Description/Explanation: AUG 0 4 2008 CITY OF CARLSBAD PLANNING DEPT This purpose of the submittal of this application is to modify an existing Conditional Use Permit for the Public Safety Center site to allow for the construction of the First Responder's Training Facility. The project consists of four buildings ranging in size from 2,246 to 31,224 square feet and serves to train the Fire, Police and Public Works Departments of the City of Carlsbad. In addition to these structures is a large concrete area called the Rodeo/Drill Grounds that will be used by the City for a variety of driver training and fire evolution exercises. The largest of the buildings is a 2-story structure that contains both a I 00-yard and a 25-yard shooting range and a divisible classroom space. In addition, the building designates room for all necessary support and storage spaces. The massing of the building is broken up into different volumes to reduce the scale of the building and allow for a variety of materials to be used. The palette of materials includes concrete block, smooth and ribbed metal panels, perforated metal screens and sand finish stucco. The height of the building varies from 28'-0" to 34'-0" as the building steps back from Orion Way in order to again reduce the scale of the building from the street edge. A 2-story Fire Administration building is to be located on the East side of the site across the street from the Police Safety Center. Due to a 9'-0" existing grade difference, the first level of the building is set 12'-0" below Orion Way. This allows for the building to appear as though it is a 1-story structure. The massing of the building is broken up into different volumes to reduce the scale of the building and allow for a variety of materials to be used. The palette of materials includes concrete block, smooth and ribbed metal panels, perforated metal screens and sand finish stucco. The height of the building varies from 16'-0" to 32'-0" as the building steps back from Orion Way in order to again reduce the scale of the building from the street edge. The two remaining buildings are burn prop structures that will be used by both the Police and Fire Department for various training exercises. The larger of the two structures is a commercial burn prop that has a 4-story tower element with a roof canopy, which will be used for repelling and rescue training. Each elevation of this building simulates a different environment, from a strip mall to a 2-story walk-up apartment. The massing of the building is broken up into different volumes to reduce the scale of the building. The palette of materials includes concrete block, smooth rnetal panels and perforated metal screens. The height of the building varies from 28'-0" to 56'-0". The smaller of the two burn props is a 2-story residential structure that simulates a single-family home on a cul-de-sac. The palette of materials includes concrete block, smooth metal panels and perforated metal screens that are used to enclose the exhaust stacks and resemble a chimney. The results of the questionnaire determine the level of storm water pollution prevention standards applied to a proposed development or redevelopment project. Many aspects of project site design are dependent upon the storm water pollution protection standards applied to a project. Applicant responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the development application. A staff determination that the development application is subject to more stringent storm water standards, than initially assessed by the applicant, will result in the return of the development application as incomplete. If applicants are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, they are advised to seek assistance from Engineering Department Development Services staff. A separate completed and signed questionnaire must be submitted for each new development application submission. Only one completed and signed questionnaire is required when multiple development applications for the same project are submitted concurrently. In addition to this questionnaire, applicants for construction permits must also complete, sign and submit a Construction Activity Storm Water Standards Questionnaire. To address pollutants that may be generated from new development, the City requires that new development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practices (BMPs) into the project design, which are described in Chapter 2 of the City's Storm Water Standards Manual This questionnaire should be used to categorize new development and significant redevelopment projects as priority or non-priority, to determine what level of storm water standards are required or if the project is exempt. 