City Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 May 19, 2021 CALL TO ORDER: 3:00 p.m. ROLL CALL: Kamenjarin, Lafferty, Luna, Meenes, Merz, Sabellico, and Stine APPROVAL OF MINUTES: Motion by Commissioner Lafferty, seconded by Commissioner Stine to continue the April 7, 2021 minutes. Motion carried 6/0/1 (Commissioner Luna abstained). PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None PLANNING COMMISSION PUBLIC HEARING: 1. 2. CDP 2020-0044 (DEV2020-0254)-GIBSON FAMILY RESIDENCE -Request for approval of a Coastal Development Permit to allow for the construction of a 3,266-square-foot, one-story single-family residence with a 807-square-foot attached garage on a 0.40-acre vacant lot located on the southwest corner of Park Drive and Hillside Drive within the Mello II Segment of the city's Local Coastal Program and Local Facilities Management Zone 1. The project site is not located within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a), construction of a single-family residence, of the state CEQA Guidelines. CDP 2020-0018 (DEV2020-0111) -FORESTER RESIDENCE -Request for approval of a Coastal Development Permit to allow for the demolition of an existing residence and the construction of a new 4,085 square foot single-family residence within the Mello II Segment of the city's Local Coastal Program located at 4464 Adams Street within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a) construction of a single-family residence of the state CEQA Guidelines. Chair Meenes asked if any public comments were submitted for Agenda Items 1 and 2. City Planner Neu confirmed that no comments were submitted Agenda Items land 2. SDP 2018-0014/MS 2018-0011 (DEV2018-0156) -635 PINE AVE CONDOS Request for a recommendation of approval of a Site Development Plan and Tentative Parcel Map to construct a four-unit residential air-space condominium project on a 0.19-acre site in the Pine- Tyler Mixed-use (PT) district of the Village and Barrio Master Plan on property generally located at 635 Pine Avenue In Local Facilities Management Zone 1. The City Planner has determined that this project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment and is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to section 15303(b) (New Construction or Conversion of Small Structures) of the State CEQA guidelines. City Planner Neu introduced Agenda Item 3 and stated Associate Planner Danna would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioner Lafferty disclosed visiting the site and having read the historic and geologicalreports. Commissioners Stine, Kamenjarin and Chair Meenes disclosed walking around and driving by the site. Commissioner Sabellico reviewed the site on Google Maps. Chair Meenes asked if there were any members of the public who wished to speak on the project. He opened and closed public testimony at 3:40 p.m. COMMISSION DISCUSSION: Chair Meenes asked if any information should be known, given that the project is located in the Pine Tyler district which has a growth management control point. City Planner Neu responded that with actions taken on the housing element and changes to state law, City Council suspended some of the provisions in the general plan, the growth management plan, and council policy no. 43 related to the growth management control point. He stated that the city cannot limit someone to available units in the bank. However, the number of units will continue to be tracked as it would have been with control points, in the event that state laws change to allow limitations. Commissioner Stine stated support for the project noting that it will be an asset to the area and community. Commissioner Meenes stated support for the project noting that the architecture is welt designed given the confines of the area. ACTION: Motion by Commissioner Luna, seconded by Commissioner Stine, to adopt Resolution No. 7413. Motion carried, 7 /0. 4. SUP 2020-0001/HMP 2020-0001 (PUB2020-0003) -VISTA-CARLSBAD INTERCEPTOR REACH 1 -Request for approval to upgrade, realign, and rehabilitate the existing Vista-Carlsbad (VC) Interceptor Reach 1 access road to provide more reliable access to the VCl pipeline and manholes for maintenance and during heavy rainfall events generally located south of SR 78, north of Buena Vista Creek, and between the eastern terminus of Haymar Drive (west of Planning Commission Minutes May 19, 2021 Page 3 College Boulevard) and the western terminus of Haymar Drive (east of El Camino Real) in Local Facilities Management Zone 25. The City Planner has . determined that the potential environmental effects of the project were adequately analyzed by the previously certified Supplemental Program Environmental Impact Report (SPEIR) (State Clearinghouse Number 2007091072) for the Comprehensive Sewer Master Plan. City Planner Neu introduced Agenda Item 4 and stated Associate Planner Dan would make the staff presentation (on file in the Planning Division). DISCLOSURES: Chair Meenes disclosed driving close to the site, on the adjacent road . Commissioner Lafferty disclosed familiarity with the site and noted the Marron Adobe house is a property of concern to the Historic Preservation Commission . STAFF AND APPLICANT QUESTIONS: Chair Meenes asked for clarification on the material to be used for the acces.s road. Associate Planner Dan responded that crushed rock was selected to allow stormwater to flow easily as asphalt presents challenges to preservation. He added that the selected material is the best choice for environmental purposes. Commissioner Lafferty asked whether the project will impact the Marron Adobe property. Associate Planner Dan responded that the distance of the project from the Marron Adobe property was analyzed within the 2019 environmental report. He stated that impact of the project to the Marron Adobe house was determined to be less than significant. Commissioner Lafferty asked whether there is an easement on the property. City Planner Neu added that sheet 3-01 of the full-size exhibits show that the easement is outside the Marron Adobe property lines. Commissioner Lafferty asked if the Historic Preservation Commission has been notified of the proposed project. Associate Planner Dan responded that the project has not been presented to the Historic Preservation Commission. Chair Meenes asked if there were any members of the public who wished to speak on the project. He opened and closed public testimony at 4:12 p.m. COMMISSION DISCUSSION: Commissioner Luna expressed satisfaction with the conditions of approval and comfort that staff has addressed any issues that may come up with the Historic Preservation Commission. She stated support for Agenda Item 4. Commissioner Stine stated support for the project from a safety and environmental perspective.
