NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Carlsbad yviii
hoW a public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad,
California, at 6:00 p.nn. on Wednesday, January 21, 1998, to consider a request for a
Conditional Use Permit to allow the use of a residential structure as a public building on
property located on the northwest corner of Elmwood Avenue and Laguna Drive, in
Local Facilities Management Zone 1 and more particularly described as:
A portion ofthe northwest quarter of Section 6, Township 12
south. Range 4 west, San Bernardino Base and Meridian, in
the City of Carlsbad, County of San Diego, State of
California
Those persons wishing to speak on this proposal are cordially invited to attend the
public hearing. Copies of the staff report will be available on and after January 15,
1998. Ifyou have any questions, please call Michael Grim in the Planning Department

SUBJECT: CUP 96-21 - ARTS OFFICE- Request for a Conditional Use Pennit to allow the
use of a residential stmcture as a public building on property located on the
northwest comer of Elmwood Avenue and Laguna Drive, in Local Facilities

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4232,
APPROVING a Conditional Use Permit (CUP 96-21), based on the fmdings and subject to the
conditions contained therein.
II. INTRODUCTION
The proposal involves the use of the single family dwelling as a City administrative office,
namely the Arts office. While the Arts Office has occupied the building for several years without
incident, the previously acquired Conditional Use Permit (CUP 91-13) expired without the
benefit of extension, thereby requiring a new Conditional Use Permit. No circumstances have
significantly changed since the original approval and the Arts Office is still a compatible use in
the single family neighborhood. A Conditional Use Permit is required to allow a public building
within a residential zone. The project conforms to all applicable regulations and staff has no
issues with the proposal.
III. PROJECT DESCRIPTION AND BACKGROUND
The City of Carlsbad Community Services/Arts Office is requesting approval of a Conditional
Use Permit to allow the continued occupation of a single family residence at 2955 Elmwood
Street by the City's Arts Office. The site is located on the northwest corner of Elmwood Street
and Laguna Drive, across the street from the Georgina Cole Library and City Hall parking areas.
The 1,843 square foot house, with its attached 500 square foot garage, is situated on a 12,050
square foot lot, taking principal access off of Laguna Drive. The property is zoned R-l, One
Family Residential, and designated RLM, Residential Low Medium Density, in the City's
General Plan. As shown on Exhibit "A", dated January 21, 1998, the Arts Office includes a
public outdoor sculpture garden on the west side of the site, adjacent to the City's Community
Garden. Due to the size and shape of the rear yard and its landscaping, the area covered by the
sculpture garden would measure 500 square feet or less. The hours of operation of both the Arts
Office and sculpture garden would be Monday through Friday, between 8:00 a.m. and 5:00 p.m.,
however, some weekend hours for the sculpture garden may be added in the future. There are

typically a maximum of five (5) employees working at the Arts Office at any given time. The
relevant history of the site dates back to Jtine 5, 1989, when the Planning Commission approved
PCD/GPC 89-04 to allow the City to acquire the single family site property for the future
expansion of the Cole Library. The City officially acquired the property in June of 1990 and a
Conditional Use Permit (CUP 91-13) to allow occupation of the residence by the Arts Office was
approved by the Planning Commission on March 18, 1992. The Arts Office has occupied the
building since 1992, operating without incident. The original Conditional Use Permit expired
without being extended and, therefore, the Arts Office reapplied for a new Conditional Use
Permit. Over the past year, the Community Services department has been redesigning the Arts
Office to improve access for physically challenged individuals and to accommodate a sculpture
garden in the rear yard, with direct access off of Laguna Drive. These improvements are shown
on Exhibits "A"-"H", dated January 21, 1998.
The Arts Office is subject to the following regulations:
A. General Plan;
B. R-l - Single Family Residential Zone (Chapter 21.10 of the Zoning Ordinance);
C. Conditional Use Ordinance (Chapter 21.42 of the Zoning Ordinance);
D. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance); and
E. Zone 1 Local Facilities Management Plan.
IV. ANALYSIS
The recommendation for approval of this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of these regulations/policies utilizing both text and
tables.
A. General Plan
The Arts Office project is consistent with the applicable policies and programs of the General
Plan. Particularly relevant to the public use of the residential structure are the Land Use,
Housing, and Arts Elements. Table 1 below indicates how the project complies with these
particular elements of the General Plan.

