APPROVAL OF PROPOSED THREE-YEAR RATES FOR POTABLE WATER, RECYCLED WATER AND WASTEWATER SERVICES-1) Adoption of Resolution No. 2022-009 approving three-year rates for wastewater services; and 2) Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1667 approving three-year rates for potable water and recycled water services. (Staff contact: Vicki Quiram and Shoshana Aguilar, Public Works) City Manager's Recommendation: Take public input, close the public hearing and adopt the resolutions. DEPARTMENTAL AND CITY MANAGER REPORTS: 11. DETERMINATION TO CONTINUE VIRTUAL PUBLIC MEETINGS OR RESUME IN-PERSON PUBLIC MEETINGS BEGINNING JAN. 15, 2022 -Discuss how to proceed with public meetings until Feb. 10, 2022, and take one of the following actions: 1) Consider adoption of Resolution No. 2022-010 making findings in accordance with·AB 361 to continue virtual public meetings until Feb. 10,2022;or 2) Direct staff to resume in-person public meetings beginning Jan. 15, 2022. Fire Chief Michael Calderwood presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The following individuals called into the City Council Meeting and voiced their comments for the record: A speaker requested hybrid City Council meetings or conducting City Council meetings outside in the courtyard beginning Jan. 15. Kelly LeBerthon thanked staff for the report and encouraged information on fighting the virus. Tamara Dixon urged the City Council to resume in person City Council meetings on Jan. 15 meeting outside in the courtyard. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-010. Motion carried, 4/1 (Hall -No). 12. UPDATE· ON THE CITY OF OCEANSIDE'S PLANNED BEACH SAND REPLENISHMENT AND RETENTION DEVICE PROJECT AND PROPOSED STATEMENT OF OPPOSITION -Adoption of Resolution No. 2022-011 approving the City Council's statement of opposition to constructing devices that could interfere with the natural flow of beach sand into Carlsbad. (Staff contact: Kyle Lancaster, Parks & Recreation) Jan.11,2022 Carlsbad City Council Regular Meeting Page 5 City Manager's Recommendation: Receive the update and adopt the resolution. Parks & Recreation Director Kyle Lancaster presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The following individuals called into the City Council Meeting and voiced their comments for the record: John Rause explained that sand ret~ntion is important to all beach cities and expressed his · opposition to the resolution. John Maschue expressed his opposition to the resolution. City of Oceanside Mayor Esther Sanchez expressed her desire to work together on this regional issue. City of Oceanside Deputy Mayor Ryan Keim spoke of the importance of this project and explained the goal of the sand nourishment program. Jayme Timberlake expressed her opposition to the resolution. Save Oceanside Sand Co-Founder Nick Richie expressed his opposition to the resolution and asked for the item to be postponed. Bob Ashton expressed his concerns with the lack of sand in Oceanside and added that Oceanside and Carlsbad must work together to develop a regional shoreline solution that is adaptive to climate change. Matt Caulfield expressed his opposition to the resolution. John Teneglia requested that the City Council work with the City of Oceanside to come to a solution that will work for everyone. Bob Walker apologized for the Jack of dialogue between the City of Oceanside and the City of Carlsbad and explained that Oceanside's progran:, is only a pilot program. Elise Withera/1 spoke of the many structures built in the past that has contributed to severe do.wn coast erosion and sand Joss and expressed her opposition to the resolution. Katie Taylor requested that the resolution be put on hold until more information can be obtained. Pierre Cochet-Weinardt provided the reasons behind the Joss of sand on the Oceanside and Carlsbad beaches. Jan. 11, 2022 Carlsbad City Council Regular Meeting Page 6 Surfrider Foundation Policy Manager Laura Walsh explained that the Coastal Commission has not approved any projects utilizing groins and expressed her support of the resolution. In response to Council Member Bhat-Patel's inquiry, Parks & Recreation Director Lancaster explained that the resolution is a general statement opposing and taking a stand against any plan from any entity that is being brought forward and would negatively affect Carlsbad in terms of sand retention or replenishment. Parks & Recreation Director Lancaster added that it would also include any structure that would obstruct the natural sand flow to Carlsbad. In response to Council Member Bhat-Patel's inquiry, Parks & Recreation Director Lancaster explained that the City of Carlsbad was not given the opportunity to be a key stake holder nor be brought to the table before the project was brought before the City of Oceanside City Council on Aug. 11, 2021, and that the City of Oceanside expressed the omission was inadvertent. Council Member Norby explained that he had an issue with the word "inadvertently" being used when being left out of the decision to go forward with the project by the City of Oceanside. In response to Council Member Norby's inquiry, Parks & Recreation Director Lancaster explained that the City of Carlsbad would typically make an attempt to reach out to neighboring cities and that the City of Oceanside expressed that they were in error in not reaching out. In respons~ to Council Member Acosta's inquiry, City Manager Chadwick explained that he was contacted by the City of Oceanside on Dec. 28, 2021 regarding the project that had been passed by the City of Oceanside's City Council on Aug. 11, 2021. Mayor Pro Tern Blackburn explained that more collaboration needs to take place between all of the neighboring cities when projects like this are happening. In response to Mayor Pro Tern Blackburn's inquiry, City Manager Chadwick explained that the City Council's action on the item today does not foreclose any further discussion in the future and added that the Beach Preservation Commission voted unanimously to oppose the City of Oceanside project. City Manager Chadwick recommended the City Council hear the item and pass the resolution opposing the construction of devices that could limit sand flow to Carlsbad. Mayor Hall explained that the primary concern is to establish collaboration, move forward and work together with the City of Oceanside. Council Member Norby expressed