Executive Summary The Housing Services Division of the Community Development Department administers the federally funded Section 8 Rental Assistance Program on behalf of the City of Carlsbad Public Housing Agency. Under federal law, the Carlsbad Public Housing Agency is required to file a five- year Public Housing Agency Plan with HUD. Additionally, the housing agency is also required to prepare, adopt and submit to HUD an Annual Public Housing Agency Plan consistent with the goals and objectives of the five-year plan. These plans provide a basic guide to the housing agency’s policies, and the rules and requirements concerning the agency’s operations, programs and services. In addition, the plans advise HUD and members of the public about the mission and strategies for serving the needs of low-income and very low-income families within the housing agency’s jurisdiction for each of the next five years. Under federal law, the plans must be adopted by the local Public Housing Agency’s Board of Commissioners, which for Carlsbad is the City Council, serving as the Community Development Commission. The commission approved the five-year plan on April 7, 2020. The Fiscal Year 2021 Annual Plan (attached to Exhibit 1) is the first annual update of the five-year plan. Discussion Plan goals and objectives The 5-Year Public Housing Agency Plan identifies quantifiable goals and objectives that will enable the agency to serve the needs of low-income families, those with under 80% of the area median income; very low-income families, with under 50% of the area median income; and extremely low-income families, with under 30% of the area median income. March 23, 2021 Item #7 Page 1 of 24 The adopted 5-Year Public Housing Agency Plan has the following goals and objectives: 1. Expand the supply of assisted housing • Apply for additional Housing Choice Voucher funding, when funds are made available and the PHA is eligible to apply for such funds1 2. Improve the quality of assisted housing • Improve voucher management by continuing to be recognized as a “high- performing housing agency” in accordance with HUD’s Section Eight Management Assistance Program performance evaluation • Improve management functions by streamlining functions and technical initiatives • Fully utilize and maintain housing assistance payment costs within HUD-funded allocations 3. Increase assisted housing choices • Maintain voucher payment standards to expand assisted housing choices 4. Promote self-sufficiency and asset development of families and individuals • Continue to voluntarily administer the Family Self-Sufficiency Program for participants that are transferring into the jurisdiction who are currently on such a program 5. Ensure equal opportunity and affirmatively further fair housing • Undertake affirmative measures to ensure access to assisted housing regardless of race, color, religion, national origin, sex, sexual orientation, familial status and disability o Will provide educational information about equal opportunity and fair housing at all Section 8 Program briefings and move briefings o Will provide reasonable accommodations for people with disabilities and for frail elderly o Will contract with the Legal Aid Society of San Diego, a non-profit agency that provides advocacy on fair housing and tenant-landlord mediation issues Plan changes from last year Each year, the Public Housing Agency is required to identify any plan elements that have been revised since the last annual plan submission. For this reporting period there was one area that has been revised and is addressed in the Fiscal Year 2021 Annual Public Housing Agency Plan elements segment: 1 The housing choice voucher program is the federal government's major program for helping very low-income families, the elderly, and the disabled afford decent, safe, and sanitary housing in the private market. March 23, 2021 Item #7 Page 2 of 24 Financial resources - The amount of funding received for housing assistance payments and program administration in calendar year 2020 increased significantly since the last reporting period: 2019 2020 Annual contributions $7,192,359 $9,209,244 For rental assistance payments $6,637,580 $8,420,505 For program operating expenses $554,779 $788,239 In November 2020 the housing agency received an additional disbursement of $975,370. These additional funds were in response to the increase in monthly rental assistance payments as a result of the COVID-19 pandemic. The housing agency also received $251,319 for administrative costs also due to the pandemic. Plan progress report The Public Housing Agency also needs to indicate its progress in meeting the goals and objectives identified in its last approved and adopted 5-Year Public Housing Agency Plan. The agency’s goals and their status are described below: 1. Goal – Expand the supply of assisted housing • Received an allocation of nine special purpose vouchers specifically for non- elderly persons with disabilities. 