HomeMy WebLinkAbout2021-02-16; City Council; Resolution 2021-044RESOLUTION NO. 2021-044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS, AWARDING A CONTRACT TO HAZARD CONSTRUCTION COMPANY AND AUTHORIZING ADDITIONAL APPROPRIATION IN AN AMOUNT NOT TO EXCEED $512,000 FOR CONSTRUCTION OF THE EL CAMINO REAL BRIDGE IMPROVEMENTS AT CANNON ROAD PHASE I, CAPITAL IMPROVEMENT PROGRAM (CIP) PROJECT NOS. 6042 AND 6056, IN AN AMOUNT NOT TO EXCEED $1,819,988 WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to construct El Camino Real Bridge Improvements at Cannon Road Phase I, CIP Project Nos. 6042 and 6056 (Project); and WHEREAS, on Oct. 6, 2020, the City Council adopted Resolution No. 2020-197 approving the plans and specifications and authorizing advertisement for bids for construction of the Project; and WHEREAS, on Dec. 8, 2020, staff received 10 sealed bids for the Project; and WHEREAS, the lowest responsive and responsible bid for the Project was submitted by Hazard Construction Company, in an amount of $1,819,988; and WHEREAS, the current funding for the Project that has been appropriated from Traffic Impact Fees and the Infrastructure Maintenance and Repair Fund is not sufficient to complete the Project; and WHEREAS, additional appropriations for the Project will be appropriated from the Gas Tax Fund in the amount of $512,000; and WHEREAS, Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(l)(6) require City Council to award all formally bid contracts when the value exceeds $200,000; and therefore, the Project is subject to this requirement; and WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C)(5) and 3.28.090(B) authorize the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which is $273,000 for this Project; and WHEREAS, the city planner has determined that the project is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines — Existing Section 15301 (c) — Existing Facilities and Section 15301 (d) — Replacement or Reconstruction, and that no exception as set forth in CEQA Guidelines Section 15300.2 applies. Feb. 16, 2021 Item #6 Page 5 of 7 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.That the bid of $1,819,988 submitted by Hazard Construction Company for construction of El Camino Real Bridge Improvements at Cannon Road Phase I, CIP Project Nos. 6042 and 6056, is accepted and the mayor is hereby authorized to execute the contract for this Project. 3.That the deputy city manager, administrative services, is authorized and directed to appropriate additional Gas Tax Fund in the amount of $512,000 for construction of the Project. 4.That the City Manager or designee is hereby authorized to approve construction change orders up to $273,000; construction management and inspection costs up to $350,000; and construction support up to $40,000. 5.That the award of this contract is contingent upon Hazard Construction Company executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 calendar days of adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 16th day of February, 2021, by the following vote, to wit: AYES: Hall, Blackburn, Acosta, Bhat-Patel, Schumacher.
