Dear Mr. Holzmiller
Yesterday I came to the Carlsbad Community Bldg. to obtain
the necessary applications I would need for a project I am planning
on a lot I've purchased along with the lender on James Drive. In the
planning dept. I met with Mike Grimm and Eric Munoz. They told
me I would have to go through a process called a land use review
which was a complete surprise to me. They also said it could take
anywhere from 3 to 6 months to process my application and that is
even before I can begin plan check. Eric and Mike suggested that I
write you and Gary Wayne because you two may be the only
planners who can help my family.
The project is really quite simple, I'm using the land for what it
is designated for, a single family home on an Rl lot. The only
difference is I'm bringing the house in from off site rather than
building it on site, that's the only difference I can see. I've included
a project description that should help you understand the scope of
the project.
There are two reasons I choose to move a house onto the site
rather than build a new one, the first is price, I'm on a tight budget,
and the second is time, the quicker I complete the job the less money
I have to spend on interest. The house was located in La Jolla at the
beach at Bird Rock and was scheduled for demolition and it was
mine for the price of moving it, and since the house already exists I
can complete it in a fraction of the time it would take to build a new
house, although had I been aware of the possible delays involved in
the review process I would not have attempted the project.
I have been a contractor for 11 years and a carpenter for more
years than that. I've built 7 or 8 custom houses in Carlsbad and have
even been involved in moving a house to a fill-in lot at 3229 Valley
in Carlsbad and I've never been subject to the land use review
process. It is not the process I mind so much as the time the process
takes. The time the process takes will not only be an extreme
hardship to my family but I could loose just about everything
including the $500. a month I'll have to pay for storage of the
house.
Maybe a little background will help you understand our
situation. About 2 years ago my wife died of cancer after an 18
month battle, she was 31 years old . She was survived by myself and
our two kids, ages 2 and 5 at the time. Our Medical bills were
approaching the one million dollar mark, fortunately we had
medical insurance but it only covered $790,000. It was my
responsibility to pay off the balance which came to a little more than
$200,000.1 was forced to sell my house to help cover the bills.
Then about 6 months ago the house we were leasing to buy burned
to the ground. It was a total loss and we lost everything and had to
start over again. Soon after the fire I came across the perfect house
for my family, all I had to do was have it moved and come up with
a permanent site. I came up with the James Dr. site where we had
friends, some that even attend the same church we do, and they said
they could help with my kids, it is perfect for a single dad.
Anyway, because of the amount of the medical bills, I wasn't
always able to pay them on time. Even though I eventually paid all
my wife's medical bills my credit report was affected in a negative
way. The conventual sources I normally do business with turned me
down. It took 5 months and almost that many lenders to get a loan
because of the credit report. The lender who was willing to make
the land and construction loan is not a conventual lender, but a hard
money lender. This lender gave me 6 months to complete the
project and obtain a mortgage. The 6 month loan did not pose a
problem for me because I was confident I could complete the
project with time to spare and my lender is experienced with move
on and felt 6 months wouldn't be a problem. Of course this was
before I was aware of the land use review process.
If the land use review delays me to the point that I'm unable to
complete the project within 6 months I won't be able to obtain a
mortgage to pay off the construction loan. If this happens my family
will loose everything we have invested in the project, which is just
about all we have. I don't like revealing my personal situation to
strangers, dumb pride I guess, but I would appreciate it if you only
discussed my situation with those people who need to know or can
help.
I'm doing my best to make a good and safe home for my kids,
but the time the land use review process takes could wipe our family
out financially. I still don't understand why there has to be a review
because I'm using the property the way it was designated to be used,
a single family home on a Rl lot.
If there is any way you can help us to expedite this process of
land use review my kids and I would be very grateful. I don't know
what else to say other than my kids and I need all the help we can
get.

PROJECT DESCRIPTION
The project is a simple one in scope. I propose
to move an existing 1500 sq. ft. single family
dwelling from San Diego to an improved Rl lot
with all the underground utilities in place in the
city of Carlsbad. The house is in excellent shape
and will be placed on a new stem wall foundation.
The 2nd part of the project involves constructing a
detached 2 car garage on slab with an
office/workroom that will also double as a guest
room when the need arises. The house will be the
residence for myself and two young children.
There is president for moving a house on to an
infill lot in this neighborhood. Approximately 5
years ago a house was moved to a site located at
3229 Valley which lies directly east of my
proposed building site on James Dr. I have spoken
to the neighbors, and none have objected.
In conclusion I would like to say that this house
when completed will enhance, not detract from the
neighborhood. I would also like to say that a
project as simple and as straightforward as this
should not be subject to the time consuming and
complicated process of a Land Use Review.
