June 2, 2021 CALL TO ORDER: 3 p.m. City Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 ROLL CALL: Kamenjarin, Luna, Meenes, Merz, Sabellico, and Stine Lafferty absent APPROVAL OF MINUTES: Motion by Commissioner Stine, seconded by Commissioner Sabellico, to approve the April 7, 2021 meeting minutes as amended. Motion passed 5/0/1/1 (Commissioner Luna abstained; Commissioner Lafferty absent.) PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None PLANNING COMMISSION PUBLIC HEARING: Chair Meenes directed everyone's attention to the slide on the screen to review the procedures the Commission would be following for that evening's public hearing. Chair Meenes opened the public hearing for Item 1. 1. AMEND 2020-0015 (DEV01052) -HIGHLAND ACADEMY -Request for the approval of a third amendment to Conditional Use Permit CUP 01-12 to allow two additional staff members and half- time students, and to approve a time extension retroactively to Conditional Use Permit CUP 01-12 without an expiration date, for the educational institution located at 3016 Highland Drive in Local Facilities Management Zone 1. The City Planner has determined that the project site belongs to a class of projects that the State Secretary of Resources has found do not have significant impact on the environment, and it is therefore categorically exempt pursuant to Section 15301 -Existing Facilities -of the state California Environmental Quality Act (CEQA) and . the City of Carlsbad Municipal Code Section 19.04.070(A)(l)(b). City Planner Neu introduced Agenda Item 1 and stated Principal Planner Jones would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioner Merz, Stine, Luna, and Meenes, disclosed they drove by the site. Principal Planner Jones gave the staff presentation. Chair Meenes asked if there were any members of the public who wished to speak on the project. Seeing none, he opened and closed public testimony at 3:15 p.m. Planning Commission Minutes June 2, 2021 Page2 The Commission thanked staff for the recommendation to eliminate the conditional use permit expiration date recognizing that the conditional use permit already has a condition that allows the permit to be revoked or modified if it is found that the use has a substantial detrimental effect on surrounding land uses and the public's health and welfare, or the conditions imposed herein have not been met. The Commission agreed that requiring conditional use permits to be extended after a specified time period creates unnecessary work and cost for business operators and city staff. ACTION: Motion by Commissioner Luna, seconded by Commissioner Merz, to adopt Resolution No. 7416. Motion carried, 6/0/1 (Commissioner Lafferty absent). 2. Planning Commission Discussion of the Start Time for Future Meetings -Discussion by the Planning Commission of the preferred start time for regular meetings. DISCUSSION City Planner Neu stated one option is to wait for the City Council to make a decision on returning to in person meetings and the start time. Commissioners Kamenjarin, Stine, and Luna stated the start time of 3 p.m. is preferred. Commissioner Stine stated he would like the commission to make a recommendation to the City Council. Assistant City Attorney Kemp stated the municipal code says the Planning Commission can set their own meeting time. He stated the most recent resolution that was adopted, sets the meeting time of 6 p.m. He stated the City Council is set to discuss in person meetings on June 22, 2021. Commissioner Sabellico stated he would like to see the meeting stay at a start time of 6 p.m. so that the public can participate as well as that is the start time currently set. He stated he would be against moving the meeting to 3 p.m. permanently if he were to vote today. Commissioner Merz stated he has seen public participation increase during the virtual format of public hearings as well as the quality of participation. The Planning Commission asked City Planner Neu to provide the City Manager with a memo to include discussion around the start time of meetings once we return to an in person format. PLANNING COMMISSION REPORTS/COMMENTS: Commissioner Luna asked the status of the Housing Element. City Planner Neu stated the city is waiting on comments back from the State.
