Install 3" mulch layer in all planting beds per note number 3 on sheet 6. 2. Install Ajuga reptans ground covers below shrubs per plan requirements. 3. Install Blood Red Trumpet Vines on the wall surrounding the patio area to the west of unit A, 4. Install Carex at the southwest comer of the lot per plan requirements. 5. Double stake all trees and remove nursery stakes. Fill hole left by removal of nursery stakes with appropriate soil amendments. 6. It was noted that the main leader of the Floss Silk Tree is broken out. It is recommended that this tree be replaced with a healthy tree having the main leader in place. Lack of a main leader may cause the tree to be deformed and cause potential structural weakness as the tree grows. 7. It is noted that two King Palms are missing at the east end of unit D. The contractor noted that smaller King Palms were placed adjacent to the other King Palms along this side to make up for this difference. It is recommended that the Landscape Architect of work review this installation and make recommendations as appropriate. The contractor/developer is reminded that the landscape architect of work shall review/inspect the project and submit the "final landscape certification form" prior to requesting a second city inspection. The contractor/developer is reminded that irrigation record drawings (as-builts) will be required to be completed and approved by the City prior to signing off the project. The contractor is to call Mike Elliott at (760) 944-8463 for a follow-up inspection when the above items are completed. Developer shall pay an inclusionary housing in-lieu fee as an individual fee on a per market rate dwelling unit basis prior to issuance of building permrt. Since the Housing and Redevelopment Department does not maintain storage of mylar plans, we request the Planning Department maintain this record in the same manner as all other discretionary land use permits. MS 05-01 PINE AVENUE UNITS A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carisbad Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject to conciitions that follow in this letter. Unless specifically stated in the condition, all of the following conditions, upon the approval of this tentative parcel map, must be met prior to approval of a final parcel map. General 1. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, Developer shall apply for and obtain approval from, the City Engineer for the proposed haul route. 2. Developer shall submit to the City Engineer, a reproducible 24" x 36", mylar copy of the tentative map and a digital copy of said map (in AutoCAD format, latest version) reflecting the conditions approved by the final decision making body. The reproducible shall be submitted to the City engineer, reviewed and, if acceptable, signed by the City's project engineer and project planner prior to submittal of the building plans, final map, improvement or grading plans, whichever occurs first. Prior to approval of any grading or building permits for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carisbad Street Lighting and Landscaping District No. 1 and/or to the formation or annexation into an additional Street Lighting and Landscaping District Said written consent shall be on a form provided by the City Engineer. Developer shall cause owner to waive direct access rights on the parcel map or by separate document and provide proof of recordation to the city engineer prior to the issuance of a building permit for all lots abutting Roosevelt Street. 9. Developer shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. Developer shall provide improvements constructed pursuant to best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be submitted to and subject to the approval of the City Engineer. Said plans shall include but not be limited to notifying prospective owners and tenants ofthe following: A. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properiy dispose of toxic and hazardous waste products. B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. 10. Prior to occupancy, developer shall install streetlights along all public and private street frontages abutting and/or within the subdivision boundary in conformance with City of Carisbad Standards. Carlsbad Municipal Water District 13. Prior to issuance of building permits, Developer shall pay all fees, deposits, and charges for connection to public facilities. Developer shall pay the San Diego Countv Water Authoritv capacitv charge(s) prior to issuance of Building Permits. 14. The Developer shall prepare a colored recycled water use map and submit this map to the Planning Department for processing and approval by the District Engineer. 15. The Developer shall design landscape and irrigation plans utilizing recycled water as a source. Said plans shall be submitted to the satisfaction of the District Engineer. 16. The Developer shall install (potable water and/or recycled water services) and meters at a location approved by the District Engineer. The locations of said services shall be reflected on public improvement plans. 17. The Developer shall install sewer laterals and clean-outs at a location approved by the District Engineer. The locations of sewer laterals shall be reflected on public improvement plans. 18. The Developer shall design and construct public water, sewer, and recycled water facilities substantially as shown on the (Tentative Map/Site Plan) to the satisfaction of the District Engineer. Proposed public facilities shall be reflected on public improvement plans. 