1. Is your project a significant redevelopment? Definition: Significant redevelopment is defined as the creation, addition or replacement of at least 5,000 square feet of impervious surface on an already existing developed site. Significant redevelopment includes, but is not limited to: the expansion of a building footprint; addition to or replacement of a structure; structural development including an increase in gross floor area and/or exterior construction remodeling; replacement of an impervious surface that is not part of a routine maintenance activity; and land disturbing activities related with structural or impervious surfaces. Replacement of impervious surfaces includes any activity that is not part of a routine maintenance activity where impervious material(s) are removed, exposing underlying soil during construction. Note: If the Significant Redevelopment results in an increase of less than fifty percent of the impervious surfaces of a previously existing development, and the existing development was not subject to SUSMP requirements, the numeric sizing criteria discussed in Table 3 of 2.3.3.4 applies only to the addition, and not to the entire development. 2. Provide specifications for the cover crop if to be used: Slopes 6: I or steeper requiring erosion control measures as specified herein shall be treated with one or more of the following planting standards: a. Standard I -Cover Crop/Reinforced Straw Matting: Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application. The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within thirty (30) days. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder of the year. b. Standard #2 -Ground Cover One hundred (I 00%) percent of the area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3 -Low Shrubs Low spreading woody shrubs (planted from a minimum of2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4-Trees and/or Large Shrubs Trees and/or large shrubs shall be (planted from a minimum of I gallon containers) at a minimum rate of one (I) per two hundred (200) square feet. The plans shall indicate positive surface drainage (2% grade in planting areas) away from structures and terminating in an approved drainage system. 36. Due to relocation of utilities after plan approval, please add a note to plans indicating that the contractor shall contact the landscape architect prior to beginning landscape work so that the landscape architect can review the project utility locations and revise plans accordingly to fully screen all utilities from view. 3 7. It is recommended that a full weed abatement program be provided prior to planting to reduce the amount of weeds. See the following example: Upon completion of all fine grading work and soil preparation, perform weed control measures as follows: a. Irrigate all areas designated to be planted for a minimum of I 0 minutes per setting, two settings per day for seven days to germinate all weed seed possible. b. Apply a contact weed killer and allow sufficient time to obtain complete kill of all weeds germinated. c. Repeat step a above. d. Repeat step b above. 38. After rough grading, soil samples shall be taken from enough locations on the site to represent an adequate cross section of conditions. Soil test shall be performed by a soil testing laboratory (pre-approved by the City). The test shall indicate but not be limited to the following: a. organic matter content b. N, P, K c, pH d. EC e. soil texture (silt, clay, sand) f. recommendations for amendments, leaching, and maintenance fertilizations. The results and recommendations of the soil testing laboratory shall be submitted to and approved by the City. The approved recommendations for amendments and backfill shall be incorporated into the landscape plans prior to the start of landscape construction and shall become part ofthe approved plans. Please address in the specifications and/or on the plans. 39. Trees planted within 5' of public sidewalks shall be installed with root barriers approved by the City. Please provide appropriate notes and installation details. The barrier should be a lineal type barrier. 40. Add the following note to the title sheet: Prior to the start of grading, the applicant or applicant's agent shall obtain city approval of a construction schedule and/or exhibit outlining the timing of the slope planting and irrigation. The schedule shall show timing of construction of free-standing, retaining and crib walls immediately after rough grading as each location is achieved. The purpose of this document is to safeguard property and public welfare by regulating and reviewing the design, construction, quality of materials, use and occupancy, location, and maintenance of all buildings and structures. The standards used in this document represent model national standards. Crime Prevention through Environmental Design The proper design and effective use of the built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life. The proper design influences this by positively affecting human behavior. The design includes the physical environment, the planned behavior of people, the productive use of space and an effective crime/loss prevention program. Natural Surveillance 1. Place and design the physical features to maximize visibility. This will include building orientation, windows, entrances and exits, parking lots, walkways, landscape trees and shrubs, fences or walls, signage and any other physical obstruction. 2. Design the placement of person and or activities to maximize surveillance possibilities. 3. Design lighting that provides for appropriate nighttime illumination of parking lots, walkways, entrances and exits. Natural Access Control 1. Use sidewalks, pavement, lighting and landscaping to clearly guide the public or users to and from appropriate entrances and exits. 