Background Every five years, preparation, adoption and submission of a UWMP is required by the California Department of Water Resources (DWR) for all urban water suppliers within the State of California that provide water to more than 3,000 customers or supply more than 3,000-acre feet of water annually. CMWD is subject to this requirement. The California Water Code (CWC) and the Urban Water Management Planning Act (Act) set forth requirements for these plans. The CWC also requires water suppliers to prepare a water shortage contingency plan (WSCP) which will be incorporated into the UWMP. In accordance with the CWC, this UWMP and WSCP must be adopted and submitted to the DWR by July 1, 2021. The Act states that urban water suppliers should make every effort to assure the appropriate level of reliability in water service is in place to meet the needs of its various categories of customers during normal, dry and multiple dry years. The Act also describes the required contents ofthe UWMP and procedures for adoption. Discussion The DWR's 2020 Urban Water Management Plan Guidebook {2020 Guidebook) provides guidance on preparing the UWMP to ensure compliance with the CWC. On March 29, 2021, the DWR released the 2020 Guidebook, which was issued significantly later than normal and resulted in water agencies having a condensed period to complete the UWMP. San Diego County water agencies also work with the San Diego County Water Authority on its UWMP, which needs to be completed prior to the agency-specific documents. Carlsbad Municipal Water District 5950 El Camino Real I Carlsbad, CA 92008 I 760-438-2722 t Board Memo -2020 Urban Water Management Plan (Districts -All) April 15, 2021 Page 2 On March 26, 2021, CWMD notified neighboring agencies that the draft UWMP will be available by May 7, 2021, on the city's website (www.carlsbadca.gov) for public review (Attachment A). The UWMP public review schedule is as follows: May 7, 2021 • The draft UWMP will be available on the city's website (www.carlsbadca.gov) for public review June 8, 2021 • The ewe-required public hearing will be held, and the draft document will be presented to the CMWD Board • To meet the DWR deadline, and if the Board requests changes to the draft document, staff will recommend delegating to the executive manager or designee authority to approve any changes for the final 2020 UWMP • Following the meeting, staff will revise the draft UWM P to address comments received at the public hearing July 1, 2021 • If the CMWD Board delegates authority to the executive manager or designee, and upon approval by the executive manager or designee, the final UWMP will be submitted to the DWR by this time Next Steps Staff will continue to coordinate with the San Diego County Water Authority and complete CMWD's draft 2020 UWMP based on the 2020 Guidebook. On June 8, 2021, a public hearing will be held at the CMWD Board meeting, and staff will notify the public in advance in accordance with the CWC. Any requested changes will be noted in the final 2020 UWMP. If the CMWD Board delegates authority to the executive manager or designee, and upon approval by the executive manager or designee, the UWMP will be submitted to the DWR by July 1, 2021. California state law, specifically California Water Code Section 10610-10610.4, requires each urban water supplier to prepare and adopt a UWMP every five years. CMWD is currently preparing an update to its 2015 UWMP. The 2020 UWMP documents CMWD's plans to ensure adequate water supplies to meet existing and future demands for water under a range of water supply conditions, including water shortages. This letter is also to inform you that CMWD is preparing an attachment to its 2020 UWMP to demonstrate consistency with Delta Plan Policy WR Pl, Reduced Reliance on the Delta Through Improved Regional Water Self-Reliance. Finally, this letter is to inform you that CMWD is preparing a Water Shortage Contingency Plan {Wsce), as a chapter of the 2020 UWMP. California state law, specifically Water Code Section 10632.3, requires every urban water supplier to prepare and adopt a water shortage contingency plan as part of its UWMP that details how the supplier intends to act in the case of a water shortage condition. In conformance with California Water Code Division 6, Part 2.6, §10621, this letter serves as notification to all city and county agencies, which CMWD provides water, that the UWMP is being reviewed, updated and the WSCP is being prepared. The draft 2020 UWMP and draft WSCP will be available for public review on the City of Carlsbad website (www.carlsbadca .gov) by Friday, May 7, 2021. Notice is hereby given that on Tuesday, June 8, 2021 at 3:00 P.M., at the virtual meeting available at www.carlsbadca.gov, the Board of Directors of CMWD will conduct a public hearing on the draft 2020 UWMP and draft WSCP. Immediately following the public hearing on June 8, 2021, the draft 2020 UWMP and draft WSCP will be considered for adoption by the CMWD Board of Directors. Per California Executive Order N-29-20, and in the interest of public health and safety, the City of Carlsbad is temporarily taking actions to prevent and mitigate the effects of the COVID-19 pandemic by holding City Council and other public meetings online only.
