and designed to accommodate permitted uses.
4) Since use of the proposed facility will be by owners and guests of the
resort, virtually 100% of the traffic will be pedestrian thereby
negating any additional impact on the street system.
In conclusion, we wish to acknowledge the contributions made in planning
this facility by all concerned...neighboring property owners. City and Coastal
(Penmission staffs as well as our engineering, architectural and design
consultants. We are confident that the proposed Carlsbad Inn Beach Club
very nicely meets the needs of our owners, guests and community.

Recently, we have been studying the method and sequence of construction
for the hotel and parking garage to most effectively accomplish our best
possible production schedule. Essentially, the two methods we have considered
to facilitate the earliest start on both the hotel and parking garage would be
1) to cut and shore the slope adjacent to the hotel pad, or 2) to over-
excavate, build and backfill the eastern retaining wall of the parking garage
along the hotel pad with the necessary supporting structure.
After looking at the time and cost implications of both alternatives, we
have decided to follow the second scenario and, therefore, ask your assistance
in positioning our plans in the check process to allow us to meet our start
date of July 18 on the parking garage. As you may be aware, these drawings
have been in a progressive plan check process since May 7 and the final set
for corrections was submitted July 2.
If that date would be difficult to meet for the entire parking garage
perrait, we ask that we be allowed to pull the permit for the wall first. Ray
Flores, our structural engineering consultant, is available to discuss this
methodology and to produce any separate caicuiations that may be required.
Marty, we are certainly grateful for the cooperation from your department
during this fast track scheduling process, especially in view of the heavy
work load the City is handling. We feel that our own cooperation with the
City's staff and officials has enabled us to co-create the best vacation
resort along the north coast. And, we are pleased to be a part of Carlsbad's
Village Redeveiopment Area knowing that the development of The Carlsbad Inn
will produce significant revenues for its continued prosperity.

MAINTENANCE AGREEMENT
THIS AGREEMENT made and entered into this day of , 1984,
by and between CARLSBAD INN LIMITED ("Owner") as Owners of that certain real
property described on Exhibit "A" attached hereto and made a part hereof, and
THE CITY OF CARLSBAD ("City).
WHEREAS, Owner desires to develop said real property, to include, but
not be limited to, condominium units, a hotel, retail/commercial shops and a
restaurant; and
WHEREAS, Owner desires further to enhance the parking and public right-
of-way areas surrounding said real property with landscaping and decorative
wall improvements; and
WHEREAS, it is the mutual desire of the parties herein named that said
improvements be maintained in a safe, usable and attractive condition;
NOW, THEREFORE, in and for consideration of the mutual covenants and
conditions herein contained, it is mutuaUy convenanted and agreed as
foUows:
1) The parties hereby agree for themselves, their heirs, successors and
assigns, that the improvements described above, shaU hereafter be maintained
in a safe, usable and attractive condition.
2) The parties hereby further agree for themselves, their heirs,
successors and assigns, that the cost and expense of maintaining said
improvements in a safe, usable and attractive condition shall be the sole
obligation of Owner, their heirs, successors and assigns.
3) The parties hereby further agree that the covenants and agreements
herein contained shall run with the land and be binding on Owner, their
heirs, successors and assigns on aU or any portion of the property referred
to herein and any amendment or modification of this agreement will be null
and void unless first approved in writing by the City Attorney of the City of
Carlsbad.
4) Should Owner, their heirs, successors or assigns fail to maintain
said improvements in a safe, usable and attractive condition and if in the
City's judgement, said landscaping poses a safety hazard for traffic or other
purposes, the City may thereupon provide written notice to the then Owner(s)
"to iniiate" maintnenance within _____ days- Upon failure to demonstrate
good faith to provide mainenance or repair. Owner hereby agrees that City may
make aU needed maintnenace and/or repairs to said landscaping and then
assess costs to the Owner(s) then of record.
5. If City elects to make necessary maintenance and/or repair in
accordance with paragraph 4 above, then said work shall be without warranty.
Said repair and/or maintenance shall be accepted and guaranteed by the then
Owner(s) and said Owner(s) shaH indemnify, save and hold harmless City.
6) If the Owner elects to change, replace, alter or remove the above
improvements contained within said rights-of-way, then Owner shaU submit in
written and/or graphic form its plan for said change to the City for review
and approval prior to its implementation.. Said plan shaU be deemed approved
if Owner is not advised to the contrary within thirty (30) days of
submission.
7) It is the purpose of the parties herein that this instrument be
recorded to the end and intent that the obligation hereby created shaH be
and constitute a covenant against the property and any subsequent Owner(s) of
aU or any portin thereof, by acceptance of delivery of a deed and/or
conveyance regardles of form, shaU be deemed to have consented to and become
bound by these covenants and agreements.

