Dear Jim:
The purpose of this letter is to confirm our understanding with regard to Paragraph 15 of the
attached letter dated July 15, 1991 from the City of Carlsbad, addressed to Ware & Malcomb w,d $i;:lgqn . c.u *! L-. Cry E. V.kyne, Assistmt PPnnicg Dircctcr.
You explained to me that Paragraph 15 does not apply, and will not be a condition of our
building permit #CB910842 for Smith & Nephew DonJoy tenant improvements. You further
explained to me that if we obtained the referenced building permit without having to pay, or
agreeing to pay any costs associated with Paragraph 15, then this shall be conclusive evidence
that Paragraph 15 is not a requirement of the issuance of such building permit.
At one point in our conversation, your conferred with Jim Murray, Associate Engineer, and he
agreed with you.
By the way, I also spoke to Martin Lauber, Associate Engineer, and he also agreed that
Paragraph 15 does not apply and is not a requirement for getting this particular building permit.
We did obtain the building permit today and as you stated, we were not required to pay or agree
to pay anything under Paragraph 15.
If my understanding as expressed in this letter is incorrect, please respond to me immediately.