2. Use fences, walls or landscaping to prevent and or discourage public access to or from dark and or unmonitored areas. Provisions for territorial reinforcement 1. Use pavement treatments, landscaping, art, signage, screening and fences to define and outline ownership or property. Lighting I. All types of exterior doors should be illuminated during the hours of darkness, with a minimum maintained one (1) foot-candle of light, measured within a five-foot radius on each side of the door at ground level. 2. Recessed areas of buildings or fences, which have a minimum depth of two feet, a minimum height of five feet, and do not exceed six (6) feet in width and are capable of human concealment, should be illuminated with a minimum maintained 0.25 foot- candles of light at ground level during the hours of darkness. Landscaping 1. The basic landscaping theme should consist of low ground cover with a maximum height of 2 feet and canopy trees with a minimum lower canopy of 6 feet. 2. Overhead light poles should not be placed in an area planted with shade trees or other canopy producing species. Only basic ground cover, including but not limited to hedges and shrubs, should be used. 3. Use security landscaping in areas to deter loitering or entrance where pedestrians are not wanted. A single or double door shall be equipped with a double cylinder deadbolt with a bolt projection exceeding one inch or a hook-shaped or expanding deadbolt that engages the strike sufficiently to prevent spreading. All SkYlights on the roof of any building should be provided with rated burglary resistant glazing material securely fastened with bolts that are non-removable from the exterior. 2. All hatchway openings on the roof of any building should be secured as follows: a. If the hatchway cover is of wooded material, it should be covered on the inside with at least sixteen (16) gauge steel metal or its equivalent and attached with screws. 3. All air duct or air vent opening exceeding ninety-six (96) square inches on the roof, exterior doors, or exterior walls of any building should be secured by covering the same with the following: Stairways a. Iron bars of a least number four (4) steel or equivalent, spaced no more that five (5) inches apart on center, at each direction, welded at all point of intersection, or one by one-fourth ( 1 X Y•) inch flat steel or equivalent, spaced no more the five (5) inches apart on center, welded at all points of intersection. 1. Interior doors should have glazing panels a minimum of five inches wide and 20 inches in height and meet requirements of the Uniform Building Code. 2. Areas beneath stairways at or below ground level shall be fully enclosed or access to them restricted. 3. Stair towers and elevators have been the highest risk for personal injury as they are typically enclosed. Stairways should be designed to be completely visible from either the interior or exterior or both, unless mandated by the Uniform Building Code to be enclosed. 4. Fully enclosed interior or exterior stairways with solid walls, when required, should have shatter resistant mirrors or other equally reflective material at each level and landing and be designed or placed in such a manner as to provide visibility around corners. Elevators 1. Elevator cabs with interiors that are not completely visible when the door is open from a point centered on and 36 inches away from the door, shall have shatter resistant mirrors or other equally reflective material so placed as to make visible the entire elevator cab from this point. 2. H/ ADMIN/TEMPLATE • • Carlsbad Joint First Responders Training Facility Parking Management Plan The Carlsbad Police and Fire Departments have jcintly created this management plan to ensure the proper and effective use parking spaces at the new Public Safety Training Center facility and the adjacent Fire Station, Safety Center and Skate Park sites. The JFRTF manager(s) and facility staff shall: 1. Any new identification signage shall be shown on the construction drawings, including "Visitor Parking Only" signage at the entrance to the Joint First Responders Training Facility. 2. Ensure parking is within the facility (rodeo grounds) and are accessible to visiting staff and other non- general public users. Users will be given direction to use these parking spaces and not to park in the spaces intended for the general public. The following are parking management tools that can be utilized: 1) all visiting staff and other non-general public users will be provided a site plan and/or directions prior to their arrival directing them to parking areas on the site; 2) include signage or wayfinding methods to direct personnel into the rodeo grounds particularly during larger training evens or major gatherings; or 3) provide staff to implement an access control plan for the event. Parking management will be tailored depending on the type of event planned and which of the above tools will be most effective. 