Our District has reviewed the proposed 132 time share condo-
miniums at the above-referenced location and has evaluated
the impact of that development on the facilities of the
District.
Inasmuch as approval of this request would have no direct
impact upon the enrollment of students in the Carlsbad
Unified School District, we will not require an agreement
or contributions at this time as a result of the development
However, in the event that the time share condominiums
are converted to standard residential units, we would need
that information for further evaluation. It is highly
likely that school contributions would be required at that
time.

As you will recall, at the March 20 Council Meeting on the Twin Inns
issue, I presented NCTD's concerns regarding our current transfer
point at Grand and Washington. Although I requested that the Housing
and Redevelopment Conmission modify condition #14 of the Redevelopment
permit to incorporate solutions to those concerns, the members voted
to approve the permit without modification.
Based on the Commission's actions, we assume that NCTD will continue
to use the Grand and Washington transfer point for our buses. If the
City or developer are still interested in pursuing the other options,
NCTD staff is ready to work with you.
Please contact me if you are interested in pursuing the alternatives.

Dear Board Members and Commissioners:
I have, together with several other interested Carlsbad citizens,
reviewed schematic drawings for the proposed Carlsbad Inn development
("Project"); inspected the existing Cohn House (Currently occupied by
Fidel*s Restaurant) on the site of the Project; and reviewed
documentation regarding the historical significance of this edifice and
site. As a result of these reviews and inspections, we would like to
report the following Findings and Recommendations to the Design Review
Board and Planning Commission:
Finding 1: The proposed design is generally sensitive to the
appropriate scale and character desired in the Village Redevelopment
Area. The proposed Project, with some modifications, will be an asset
to the Village and the City of Carlsbad. Winners Circle Resorts
("Developer") appears to be genuinely interested in working with our
community to create a unique, high-quality Project, and we applaud them
for that concern.
Recommendation 1: The City should continue to work with the
Developer to ensure realization of a Project which incorporates our
recommendations below, is likely to be successful for the Developer, and
is of long-lasting benefit to the community.
Finding 2: The drawings presented for our review were not only
preliminary, but apparently inaccurate with respect to the currently
proposed massing of the buildings, and with respect to the probable
utilization of the Cohn House.

Recommendation 2: The Developer should be directed to prepare
schematic drawings for public review and comment which are essentially
accurate in their portrayal of tbe proposed project, particularly with
respect to the character, location and massing of all new buildings, and
with respect to the intended restoration or disposition of the Cohn
House. Action on the Project by the Design Review Board and Planning
Commission should be deferred until such time as accurate drawings have
been prepared and public input received.
Finding 3: Designed in 1931 by prominent La Jolla architect George
S. Walker, the Cohn House represents an Important landmark in the
development of Carlsbad, and an integral and important part of
Carlsbad's historic district along Carlsbad Boulevard. Its significance
to the Village is amplified by its location at the conspicuous corner of
Carlsbad Boulevard and Elm Avenue.
Recommendation 3: The Developer and the City should make every
effort to attempt to devise an economic scheme which would preserve and
enhance the original character of the Cohn House, together with its
significant landscaping. With the City's cooperation, there are many
economic incentives available to the Developer, at no or low cost to the
.City, which could improve the economics of the entire project, while
preserving the historic Cohn House. If necessary for the success of tbe
project, utilization of these incentives should be explored.
Finding 4; The Cohn House appears to be structurally sound
(although this should be confirmed by a complete building survey),
functionally useful, and reasonably placed on the site to allow economic
development of the entire site. This site potential was preliminarily
demonstrated in the Developer's early drawings of the Project.
Recommendation 4: The City should encourage the Developer to
include the historic Cohn House in an architecturally compatible
(although not necessarily architecturally similar) setting. The
Project, as planned, includes three distinct elements: Time-share
units, a hotel, and restaurant/commercial space. The Cohn House is a
reasonable focus for the restaurant/commercial portion of the Project.
Its original style, if sensitively related to the other elements of the
project in scale, use, and circulation, would be complementary to, even
if not stylistically like, the rest of the Project. If, after
reasonable efforts, the reuse of the Cohn House proves to be Infeasible,
the City and Developer should investigate the possibility of relocating
the building offsite, perhaps even for return to use as a private
residence. It is a sturdy, wood-frammed building, and can be moved.

