of them.
Commissioners Merz, Kamenjarin, Meenes and Lafferty disclosed they are familiar with the site by either
driving by and or walking the site.
Commissioner Sabellico disclosed he viewed the site on google maps.
Chair Meenes asked if there were any members of the public who wished to speak on the project. He
opened public testimony at 4:05 p.m.
Residents Caroline Bo/, John Newton, Bob Monahan, Janet Newton, Kurt Hoy, and Terry Gagnon, submitted
comments that were requested to be read and were read into the record stating the project is too big, has
too many units, setbacks are too small, does not have adequate parking, will cause additional traffic,
safety issues, trash, does not aesthetically fit in the neighborhood, and do not want the property becoming
a short term vacation rental. They stated they do not want the project to be approved.
Howard Krausz, MD, President of North County Advocates submitted comments with concerns about
losing open space with the increased density of the proposed project and that the project must comply
with the general plan.
Chair Meenes asked if there were any additional member of the public who wished to speak on the
project. Seeing none, he closed public testimony at 4:20 p.m.
COMMISSION DISCUSSION:
Commissioner Merz stated the lot coverage is on the lower side and the proposed parking on site seems
to be disconnected to some of the comments from the public that the project will take parking away from
the neighborhood. He stated support for the project.
Commissioner Stine asked for additional information on the setback, density, and the time the project has
taken to get to planning commission.
Associate Planner Garcia stated the setback for the proposed project is the standard for the codes .today,
he explained the codes and policies in place allow rounding up to the 4 proposed units and that there was
a preliminary review that the applicant had submitted prior to an official application.
City Planner Neu added that the Beach Area Overlay was developed some years ago to address some of
the issues the community had with development in the beach area. He stated in the Beach Overlay Zone,
building height is lower, parking requirements are higher and the zoning of R-3 is reflective of a multi-
family designation.
Assistant City Attorney Kemp gave a brief overview of the Housing Accountability Act and how it applies
to the proposed project.
Commissioner Lafferty stated concern with the curb cuts and the sidewalk being circuitous. She stated it
cuts off the sidewalk and is really not direct access any longer for the residents and it's a bigger impact on
the neighborhood. She sated the planters will probably be difficult to maintain and the sidewalk comes
into the property line and then back out of the property. She stated that is what is hinging on her concern
with the project. She stated she would like to see the driveway reevaluated or a complete shift of 90

degrees of the buildings. She stated there is no geotechnical report and that the effect of storm water is
unknown because of all the paving. She stated concern about ADUs and the possibility of their being
additional units to what is proposed. She stated the project barely meets some of the requirements and
is not sure she can approve the project as proposed.
Commissioner Stine stated the design options, from his understanding, is to comply with ADA standards
and to address some of the neighbor's concerns. He acknowledged the input of comments both in support
and opposition to the project. He stated support for the project and that he could not make the requisite
findings to deny it under state law.
Commissioner Sabellico and Chair Meenes stated support for the project.
Commissioner Kamenjarin stated he has concerns with the number of comments submitted by the public,
parking, and the units being used for short term vacation rentals.
ACTION:
Motion by Commissioner Sabellico, seconded by Commissioner Merz, to adopt Resolution No. 7411.
Motion carried, 4/2/1 (Commissioners Kamenjarin and Lafferty no, Commissioner Luna absent).
PLANNING COMMISSION REPORTS/COMMENTS:
Commissioners Kamenjarin, Lafferty, and Sabellico gave a brief overview of the virtual League of California
Cities Planning Commissioner Academy they attended.
Commissioner Merz gave a brief overview of the last Community Development Bio.ck Grant meeting,
where he serves as a committee member.
