MCUP 10-15 was approved on July 27, 2010. A 10-year extension to MCUP 10-15 was approved on October 1, 2020 and the permit is valid until July 27, 2030. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include the following: • Remove and replace two (2) wall-mounted panel antennas behind existing RF screen boxes on the west and north elevations • Add one (1) new wall-mounted panel antenna and RF screen to the south elevation of the building • Modifications to the equipment on the roof. The equipment will continue to be fully screened from public view. The current approval associated with MCUP 10-15 allows for five (5) wall-mounted panel antennas and associated equipment located inside the Bank of America building at 7700 El Camino Real. The proposed CD entails a request to increase the number of approved panel antennas from five (5) to six (6). In order for o Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted thot had been considered essential to the project's design, quality, safety or function in that the modifications to the WCF, including the removal and replacement of two (2) wall-mounted panel antennas behind existing RF screen boxes and the addition of one {1) new wall-mounted panel antenna with a matching RF screen box on the south elevation of the building, exhibit a stealth design and remain consistent with City Council Policy No. 64, Wireless Communication Facilities. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the modifications maintain consistency with City Council Policy No. 64 and the WCF exhibits a stealth design. Community Development Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 760-602-4600 I 760-602-8560 f I www.carlsbadca.gov CD 2021-0002 (DEV02099)-SD07644 BANK OF AMERICA April 5, 2021 Pa e 2 3} The proposed revision does not change the density ar boundary of the subject property in that the modifications to the WCF ore proposed on the building. 4) The proposed revision does not involve the addition of o new land use not shown an the original permit in that the net increase of one {1} wall-mounted panel antenna substantially conforms to MCUP 1.0-15. 5) The proposed revision does not rearrange the major land uses within the development. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code . in that the net addition of one (1) wall-mounted panel antenna remains consistent with City Council Policy No. 64 and does not constitute a change greater than 10 percent. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the project is still considered exempt from CEQA review pursuant to Section 15301 (Existing Facilities) of the state CEQA Guidelines. 8) The proposed change would not result in any health, safety or welfare impacts in that with the posting of the appropriate signage, the project complies with the FCC rules and regulations. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that two {2} wall-mounted panel antennas will be replaced in-kind behind an RF screen boxes and one (1) additional panel antenna and RF screen box will be added to the south elevation of the building. The new wall- mounted antenna will be screened with the same material, design and color as the existing panel antennas. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determin_ation with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