Although the above recommendations will result in the project not being
approved at this week's meeting, we feel this delay is largely due to
the unavailability of good schematic drawings for timely input. We
recognize the cost of delay in real estate development projects, as well
as we recognize the subtler costs of unthoughtful development. These
recommendations are made in order to help the Developer and the City
ensure that the Carlsbad Inn project is completed on-time, on-budget,
and sensitively designed at this important and historically significant
corner in our Village.

of information regarding this building's historic and
architectural significance. V/e hope to share these items
with you at the above hearing; meanv/hile, allow us to
clarify the issues that concem us the most:
1. Preservation of one of Carlsbad's significant
historic and architectural sites;
2. Continuity of the architectural scale and design
of this property, particularly as it relates to
the surrounding environment.
We have received direct infonnation from the developers
regarding his design for the entire property but due to recent
changes in their plans for the Cohn home, specific remodeling
plans were not available. We are hopeful that the City of
Garlsbad will encourage, if not insist on, maximum preservation
of this valuable community resource.
Because of the uncertainty of plans for the Cohn home,
we respectfully suggest that consideration of plans for this
portion of the Carlsbad Inn development be delayed until a
specific architectural design has been completed.

We are submitting this letter in response to Staff
Recorrmendations and Conditions formulated for our Carlsbad
Inn project proposed for the property located at Elm and
Clarlsbad Boulevards.
Attached are eighteen copies of our Marketing and
Management Plans you have requested.
With regard to contingency planning, in the event our
timeshare marketing is unsuccessful we would envision
pursuing the follcwing plans in order:
A) Operate the whole business as a 198-unit resort
hotel. Parking requirements would remain one space
per unit — no change in count of spaces.
B) Convert the 132 resort units to 57 whole
condominiums by the following method: two adjoining one
bedroom units would be combined to produce one two-
bedroom unit converting 78 into 39 condos; three adjoin-
ing one-bedroom units would be combined to produce one
two-bedroom unit converting 36 into 12 condos; and two
adjoining two-bedroom units plus an adjoining one-
bedroom unit would be combined to produce one three-
bedrocm unit converting 18 into 6 condos.
Parking requirements for this configuration would
be as follows:
Ctondos = 2 spaces for each of the 57 units 114
Guests = 5 spaces for first 10 units 5
1 space for each 4 units thereafter 12
Total Spaces Required 131

