HomeMy WebLinkAboutCD 2021-0005; POINSETTIA 61 PATIO COVER PLAN; Admin Decision LetterJune 16, 2021 Alan Chik 15131 Alton Parkway, Suite 365 Irvine, CA 92618 SUBJECT: CD2021-0005 (DEV014060}-POINSETTIA 61 PATIO COVER PLAN {'city of Carlsbad 8FILE COPY ,n(,l,leJ h/1a/z1 The City Planner has completed a review of your application for a Consistency Determination on the property located at APNs: 215-023-02-24, 215-023-11-01, and 215-023-12-29 which is a modification to GPA 14-06/2C 14-04/LCPA 14-06/CT 14-10/PUD 14-12/SDP 14-15/CDP 14-34/ HDP 14-07 /HMP 14-04 - POINSETTIA 61 that approved the development of a 50.8-acre site for a 123-unit single-family detached condominium project. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modification includes: • A patio cover plan which demonstrates the area allowed for attached patio covers for condominium units within the Treviso subdivision. Proposed patio covers are required to comply with this patio cover plan. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the modification only includes the proposal to allow attached patio covers for each residential unit within the Treviso subdivision within the approved areas as shown on Exhibits '~" -"B." If a property owner elects to construct a patio cover, the patio cover is required to be consistent with the residence in material, color and design to ensure compatibility with the approved project. Therefore, the modification will not alter or eliminate any condition, feature, facility, or amenity that had been considered essential to the approved project. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the revision includes an upgrade in the design of the approved subdivision in that the patio covers will accent the residences by providing variation to wall planes. The patio covers will be compatible with the neighborhood in that the material, design, and color must match each residence. 3) The proposed revision does not change the density or boundary of the subject property in that the modification will allow for attached patio covers within the boundary of each approved residence and will not result in the construction of additional dwelling units or adjustments to the property line boundary. The existing lot coverage is 37 percent and with the proposed modification to allow for patio covers, the lot coverage wlll be 47 percent and therefore, the proposed revision to allow patio covers for each residence will result in only a ten percent change in lot coverage while maintaining compliance with all applicable development standards in the Carlsbad Municipal Code such as height and setbacks. 7} The proposed change will not result in any significant environmental impact, and/or require additional mitigation because the proposed modifications are categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303 -New Construction or Conversion of Small Structures of the state California Environmental Quality Act Statute and Guidelines. The proposed modifications do not create any potential impacts not previously addressed. 8) The proposed change would not result in any health, safety or welfare impacts. 9} There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved because the proposed modification to allow attached patio covers to each residential unit represents a minor change to the site. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