B. R-l - Single Family Residential Zone
The project site is zoned R-l and, therefore, subject to the regulations contained in Chapter 21.10
of the Zoning Ordinance. With regard to the use of a single family dwelling as a public building,
the regulations of the Conditional Use Ordinance take precedence. Since the single family
structure is existing, and no extemal expansion of the stracture is proposed, many of the
development standards of the R-l zone are not directly pertinent to the Arts Office proposal. The
existing stracture does conform to all development standards, however, with the exception of a
reduced intemal side yard along the north side of the building. Therefore, the building is a legal,
non-conforming structure. While this non-conformity would have an impact on any physical
expansion of the stracture, no restrictions on uses of non-conforming buildings exist. Since the
office uses are active only during daytime, weekday hours, no conflict should exist due to the
reduced side yard.
While not a part of the R-l Zone, a discussion of the parking requirements of the Zoning
Ordinance (Chapter 21.44) and the project's conformance is appropriate in this section. The Arts
Office measures 1,843 square feet in area, thereby necessitating eight (8) parking spaces at the
office ratio of one space per 250 square feet. In addition, the maximum 500 square foot sculpture
garden would require an additional space, based upon a museum parking ratio of one space per
500 square feet of floor area. There are three parking areas available to the Arts Office. There
are six extra spaces in the improved City Hall parking lot, located across the street and less than
300 feet away. These six spaces, combined with the 82 spaces required for City Hall (20,440
square feet at 1:250), represent all ofthe 88 spaces provided in the City Hall parking lot. There
is also an unimproved City parking lot directly north of the City Hall parking area that can
accommodate over 12 cars. There is also the availability of two driveway parking spaces in the
driveway of the single family structure, as allowed by Section 21.44.060(1) of the Parking
Ordinance. Therefore, given the six spaces at City Hall, the one space in the unimproved parking
lot and the two driveway parking spaces, there is adequate off-street parking to accommodate the
nine (9) spaces required for the Arts Office. Given the above, the Arts Office proposal is
consistent with the provisions of the R-l, Single Family Residential Zone and the Parking
Ordinance.

C. Conditional Use Ordinance
Since the project involves the public use of a building in a residential zone, a Conditional Use
Permit is required pursuant to Section 21.42.010(2)(I) of the Zoning Ordinance. The four
findings required for a Conditional Use Permit address compatibility and harmony of the use
with the project site and its existing and future surroundings. The Arts Office operates only
during normal business hours, that being daytime on weekdays. There may be some daytime,
weekend use of the sculpture garden. The office is not subject to frequent deliveries or pick-up of
products by heavy commercial trucks and does not cause the elimination of required off-street
parking. Most of the traffic generated by the office consists of employees. Some citizens
currently visit the Arts Office to pick up information, such as the newsletter or Jazz in the Park
flyers. It is anticipated that additional citizens will tour the proposed sculpture garden. These
visitors can conveniently park in the City Hall parking lots, as they will most likely be using
other City Hall or Library facilities on the same visit. The total number of visitors to the Arts
Office will be relatively small, when compared to other office uses in residential zones. This
Conditional Use Permit will also be reviewed on an annual basis to ensure compatibility with the
neighborhood. Except for a reduced intemal side yard, the existing building meets all applicable
development standards and the single family residence is being modified to accommodate current
access requirements for physically challenged individuals. Given the above, the Arts Office is
consistent with the Conditional Use Ordinance.
D. Growth Management Ordinance
Since the Arts Office involves no residential uses, many of the facilities regulated by the Growth
Management Ordinance are not affected. Table 2 below shows the project's compliance with the
applicable Growth Management facility requirements.

Zone 1 Local Facilities Management Plan
The Arts Office site is located within Local Facilities Management Zone 1. There are no special
development conditions in the zone plan that apply to this office project. The project is
conditioned to conform to all current and future requirements of the zone plan. All public
facilities needed to serve the development are already in place. The Arts Office project is
therefore in conformance with the Zone 1 Local Facilities Management Plan.
V. ENVIRONMENTAL REVIEW
The project involves the conversion of a single family dwelling into an office use and is,
therefore, exempt from environmental review pursuant to Section 15301(n) of the State CEQA
Guidelines. A Notice of Exemption will be issued upon final project determination.