Concerning the restaurant planning, we are continuing
discussions with the current operator and are not at a point
to finalize the direction for this building. The principals
involved are interested in achieving a plan that will best
serve the interests of the resort as well as the restaurant
operation. To allow ourselves maxirnum flexibility in
planning, we have designed the lot to permit us to either
retain and remodel the existing structure or to build a new
facility. A remodel would predominantly affect the exterior:
adding a highly pitched cedar shingle roof and architectural
detailing of color and materials to match the other newer
structures in the compound and we would probably enclose it
with decorative walls of fieldstone and plaster again
matching those used elsewhere.
To accomodate the re-design of the restaurant lot, the
parking garage plan was revised to avoid an overlap of the
property line. Only the storage space layout was affected
and we will have the copies of the revised plan to you before
your Friday deadline.
Many of our discussions with Staff have centered around
our need for the City to officially make their commitment to
construct the necessary pimp station which will assure sewer
availability to our project. We understand that the facility
has been budgeted, but that design has not begun pending
clear direction from the City Council. In order for us to
proceed with our project, we will require this cornni tment
frcm the City Council at our April 17 hearing — or before.
Please understand that we are not opposing the condition as
stated in your reeonmendation, but that we have proceeded on
Staff's assurance that the City does indeed intend to build
the station and that we must now require an official
ccnmitment to that end.
We will be addressing the matter of park-in-lieu fees
and public facilities assessment fees at the April 17 hearing
with the City Council. We believe we can demonstrate several
points which illustrate the relative burden for fees to be
excessive in the case of these proposed uses.
We must ask that the engineering department's request
for a 50' dedication along Ocean Street be waived by the
Design Review Board and Planning Ccmnission. The existing
property line which falls on a 45' R-O-W and the proposed
innprovements we have submitted conform to existing conditions

developed to the north and south of our project which will
not change. Additionally, locating the wall and ten feet of
landscape area behind the sidewalk allows us to soften the
inpact of the parking garage and residential structures.
Additionally, we ask that the City share the cost of a
full median along Carlsbad Boulevard in front of our project.
Such an inprovement will certainly be a benefit to the
businesses across the street which are fully developed as
well as the City. We hope the median, vliich has not yet been
designed, will be attractively landscaped and maintained.
With regard to the signal modification requirement, the
the inprovement plans have not yet been designed so neither
we nor the City know what this will involve. However, we
do agree to absorb the cost of physically re-locating the
signal if necessary and understand that any modifications
will not be extensive in nature.

You asked me to provide some information to you relative to the Royal
Palms project. I do not believe the project will cause a problem in
line capacity or at the Home Plant lift station. However, it is
difficult to assess what, if any, problems exist or possible solutions
as no utility planning for the project has been done. I expect
Engineering has indicated that there "may be a problem" in order to
prompt them into getting some of the utility planning done. Additionally,
the site is such that it probably could be sewered from at least two and,
possibly, three directions — again, the site development scheme would
be critical.
To be more specific:
The site most likely would sewer to the north in the Ocean Street line.
This line was paralleled from Oak across Beech and thence to the Home
Plant lift station in 1978. That project took care of ultimate popula-
tion for the drainage area. The Home Plant lift station is over 20
years old and is flowing at about 400,000 gallons/day — its capacity
is 1.2 MGD. The critical problem here is the age of the plant. We're
having reliability problems, and, the wet well capacity — it will over-
flow in 20 minutes in the event of an outage. We have a two hour retain-
ing basin built two years ago to mitigate spills into the lagoon, I
have the replacement station in the CIP for design in 1984 and construction
in 1985. This schedule can be accelerated and funds are available. Larry
Willey is in the process of developing a ^FP for the station design. So,
sewering to the north is not critical and the flows could be accommodated
now.
The site could sewer to the east, directly into the Vista trunk where it
crosses Elm at the railroad. This would require a relatively deep trench
but might be reasonable.

more off site construction. This is the least likely way because of
cost.
In summary, I see no problem in providing service, however, we should
have more complete plans than they have provided us to date. A pro-

of 1983. We thank you for the cooperation and courtesy extended
to us by your staff. Our examination of your records disclosed a
misunderstanding by your staff concerning the classification of
your tenants as non-transient when in fact their stay at your
facility was less than 30 days. Paragraph 7 of Section 3.12.020
of the City of Carlsbad ordinance states: "Transient" means any
person who exercises occupancy or is entitled to occupancy by
reason of concession, permit, rights of access, license or other
agreement for a period of thirty consecutive calendar days or less,
counting portions of calendar days as full days. Any such person
so occupying space in a hotel shall be deemed a transient until
the period of thirty days has expired unless there is an agreement
in writing between the operator and the occupant providing for a
longer period of occupancy. Please advise your staff of this re-
quirement in order that compliance with the City Ordinance be
implemented.

to and approved by the Fire Department.