his disappointment in the City of Oceanside's decision and added that for the record he is asking that the City of Oceanside reconsider their decision and rescind that decision. Council Member Norby requested that a copy of the resolution be sent to the San Diego Association of Governments (SAN DAG) and the Coastal Commission as well. Jan.11,2022 Carlsbad City Council Regular Meeting Page 7 Council Member Bhat-Patel explained that she had heard of the project at the Shoreline Preservation Working Group and concerns were raised by other cities in attendance. She added that the various cities want to be included in the conversation with the City of Oceanside to find a regional solution. Council Member Acosta explained that this is a regional issue and that she strongly supports the resolution. Mayor Pro Tern Blackburn agreed with Council Member Norby's suggestion to send the resolution to SANDAG and the Coastal Commission. He also requested to add the following sentence to the resolution: "working cooperatively with the City of Oceanside and other coastal cities to come to a solution." Mayor Hall expressed that he still has many questions, but sand and beach preservation should be priority number one. City Attorney Brewer suggested that the resolution language be amended to read as follows: Under the "Now Therefore Be It Resolved" section, sentence two, be changed to read: "2. That the City of Carlsbad opposes the construction of devices that could interfere with the natural flow of beach sand into Carlsbad" striking out the "Hereby approved" language and the "statement of opposition." Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-011, adding that the City Council directs staff to work cooperatively with the City of Oceanside and other coastal cities, and that the information be forwarded to SANDAG a.nd the Coastal Commission, and to include language as amended. Motion carried unanimously, 5/0. Mayor Hall declared a recess at 4:57 p.m. Mayor Hall reconvened the meeting at 5:10 p.m. PUBLIC HEARING: This item was heard at 5 p.m. 10. Jan. 11, 2022 Carlsbad City Council Regular Meeting Page 8 Utilities Director Vicki Quiram and Senior Management Analyst Shoshana Aguilar presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 5:20 p.m. The following individual called into the City Council Meeting and voiced their comment for the record: Ellie Arkans expressed concern over the rate increases and asked if the new housing developments would be included in the calculations of the cost for shipping the water into Carlsbad. Hearing no one else wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 5:23 p.m. Utilities Director Quiram addressed the community member's question explaining that the Cost of Service Study is very detailed and allocates costs to everyone who uses the services and everyone who uses water services pays their fair and equitable share. In response to Mayor Hall's inquiry, Utilities Director Quiram explained that residential water rates are a fixed cost, most of the other customers are charged by their meter size, and that the charges are in tiers. She explained that the higher the tier the higher rate of water costs. In response to Council Member Norby's inquiry, Utilities Director Quiram explained that consideration was given to stretching the commercial wastewater rate increases out several years but that since Carlsbad's rates are so far behind, the rates need to be increased within three years instead of five. City Clerk Services Manager Faviola Medina announced the following: The City Clerk's Office received a total of 26 written protest letters from citizens of Carlsbad. These 26 letters were a variation of which rates were being protested and are as follows: To achieve a majority protest for potable water, the City Clerk's Office would need to hdve received 14,!03 written protest letters. We received 21. To receive majority protests for recycled water, we would need to have received 496 written protest letters. We received 15. To achieve a majority protest for wastewater, we would need to have received 12,054 written protest letters. We received 22. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt City of Carlsbad Resolution No. 2022-009 and CMWD Resolution 1667. Motion carried, 5/0. 13. 2022 LEGISLATIVE PLATFORM AND LEGISLATIVE PROGRAM UPDATE -1) Adoption of Resolution No. 2022-012 approving the City of Carlsbad 2022 Legislative Platform; and 2) Direct staff to advocate for two-city sponsored state legislative proposals and funding; and 3) Receive a presentation on state legislative and budget activity and recent and ongoing Jan.11,2022 Carlsbad City Council Regular Meeting Page 9 advocacy efforts and provide feedback to staff. Intergovernmental Affairs Director Jason Haber presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Intergovernmental Affairs Director Haber listed two revisions to Attachment A of the resolution, on pages 1 and 2, changing 2021 to 2022. Intergovernmental Affairs Director Haber presented a report on state budget requests and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). DISTRICT 1 APPOINTMENT OF ONE MEMBER TO THE COMMUNITY DEVELOPMENT BLOCK GRANT CITIZEN ADVISORY COMMITTEE -Adoption of Resolution No. 2022-013 appointing one member to the Community Development Block Grant Citizen Advisory Committee. (Staff contact: Tammy McMinn, City Clerk Department) City Manager's Recommendation: Adopt the resolution. Motion by Council Member Norby, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2022-013 appointing John May to the Community Development Block Grant Citizen Advisory Committee. PUBLIC COMMENT (CONTINUED): The following individuals called into the City Council Meeting and voiced their comments for the record: Anthony Bona spoke in response to a slide in the presentation in Item No. 13. Ellie Arkans expressed her concerns about the new contract with Republic Services and requested an alternative trash service option. Tamara Dixon expressed her concerns about the Homeless Response Plan and one of the city's priorities being homelessness issue in Carlsbad. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. ANNOUNCEMENTS: Mayor Hall announced that not more than two Council Members will be found in any one place over the next week, and thanked City Manager Chadwick and staff for a job very well done on the presentations.
