RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4805 APPROVING a five year extension of CUP 268 (CUP 268x3) based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This proposed five year extension of CUP 268 will allow the continued operation of a Municipal Fire Station at the northeast comer of Buttercup Road and Batiquitos Drive through June 17, 2005. III. PROJECT DESCRIPTION AND BACKGROUND On July 17, 1996 the Planning Commission approved CUP 268x2 to allow the continued operation of a Mimicipal Fire Station at the northwest comer of Buttercup Road and Batiquitos Drive. Condition No. 2 of the approving CUP Resolution No. 3957 specifies that CUP 268 is granted for a period of 5 years but may be extended upon written application of the permittee (City of Carlsbad). The applicant, the City of Carlsbad Fire Department, is requesting a 4 year, 11 month extension of CUP 268 to allow the continued operation of the fire station at this site. IV. ANALYSIS The Municipal Fire Station continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan 2. Local Facilities Management Zone 4 3. D. No formal written complaints regarding CUP 268 have been submitted to the City. E. Aimual reviews have been conducted for CUP 268 and the project is in compliance with all conditions of approval. F. The extended CUP should be exempted fi-om environmental review per Section 15301, Existing Facilities, of the State CEQA Guidelines. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the Califomia Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. INTRODUCTION This proposed retroactive extension of CUP 268x3 for an indefinite time period will allow the continued operation of Fire Station No. 4 on the northwest comer of Buttercup Road and Batiquitos Lane from Jime 17, 2005 for an indefinite time period without the need for additional time extensions. III. PROJECT DESCRIPTION AND BACKGROUND On August 2, 2000 the Planning Commission approved CUP 268x3 to allow a five-year extension of CUP 268x2 on the northwest comer of Buttercup Road and Batiquitos Lane. Condition No. 3 of the approving CUP Resolution No. 4805 specifies that CUP 268x3 is granted for a period of 5 years but may be extended upon written application of the permittee (the City of Carlsbad). The applicant, the City of Carlsbad, is requesting an extension of CUP 268x3 for an indefinite time period to allow continued operation of the fire station at this site. Although CUP 268x3 expired on June 17, 2005, the application for time extension was made in a timely manner. IV. ANALYSIS A. The City's Fire Station No. 4 continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 2. I. PROJECT DESCRIPTION AND BACKGROUND On June 20, 1990 the Planning Commission approved a five year extension to CUP 268 (CUP 268x1) to extend an existing City of Carlsbad Fire Station at the southwest comer of Buttercup Road and Batiquitos Lane. Condition No. 8 of the approving CUP Resolution No. 3021 specifies that CUP 268 was extended for a period of 5 years and may be additionally extended upon written application of the permittee (City of Carlsbad Fire Department). While the five year extension period has elapsed, the applicant (City of Carlsbad Fire Department) did make a timely request for the extension that would allow the continued operation of a Municipal Fire Station at this site for another five years. IV. ANALYSIS A. The Fire Station No. 4 project continues to be consistent with all applicable plans, policies and regulations described below: 1. Carlsbad General Plan; 2. I. RECOMMENDATION It is recommended that the Plaiming Commission ADOPT Resolution No. 3021 APPROVING the five-year extension of CUP 268x1 based on the findings and subject to the conditions contained herein. II. PROJECT DESCRIPTION AND BACKGROUND On April 10, 1985, the Planning Commission approved Resolution No. 2430 allowing the constmction of a fire station at the southwest comer of Batiquitos Lane and Buttercup Road. All required conditions of approval were met prior to building and occupancy of the station, and the project has remained in conformance with these conditions since constmction. The fire station is a one-story building of Spanish architecture surrounded by landscaped areas vaiying from 5 to 20 feet in width. Access is taken off both Batiquitos Lane and Buttercup Road for the one-way through circulation of emergency vehicles. III. ANALYSIS Based upon several visits to the site, staff found that the required findings of the conditional use permit can still be made. The original staff report recommending approval of CUP 268, dated April 10, 1985, stated that the fire station was necessary to adequately serve the residences and businesses in the vicinity and was detennined to not be detrimental to any neighboring properties. The fire station is still necessary to meet the performance standards of the quadrant and no complaints regarding the operations have been received to date. The site is still adequate in size and shape to accommodate the use and all setbacks, walls, landscaping and noise abatement measures necessary to buffer the fire station from the residential neighborhood have been maintained. IV. ENVIRONMENTAL REVIEW The Planning Director has detennined that the extension of a pubhc serving use is exempt from environmental review per Section 15301 (l)(b) of the Califomia Environmental Quality Act and has filed a Notice of Exemption on April 12, 1990. II. PROJECT DESCRIPTION The City of Carlsbad is proposing to construct a 3800 square foot fire station on approximately .5 acres of land, located as described above. The subject property is an isolated pad elevated approximately 30 feet above a surrounding drainage course. The proposed fire station would be one story in height with a Spanish architectural motif. The station would serve the southwest quadrant of the City. Access would be derived from both Buttercup Road and Batiquitos Lane. Ill. ANALYSIS Planning Issues 1) Can the four findings required for approval of a Conditional Use Permit, be made? Specifically: a) That the requested use is necessary or desirable for the developm.ent of the community; is essentially in harmony with various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located; b) That the site for the intended use is adequate in size and shape to accommodate the use; c) That all of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or pennitted future uses in the neighborhood will be provided and maintained; d) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. Discussion The requested use is necessary for the development of the community in this area of the City. In the southwest quadrant, first phase construction has begun on several projects that will total over 1100 residential units east of 1-5 near Poinsettia Lane. West of 1-5, four hotel/motel project (totaling approximately 600 units) have been approved. All of this development will be located beyond a five-minute reponse time for the Fire Department. For this reason, the present status of fire service for this quadrant is considered limited to inadequate. Construction of the fire station will enable residences and businesses in the vicinity to receive adequate fire protection and emergency medical service. Previous research done under the processing of the conditional use permit for the fire station at El Camino Real and Chestnut indicated a neighborhood fire station would have no detrimental effect on property values as far as the tax assessor's office was concerned. A check on tax records verified this. The site is well suited to accommodate the proposed use. On two sides the station is buffered by Buttercup Road and Batiquitos Lane. A 60-75' wide drainage course which wraps around the site will buffer development to the west and south. As stated, the fire station will have a Spanish style architecture and will be compatible with surrounding condominiums. From the street, it will have the general appearance of a large, single family home which is heavily landscaped. All yards, setbacks, etc. required for a residential neighborhood have been provided to maintain compatibility with surrounding properties. Street systems in the area are adequate to handle the minimal traffic generated by the fire station. The site is located only one block from two major thoroughfares, Poinsettia Lane and Paseo del Norte. Both streets will be used as primary access points with travel through residential areas at a minimum. Noise will be controlled through building insulation. Alarm bells will be small and oriented to the imm.ediate station area. Only minor, routine maintenance of equipment will be done on site. Major repairs will be performed at Station No. 1 or the City yard. The use of sirens will seldom be necessary until the equipment reaches the intersection of Poinsettia and Paseo del Norte. -2- IV. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applicationsv for other approvals which are prerequisites to the map; i.e., Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded.