3. Coordinate large events with the Safety Center-Conference Center events to avoid parking problems. When overflow conditions are anticipated;'ensure the Joint First Responders Training Facility users park 1) inside the facility (rodeo grounds) first, 2) use the available parking at Fire Station No. 5, 3) use the available parking at the Safety Center employee lot or 4) park in the Public Works dirt lot. Managers will provide directional signage the day of the event if needed. The public comment period for the MND ended October 29, 2008; however, I would like to respond to your correspondence. The correspondence provides no specific comments on the project and does not identify any project concerns, environmental or otherwise. Instead, the items in the correspondence generically discuss on water quality and biological issues but for no particular project. Accordingly, this response provides a general environmental overview of the project by briefly describing its surroundings, proposed measures to mitigate project impacts, and the City's conclusion regarding the project's environmental impacts. The project site is located at the existing Safety Center on Orion Way, specifically the area that currently accommodates the ball field. Current uses in this area include the Police Safety Center, Fire Station No. 5, the City's Skateboard Park, and Public Works fleet maintenance yard. The project is not adjacent to the County of San Diego conservation area; however, it is nearby. The conservation area does border the entire Safety Center site except to the west. The mitigation measure for biological resources for the project is as follows: If construction must be conducted during the breeding season, a qualified biologist shall conduct a focused survey for bird nests not more than 72 hours prior to commencement of vegetation clearing activities. If active nests are found, the City's construction contractor shall cease construction within an appropriate buffer zone of up to 500 feet, as determined by the project biologist, around the nest site until juveniles have fledged and the nesting cycle is complete. Crews will be briefed with the requirements, consequences and enforcement of the Migratory Bird Treaty Act (MBTA) prior to construction activities. The project is also conditioned for the contractor to submit a Storm Water Management Plan (SWMP) and a Storm Water Pollution Prevention Plan (SWPPP) in compliance with current requirements and provisions established by the California Regional Water Quality Control Board (CRWQCB). In addition, the contractor shall implement best management practices (BMPs) at all times during construction of the project. The City has analyzed the project and concluded that the project with mitigation measures and conditions of approval will not have any potentially significant impacts to the environment. The same height limitation applies at driveways 25' from the edge of the apron outward along the curb then 45-degrees in toward the property. • (#18) Ceanothus 'Blue Cushion' may not be readily available. Please verify availability or provide a substitute. (#19) Locate street trees: a. A minimum of 3' outside the public right-of-way. b. A minimum of 5' from paving. c. (#21) Each unenclosed parking facility shall provide a perimeter landscape strip of at least 8' on all sides. The perimeter landscaped strip may include any landscaped yard, setback, or landscaped area otherwise required within the property and shall be continuous except for required access points. 27. (#22) Planting or any combination of planting, mounding, and decorative walls shall be used to provide screening from adjacent property or streets of the parking area to a height of 3'. 28. (#23) At least three percent of parking areas shall be planted and maintained with trees or approved shrubs. The plantings shall be contained in planting areas with a minimum dimension of 4' and bounded by a concrete or masonry curb of a minimum of 6" in height. The plantings shall be located throughout the off-street parking areas in order to obtain the maximum amount of dispersion. Please address and provide a calculation proving the percentage of landscape area provided in the parking area. 29. (#24) For office/industrial projects that are required by the City to provide outdoor employee eating areas, these areas shall be shown on the landscape/landscape construction plans picturing all amenities including but not limited to site furniture, trash receptacles, and picnic tables. (#26) Please add the following notes to the plans and address/show how each standard (standards 1 through 4) are met on the plans: Slopes 6: 1 or steeper requiring erosion control measures as specified herein shall be treated with one or more of the following planting standards: a. Standard 1 -Cover Crop/Reinforced Straw Matting: Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application. The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within thirty (30) days. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder of the year. b. Standard #2-Ground Cover One hundred (1 00%) percent of the area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3 -Low Shrubs Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4-Trees and/or Large Shrubs Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Slopes-6:1 or steeper and: a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum Standard #1. b. 3' to 8' in vertical height require Standards #1, #2 and #3. c. In excess of 8' in vertical height require Standards #1, #2, #3, and #4. Areas graded flatter than 6:1 require Standard #1 (cover crop) with temporary irrigation when they have one or more of the following conditions: a. Sheet graded pads not scheduled for improvements within 6 months of completion of rough grading. b. A potential erosion problem as determined by the City. c. Identified by the City as highly visible areas to the public or have special conditions that warrant immediate treatment. 