The contractor shall protect all existing construction from damage, and shall repair, at his cost, any damage resulting from his operations. Contractors on 1he job shall carry the following insurance: (1) Worker's Compensation; (2) Public Comprehensive General Liability; and (c) Property Damage. In an emergency threatening the life, safety or adjacent work, the Contractor is hereby instructed to act at his discretion to prevent such loss or injury. The contractor shall maintain the following minimum liability coverage during 1he contract period: Bodily Injury: $250,000 per individual per occurrence, Property Damage: $100,000 per occurrence, aggregate. 2. The Contractor shall cause to be named as additional insured in such Contractor's Public Liability and Automobile Liability policies the following: (a) Rancho Ponderosa HOA; (b) Howard Associates, Inc. 3. The Contractor agrees to hold harmless the owner and Landscape Architect from any claims arising out of his operations or the operations of any of his subcontractors, material suppliers or agents. 4. All local municipal and state and federal laws, rules and regulations governing or relating to any portion of this work are hereby incorporated and made a part of these specifications and their provisions shall be carried out by the Contractor. The Contractor shall notify the Landscape Architect immediately of any discrepancies between codes and 1he information and designs presented in these drawings. 5. The Contractor shall verify the locations of all existing utilities, structures and services before beginning work. the locations of these items shown in the plans are approximate only, and there may be additional utilities present which are not indicated on these plans. The Contractor shall notify the Landscape Architect immediately of any discrepancies between field conditions and the information and designs presented in these drawings. 6. The Contractor shall obtain and review a set of the appropriate architectural, electrical and civil engineering plans prior to beginning work. 7. Permits for all work indicated in these plans shall be obtained by the Contractor. 8. The Contractor shall have a valid contractor's license for the particular work being performed. The contractor shall not allow the license to lapse during the contract period. 9. No material substitutions of any kind will be allowed wi1hout the express written authorization of the Landscape Architect. 10. Contractor shall provide storm water and non-storm water pollution prevention measures and best management practices established by the City Engineer in accordance with Carlsbad Storm Water Best Management Practices. 11. Contractor shall notify the City's Planning Department at least two working days prior to start of landscape work. 12. HOA shall permanently and fully maintain all landscape improvements shown herein. 13. Contractor shall provide an agricultural suitability soils analysis report from a certified agronomic testing laboratory for all landscaped areas. Submit two (2) copies of the report to the City's representative prior to start of landscape work. 14. Owner/Developer shall provide as-built plans of the irrigation system to 1he Owner and City prior to final acceptance and final payment. As-built plans shall be one mylar reproducible set on standard City "D"-size sheets. 15. Construction of any private improvements in the public right-of-way shall require an encroachment removal agreement with the City. Contractor shall obtain an encroachment permit from the City of Carlsbad prior to planting trees and construction of other landscape improvements in the public right-of-way or general utility easements. Encroachment permits shall be reviewed and approved by the Department of Public Works. 16. Contractor shall notify "Dig-Alert" (800-226-2700) prior to any excavation in the public right-of-way or general utility easements. Refer to the specifications for the schedule of required inspections and required submittals. Following completion of the work, the Landscape Architect of the Work will certify that the installation has been completed by submitting the "Final Landscape Certification Form". A request for a final landscape inspection by the City must also be made by calling the Inspection Request Line. Pipe between the meter and backflow preventer shall be "Schedule K hard copper•. An approved backflow testers list can be found at the offices of the Olivenhain Municipal Water District. Existing backflow prevention devices are already in the Olivenhain Municipal Water District program. No testing is necessary.