2. Goal – Improve voucher management • In response to COVID 19 and the office closure, developed protocols for interacting with participants and stakeholders via phone, email and online meetings. 3. Goal – Increase assisted housing choices • Maintained payment standards between 100% and 110% of the HUD-published “fair market rents” to ensure voucher holders are able to fully use their assistance and find adequate housing in Carlsbad. • The city’s housing navigator position assists rental assistance participants and community members in locating housing. Last year, the housing navigator assisted about 600 individuals. 4. Goal – Promote self-sufficiency and asset development of families and individuals • Voluntarily administers the Family Self-Sufficiency Program for participants who have moved into the agency’s jurisdiction. In 2020, there were three families participating in the program, one successfully completed the program during the year. 5. Goal – Ensure equal opportunity and affirmatively further fair housing • The agency has a contract with the Legal Aid Society of San Diego to provide Fair Housing counseling, educational Fair Housing seminars for staff, tenants and landlords. Among the services it provided in 2020, the Legal Aid Society conducted a fair housing law and eviction moratorium training before the Housing Commission in December. Members of the public and the real estate and property management industries were invited to attend the virtual workshop. March 23, 2021 Item #7 Page 3 of 24 • In collaboration with other North County cities, the 2020-2025 San Diego Regional Analysis of Impediments to Fair Housing was finalized in May 2020.2 The Analysis of Impediments, which was approved by the City Council on July 14, 2020, provides guidance to the cities and the region to advance the goals of fair housing. • Fair housing educational materials are available on the city’s website and included in briefing packets and available in English and Spanish in the Housing Services lobby. On January 14, 2021, the Housing Commission passed a resolution (Exhibit 3) recommending approval of the annual plan for FY 2021. Options Federal regulations require public housing agencies to prepare, adopt and submit to HUD an Annual Public Housing Agency Plan as a condition of receiving Section 8 program funding. If the Carlsbad Community Development Commission does not adopt and submit the Fiscal Year 2021 Annual Public Housing Agency Plan to HUD, then the city’s Section 8 rental assistance program would not receive funding. Fiscal Analysis The Public Housing Agency Plan governs the federal funds allocated for administration of the Section 8 Rental Assistance Program. For calendar year 2020, the City of Carlsbad’s funding allocation was $8,420,505 for rental assistance payments and $788,739 for program operating expenses. The funding level for calendar year 2021 is unknown at this time because it is not expected that HUD will publish and release the funding allocations until April. However, assuming next year’s funding will be similar to the current year allocation, staff estimates the housing agency will be able to continue providing rental subsidies for approximately 550 families. Next Steps With the Community Development Commission’s approval of the Public Housing Agency Plan, staff will work with the mayor to execute and submit all required documents to the Department of Housing and Urban Development, which includes all certifications relating to civil rights. Environmental Evaluation (CEQA) This action does not constitute a “project” within the meaning of the California Environmental Quality Act under Public Resources Code section 21065 in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification and Outreach The draft FY 2021 Public Housing Agency Annual Plan was available for public review and comment for 45 days prior to adoption by the Community Development Commission. Public comments from the public review period and the public hearing will be included in the final Public Housing Agency Plan submission to HUD. Public notice of this item was posted in keeping with the state's Ralph M. Brown Act and it was available for public viewing and review at least 72 hours before the scheduled meeting date. The PHA has included in the Plan submission a copy of the recommendations made by the Resident Advisory Board or Boards and a description of the manner in which the Plan addresses these recommendations. 4.The PHA made the proposed Plan and all information relevant to the public hearing available for public inspection at least 45 days before the hearing, published a notice that a hearing would be held and conducted a hearing to discuss the Plan and invited public comment. 5.The PHA certifies that it will carry out the Plan in conformity with Title VI of the Civil Rights Act of 1964, the Fair Housing Act, section 504 of the Rehabilitation Act of 1973, and title II of the Americans with Disabilities Act of 1990. 