31. (#27) Please coordinate the walk layout along the south side of the project on the landscape, architectural and civil plans. 32. Include on all sheets the application number in the upper right corner (CUP 08-15). 34. Highlight the areas that will have cut and fill grading (use different symbols for cut and fill). 35. The material board depicts vertical and horizontal fins and a green screen system, however, the material legends on the elevation sheets does not depict either one of these materials. Please correct the discrepancy. 36. Depict the fire training tower attached to the commercial burn prop instead of as a stand alone structure since the two buildings are attached at the first and second floors. 37. Describe what the 12-foot high structure is used for that is depicted on the left side of the fire training tower as shown on the west elevation (Sheet A-BPC-5.1 ). 38. Provide a legend or explain what the panels are on the third floor plan of the commercial burn prop building. It is not clear if it is glass or some other material. 39. The floor and roof plans depict symbols without providing a legend to explain what they are depicting. Please either remove the symbols or include a legend. Also, remove all symbols that are not necessary for conceptual plans. 40. Provide information stating how you will reduce the appearance of bulk and mass of the building and security wall (i.e. landscaping, public art, architectural elements, etc.). Provide a color rendering showing the building, wall and landscaping as viewed from all four elevations. 41. If the project will be constructed in phases, please provide plans (site and elevation) depicting the interim use(s) of the area 42. Provide a parking analysis of the adjacent fire department and public safety facility since shared parking is planned. The analysis should include the required parking for the use and the parking provided to provide information on whether the facilities are currently under or over parked. Engineering: Storm Water Management Plan: 43. Page 2, the last paragraph states main parking lot will discharge to a grass-lined swale in the northwest corner of the site. However, in reviewing Sheet L-1. 0 no grass is indicated. The plan shows ground cover, bushes and rock. This should be corrected in the report to reference material shown on Sheet L-1.0. 44. Page 3, the second and third paragraph states, "The grass -lined swales will act as a biofilter and treat runoff before discharging off-site." This should be changed to reflect the plant material shown on Sheet L-1.0 which is not a grass-lined swale. 45. Page 5, states, "Grass Lined Swale." See comments above. Environmental Impact Assessment Form: 48. Page 4, under the title "Support Facilities" the last paragraph states water used for training will be reclaimed. Recommend that the word "reclaimed" be changed to "captured". Further, this paragraph states irrigation water will be taken from the standard pptable water supply. Recycled water is available directly to the site and any supplemental water used for irrigation shall be obtained from the recycled water supply system. There is no discussion on how the two different supplies of irrigation water will be integrated. The existing recycled water supply, based on the bottom elevation of the recycled water storage reservoir elevation 550, will result in the following: At the highest ground elevation at the site the static pressure would be 80 psi. At the lowest ground elevation at the site the static pressure would be 87 psi. We estimate that there is sufficient pressure to use the recycled water for irrigation purpose directly, but final design may result in the need for a booster pump. 49. Page 21, states that implementation of construction or clearing of vegetation within the project impact footprint shall occur outside of breeding season. Why does this existing improved site need to contain a requirement for construction activities to be limited to this time frame? Grading and clearing is probably no greater than ambient noise levels. The current activity at this site is also high when considering the recreation use. As a maximum a biologist should be allowed to review the site prior to construction and allow construction to proceed if no raptors are present in the immediate area. 50. Page 31, first paragraph, revise it to reflect the comment in 5(a) above. 51. Page 36, states that training will occur during the daylight hours. This is not correct and in addition mandatory night training is required periodically. 