19. The Developer shall provide separate potable water meters for each separately owned unit. 20. This project is approved upon the express condition that building permits will not be issued for the development of the subject property, unless the District Engineer has determined that adequate water and sewer facilities are available at the time of occupancy. A note to this effect shall be placed on the Final Map, as non-mapping data. Coofe Reminder The project is subject to all applicable provisions of local ordinances, including but not limited to the following: 21. The tentative map shall expire twenty-four (24) months from the date this tentative map approval becomes final. Upon such written request the City Engineer shall arrange a time and place with the developer for such review. The City Engineer has reviewed each of the exactions imposed on the developer contained in these conditions of approval, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and degree of the exaction is in rough proportionality to the impact caused by the project. Multi-family is considered a provisional use in District 5. Provisional use replaces the term conditional uses, which is used in the Carisbad Municipal Code. Provisional uses are subject to the discretionary approval of either the Housing and Redevelopment Director or the appropriate decision making authority. 7. Residential uses should not be placed in close proximity to uses which would adversely affect the health and welfare of the residents. There are concerns that the uses along Tyler Street could pose such a risk. 8. A reduction in the standard to the minimum, or anywhere within the range, may be allowed if the project warrants such a reduction and the following findings are made by the decision-making body: a) The reduced standard will not have an adverse impact on surrounding properties. b) The reduced standard will assist in developing a project which meets the goals of the Village Redevelopment Area and is consistent with the objectives for the land use district in which the project is to be located. c) The reduced standard will assist in creating a project design which is interesting and visually appealing and reinforces the Village character of the area. 15. A variance is required to exceed the rear side setback from ten feet (10') to twenty feet (20'). The required findings have been attached. Please provide a written justification to grant the requested variance. 16. Indicate open space percentage. Area that qualifies as open space includes; landscaped planters, open space pockets, balconies, and patios. No parking spaces or drive aisles are permitted in the open space. Indicate the percentages for the proposed patios and decks. 17. On the building elevations, please label proposed materials and colors. 18. Indicate building height and roof pitch on building elevations at all points. A minimum 4:12 roof pitch is required. 19. Provide wall height, width, and material information for all proposed patios and decks. 20. Provide a total square footage for each of the units. 21. Clarify if the chained link fence located on the north property line is existing or new. If new, the chained link fence seems inconsistent with the neighborhood and with the vision and land uses proposed for District 5. Some alternative materials would include wrought iron, block, etc. 22. Three guest parking spaces are required for the project. Standard parking spaces must have a minimum area of 170 square feet and a minimum width of SVz feet. In addition, when parking spaces are located adjacent to a solid wall, the minimum width of the space should be increased by two feet. Site plan indicates two guest parking spaces. The proposed two guest parking spaces are eight and a half feet wide. Please revise accordingly. Revise landscaping percentage information when changing the size of the guest parking spaces. 23. Propose deck railing. Please provide a description of proposed railing. Staff recommends enhanced decorative railing. 24. As part of the design review process, the Design Review Board must be satisfied that the applicant has made an honest effort to conform to each of the ten basic principles outlined in the Village Design Guidelines. Staff recommends that more attention be given to principle No. 7 stating, "Buildings shall be enriched with architectural features and details." A copy of the Village Design Guidelines has been enclosed for your use. The ten basic design principles can be found page 119 and additional suggestions for architectural treatment of residential structures can be found on pages 136-138. Staff recommends more decor on the garage doors. Add texture to the projects for example add brick or stone work to the project's patio/deck walls, and around the garage door. 25. Label architecture materials. Label architecture materials in the note section of the plans indicating features and materials. 26. In accordance with the Village Master Plan, all residential units proposed for separate ownership shall comply with the development standards and design criteria set forth by Planned Development Ordinance Chapter 21.45 of the Carisbad Municipal Code. In addition, it has been determined that the development standards set forth in the Planned Development Ordinance shall take precedence over the development standards set forth in the Village Master Plan. A copy of the Planned Development Ordinance Chapter 21.45 is enclosed for your reference. 27. Please be aware that in accordance with the Inclusionary Housing Ordinance for the City of Carisbad an affordable housing In-Lieu Fee will be required to be paid prior to the issuance of the building permit.