6.The PHA will affirmatively further fair housing by examining their programs or proposed programs, identifying any impediments to fair housing choice within those programs, addressing those impediments in a reasonable fashion in view of the resources available and work with local jurisdictions to implement any of the jurisdiction's initiatives to affirmatively further fair housing that require the P1-IA's involvement and by maintaining records reflecting these analyses and actions. 7.For PHA Plans that includes a policy for site based waiting lists: •The PHA regularly submits required data to HUD's 50058 PIC/IMS Module in an accurate, complete and timely manner (as specified in P1H Notice 2010-25); •The system of site-based waiting lists provides for full disclosure to each applicant in the selection of the development in which to reside, including basic information about available sites; and an estimate of the period of time the applicant would likely have to wait to be admitted to units of different sizes and types at each site; •Adoption of a site-based waiting list would not violate any court order or settlement agreement or be inconsistent with a pending complaint brought by HUD; •The PHA shall take reasonable measures to assure that such a waiting list is consistent with affirmatively furthering fair housing; •The PHA provides for review of its site-based waiting list policy to detennine if it is consistent with civil rights laws and certifications, as specified in 24 CFR part 903.7(c)(1). 8.The PHA will comply with the prohibitions against discrimination on the basis of age pursuant to the Age Discrimination Act of 1975. 9.The PHA will comply with the Architectural Barriers Act of 1968 and 24 CFR Part 41, Policies and Procedures for the Enforcement of Standards and Requirements for Accessibility by the Physically Handicapped. 10.The PHA will comply with the requirements of section 3 of the Housing and Urban Development Act of 1968, Employment Opportunities for Low-or Very-Low Income Persons, and with its implementing regulation at 24 CFR Part 135. 11.The PHA will comply with acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and implementing regulations at 49 CFR Part 24 as applicable. The PHA will take appropriate affirmative action to award contracts to minority and women's business enterprises under 24 CFR 5.105(a). 13. The PHA will provide the responsible entity or HUD any documentation that the responsible entity or HUD needs to carry out its review under the National Environmental Policy Act and other related authorities in accordance with 24 CFR Part 58 or Part 50, respectively. 14. With respect to public housing the PHA will comply with Davis-Bacon or HUD determined wage rate requirements under Section 12 of the United States Housing Act of 1937 and the Contract Work Hours and Safety Standards Act. 15. The PHA will keep records in accordance with 24 CFR 85.20 and facilitate an effective audit to determine compliance with program requirements. 16. The PHA will comply with the Lead-Based Paint Poisoning Prevention Act, the Residential Lead-Based Paint Hazard Reduction Act of 1992, and 24 CFR Part 35. 17. The PHA will comply with the policies, guidelines, and requirements of OMB Circular No. A-87 (Cost Principles for State, Local and Indian Tribal Governments), 2 CFR Part 225, and 24 CFR Part 85 (Administrative Requirements for Grants and Cooperative Agreements to State, Local and Federally Recognized Indian Tribal Governments). 18. The PHA will undertake only activities and programs covered by the Plan in a manner consistent with its Plan and will utilize covered grant funds only for activities that are approvable under the regulations and included in its Plan. 19. All attachments to the Plan have been and will continue to be available at all times and all locations that the PHA Plan is available for public inspection. Chairperson Ngyuen-Cleary noted that the draft 2021-2029 Housing Element includes a program to improve access to housing information, and that it overlaps with Goal 4 of the Housing Commission work plan. Commissioner Evans volunteered to meet with Ms. Rivera to discuss her concerns and ideas, and Housing Services Manager de Cordova stated that staff would also reach out to Ms. Rivera regarding points she raised. Analysis The purpose of the 5-Year PHA Plan is to identify goals and objectives to serve the needs of low- income (under 80% of the area median income - AMI), very low-income (under 50% of the AMI), and extremely low-income (under 30% of the AMI) families for the next five years. The following area is addressed in the PHA Plan Update segment: • Financial Resources Next Steps The Fiscal Year 2021 Annual Plan is required to be available for public review and comment prior to a Public Hearing and adoption by the City Council who acts as the Community Development Commission for this process. The public review period is 45 days and the Annual Plan is due to the Housing and Urban Development Department (HUD) prior to April 17, 2021. A Public Hearing will be scheduled when the Community Development Commission hears this item. All public comments received on the Annual Plan will be addressed and included in the final documents that will be submitted to HUD.