52. Page 45, revise item (b) to reflect comment in 5(a) above. Pian Sheets: 53. Sheet C-1 -To gain more paved area in the rodeo/drill grounds west of the residential burn prop, extend the paved area up to the perimeter wall on the north side by making the perimeter wall a retaining wall in that area. This will increase the proposed impervious area. 54. Sheet C-2 -Move the underground detention basin/confined space prop to a location northerly of the water pipeline adjacent to or within the parking spaces located just west of the residential burn prop (see attached sketch). This location avoids the need for the storm drain pipe to cross over the water and sewer pipelines and places the prop out of the normal vehicle pathway during a training exercise. 55. Any claim, which ariseS out of the transaction vesting in the insured the estate or interest insured by this policy, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that is based on: (i) the transaction creating the estate or interest insured by this policy being deemed a fraudulent conveyance or fraudulent transfer; or (ii) the transaction crl&lting the estate or interest insured by this policy being deemed a preferential transfer except where the preferential transfer results from the failure: (a) to timely record the instrument of transfer; or (b) of st.eh recordation to impart notice to a purchaser for value or a judgment or lien creditor. 9. (a) Any law, ordinance or governmental regulation (including but not limited to building and zoning laws, ordinances, or regulations) restricting, regulating, prohibiting or relating to (i) the occupancy, use, or enjoyment of the land; (ii) the character, dimensions or location of any improvement now or hereafter erected on the Land; (iii) a separation in ownership or a change in the dimensions or area of the Land or any parcel of which the Land is or was a part; or (iv) environmental protection, or the effect of any violation of these laws, ordinances or governmental regulations, except to the extent that a notice of the enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the Land has been recorded in the Public Records at Date of Policy. This exclusion does not limit the coverage provided under Covered Risks 12, 13, 14 and 16 of this policy. (b) Any governmental police power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the Public Records at Date of Policy. This exclusion does not limit the coverage provided under Covered Risks 12, 13, 14 and 16 of this policy. 2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the Public Records at Date of Policy, but not excluding from coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without Knowk!dge. 3. Defects, liens, encumbrances, adverse claims or other matters: (a) created, suffered, assumed or agreed to by the Insured Claimant; (b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this policy; (c) resulting in no loss or damage to the Insured Oaimant; (d) attaching or created subsequent to Date of Policy (this paragraph does not limit the coverage provided under Covered Risks 8, 16, 18, 19, 20, 21, 22, 23, 24, 25 and 26); or (e) resulting in loss or damage which would not have been sustained if the Insured Claimant had paid value for the Insured Mortgage. 4. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of the Insured at Date of Policy, or the inability or failure of any subsequent owner of the indebtedness, to comply with applicable doing business laws of the state in which the Land is situated. 5. Invalidity or unenforceability of the lien of the Insured Mortgage, or claim thereof, which alises out of the transaction evidenced by the Insured Mortgage and is based upon usury, except as provided in Covered Risk 27, or any consumer credit protection or truth in lending law. 6. Real property taxes or assessments of any governmental authority which become a lien on the Land subsequent to Date of Policy. This exclusion does not limit the coverage provided under Covered Risks 7, 8 (e) and 26. 7. Any claim of invalidity, unenforceability or lack of priority of the lien of the Insured Mortgage as to advances or modifications made after the Insured has Knowledge that the vestee shown in Schedule A is no longer the owner of the estate or interest covered by this policy. This exclusion does not limit the coverage provided in Covered Risk a. 8. Lack of priority of the lien of the Insured Mortgage as to each and every advance made after Date of Policy, and all interest charged thereon, over liens, encumbrances and other matters affecting title, the existence of which are Known to the Insured at: (a) The time of the advance; or (b) The time a modiftcation is made to the tenns of the Insured Mortgage which changes the rate of interest charged, if the rate of interest is greater as a resutt of the modification than it would have been before the modification. This exclusion does not limit the coverage provided in Covered Risk 8. 9. The failure of the residential structure, or any portion thereof to have been constructed before, on or after Date of Policy in accordance with applicable building codes. This exclusion does not apply to violations of building codes if notice of the violation appears in the Public Records at Date of Policy. · 13. This Exclusion l(a) does not modify or limit the coverage provided under COvered Risk 5. (b) Any governmental police power. This Exclusion 1(b) does not modify or limit the coverage provided under COvered Risk. 6. 2. Rights of eminent domain.
